Caldwell, husband and wife, the Grantors, do hereby grant, bargain, convey and sell to the CITY OF TUKWILA, King County, Washington, a municipal corporation, the Grantee, the following described improvements situated in King County, Washington: 72 LF of 8 -inch ductile iron pipe and 1 Type 1 CB for storm drainage, as shown on the public facility plans referred to as D99 -0104, the Caldwell Residence development. c c7 Improvements located within the right -of -way of South 136 Street, are legally described in Exhibit `A', attached hereto and by this reference made a part hereof. Together with any other appurtenances thereto. To have and to hold the same for the said Grantee, it's successors and assigns forever. The undersigned hereby covenants that it is the lawful owner of said property; that the same is free from all encumbrances; that all bills for labor and material have been paid; that it has the right to sell the same as aforesaid; that it will warrant and defend the same against the claims and demands of all persons and will pay any costs, including reasonable attorney fees incurred by Grantee, arising out of any such claim or demand. The Bill of Sale is given in consideration of the agreement of the Grantee, for itself, its Successors and assigns to incorporate said utilities in its utility system and to maintain them as provided for in applicable City Ordinances.
