This sewer easement is through a portion of the following
described property:
Beginning at the Northwest corner of Joseph Foster Donation Claim
No Township 23 North, Range 4 East W.M.; thence North 89.49'
East 368.30 feet to the East, line of County Road and the true point of
9 nning; thence South 8 East along said East line 90 feet;
thence North 89'49' East 100 feet; thence North 8 West 90 ft.;
i thence South 89'49' West 100 ft. to the true point of beginning.
This iMXKV* easement consists of a 5 foot permanent .easement
described as the Northerly 5 feet of the Westerly 50 feet of the
above described tract as measured at right angles to the North line
of Joseph Foster Donation Claim No. 39, Twp. 23 North, Rang] 4 East
W.M., as established by Leonard I. Schroeter, Land Surveyor, on
September 3, 1965.
TOGETHER WITH a 20 foot temporary construction easement described
as the Northerly 20 feet of the Westerly 50 feet of the above described
tract as measured at right angles to the North line of said Donation
Claim No. 39, Twp. 23 North, Range 4 East W.M., as established.by
Leonard I. Schroeter, Land Surveyor, on September 3, 1965.

That said Grantee shall have the Wight without prior in
of any suit or proceeding at law, at times as may be necessary, to enter
upon said property for-the purpose of constructing, repairing, altering,
or reconstructing laid utilities or making any connections therewith,
without incurring any legal obligation or liability therefor; provided
that such con repairing, altering, or reconstructing of said
utilities shall be accomplished in such a manner that the pr ivate im--
proveme�nts existing in this right -of- way shall not be disturbed or des
troyed, or in the event they are disturbed or destroyed, they will be
IJ7 replaced in as good a condition as they were immediately before the
C) property was entered upon by the Grantee.

The Grantor shall retain the right to use the surface of said
easement, so long as said use does not interfere with the installation
and maintenance of the utilities and so long as no permanent buildings
or structures are erected on said easement.
This easement shall be a covenant running with the land and shall
be binding on the successors, hears, and assigns of both parities hereto.
