AN ORDINANCE ORDERING THE IMPROVEMENT OF PROPERTY
WITHIN THE CITY OF TUKWILA, WASHINGTON, ALONG
PORTIONS OF SOUTH 152nd STREET AND 57th AVENUE SOUTH
BY ACQUISITION OF ADDITIONAL RIGHT -OF -WAY, WIDENING,
PAVING AND GRADING THE STREET SURFACE, INSTALLATION OF
CURBS AND GUTTERS, SIDEWALKS, STORM AND SANITARY
SEWERS, WATER FACILITIES, UNDERGROUND UTILITIES,
AND AN ILLUMINATION SYSTEM; ESTABLISHING LOCAL
IMPROVEMENT DISTRICT NO. 30; PROVIDING THAT PAYMENT
FOR SAID IMPROVEMENTS BE MADE BY SPECIAL ASSESSMENTS
UPON THE PROPERTY SPECIALLY BENEFITTED THEREBY; AND
PROVIDING FOR THE ISSUANCE OF LOCAL IMPROVEMENT
DISTRICT WARRANTS AND LOCAL IMPROVEMENT DISTRICT BONDS
WHEREAS, by Resolution No. 737, adopted May 18, 1980, the
City Council of the City of Tukwila declared its intention to
improve an area within the Tukwila city limits along portions
of South 152nd Street and 57th Avenue South, and to create a
Local Improvement District to assess the cost and expense of
carrying out such improvements against the properties specially
benefitted thereby; and
WHEREAS, Horton Dennis Associates, Inc., Consulting
Engineers for the City, caused an estimate to be made of the
costs and expenses of the proposed improvements, and certified
that estimate to the Tukwila City Council, together with all
papers and information in the possession of the Consulting
Engineer touching the proposed improvement; and
WHEREAS, Horton Dennis Associates, Inc., and the City of
Tukwila Department of Public Works have prepared a description
of the boundaries of the District, a statement of the costs and

expenses of the improvement to be borne by the properties
within the proposed District, and a statement in detail of the
local improvement assessments outstanding or unpaid against the
properties in the proposed District; and
WHEREAS, the above mentioned estimates and statements are
accompanied by a diagram of the proposed improvement showing
thereon the lots, tracts, parcels of land and other property
which will be specially benefitted by the proposed improvement,
and the estimated amount of the cost and expenses thereof to be
borne by each lot, tract and parcel of land or other property;
and
WHEREAS, the City of Tukwila has given due notice that all
persons who may desire to object to the improvements
contemplated herein and by Resolution No. 737 may appear and
present their objections at a hearing to be held in the Council
Chambers in the Tukwila City Hall, 6200 Southcenter Boulevard,
Tukwila, Washington, at 7:00 P.M. on June 23, 1980; and
WHEREAS, the City Council has determined it to be in the
best interests of the City that the improvements described
below be carried out and that a Local Improvement District be
created in connection therewith,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA
DOES ORDAIN AS FOLLOWS:
Section 1. The City Council of the City of Tukwila hereby
orders the construction of street improvements for a portion of
South 152nd Street and 57th Avenue South, consisting of the
acquisition of additional right -of -way, the grading, widening
and paving of street surfaces, the installation of sidewalks,
curbs and gutters, storm and sanitary sewers, water facilities,
underground utilities and an illumination system, as are more
particularly shown in Exhibit "A" attached hereto and by
this reference made a part hereof. All of the foregoing shall
be in accordance with the plans and specifications therefor
prepared by Horton Dennis Associates, Inc., Consulting
Engineers to the City, and amendments thereto.
Section 2. There is hereby created and established a Local
Improvement District to be designated Local Improvement
District No. 30 of the City of Tukwila, Washington, all within
the city limits of the City of Tukwila, the boundaries of which
are more particularly shown in Exhibit "A" attached hereto
and by this reference made a part hereof. Local Improvement
District No. 30 shall include, as nearly as may be possible,
all property specially benefitted by the improvements
contemplated herein.
Section 3. The total estimated cost of the improvements
described in Section 1 is declared to be $275,000, all of which
shall be borne by and assessed against the property specially
benefitted thereby, which property shall be included in the
Local Improvement District herein established.
Any assessments collected hereunder shall be for the
sole purpose of payment into the separate fund created by
Section 5, below.
The assessment charged against any lot, tract, parcel
of land or other property, or any portion thereof, may be paid
without interest during the thirty (30) day period following
the first publication by the Finance Director of notice that the
assessment roll is in the Finance Director's hands for collection
The sum remaining unpaid may be paid in 10 equal annual
installments.
Interest at the rate, hereafter to be fixed by ordinance on the wholE
amount shall be due on the due date of the first installment of
principal, and each year thereafter on the due date of each
installment of principal.
Assessments or installments thereof, when delinquent,
in addition to the normal rate of interest, shall accrue a
penalty at the rate of five (5%) percent per annum.
Section 4. Pursuant to RCW 35.44.047, the City may use any
method or combination of methods to compute assessments which
may be deemed to fairly reflect the special benefits to the
properties being assessed.
Section 5. The Tukwila City Finance Director shall establish and
keep a separate fund to be known as "Local Improvement Fund,
District No. 30 All assessments for local improvements in
Local Improvement District No. 30 shall be kept in that fund.
Local Improvement Fund, District No. 30, shall be used
for the redemption of warrants drawn upon, and bonds issued
against, the Fund to provide payment for the cost and expense
of the improvements contemplated herein.
Section 6. Local Improvement District warrants shall be
issued in payment of the cost and expense of the local
improvements contemplated herein, which warrants shall be
payable out of Local Improvement Fund, District No. 30. Such
warrants shall bear interest from the date thereof at the rate
to be hereafter fixed by ordinance, and shall be redeemable in
cash and /or by Local Improvement District bonds which may be
issued.
Section 7. Local Improvement District bonds may be issued
to pay for the whole or any portion of the cost and expense of
the local improvements contemplated herein. In no event shall
such bonds be issued in excess of the cost and expense of the
improvements, nor shall such bonds be issued prior to twenty
(20) days after the thirty (30) days allowed for the payment of
assessments without penalty or interest.
Local Improvement District bonds shall be payable on
or before 12 years from the date of issuance, the life
of the improvement ordered being not less than 12
years.
Such bonds shall bear

Local Improvement District bonds may be issued in
exchange for, and in redemption of, any warrants issued
hereafter and not redeemed in cash within a period of sixty
(60) days after the first publication by the City Finance Director of
a notice that the assessment roll for Local Improvement
District No. 30 is in the Finance Director's hands for collection.
The Local Improvement District bonds shall be redeemed
by funds from the collection of the special assessments to be
assessed upon the property within Local Improvement District
No. 30.
The exact form, amount, date, interest rate and
denomination of such Local Improvement District bonds shall be
hereafter fixed by ordinance, and the bonds shall be sold in
such manner as the City Council shall hereafter determine.
Section 8. All the work necessary to be done in connection
with the improvements contemplated herein shall be done
pursuant to contracts awarded through competitive bidding. The
City shall have the right to reject any and all bids received.
The call for bids for work authorized by this ordinance shall

include a statement that payment for such work will be made in
cash warrants drawn upon the Local Improvement Fund, District
No. 30.
