THIS EASEMENT AGREEMENT is made and entered into by and between the undersigned owner (grantor) in fee simple of the land described herein. And is for the benefit of the Grantee. For and in consideration of the mutual covenants, an agreement hereinafter expressed and other good and valuable considerations, in hand paid, receipt of which is hereby acknowledged, the parties hereto agree as follows: 1. Grantee shall install said Sanitary Sewer System at their sole cost and expense and shall continue to maintain and shall continue to bear all cost of repair and maintenance or repair of said Sanitary Sewer System. 4. Grantee shall hold Grantor harmless from and against any and all claims which may be made against Grantor arising out of the installation, operation, maintenance or repair or said Sanitary Sewer System. 5. The herein easement and agreement may be amended only with the written agreement of the Grantee herein. This easement agreement shall run with the land and shall be binding on all parties having or acquiring any right, title or interest in the land described herein or any part thereof.
