HomeMy WebLinkAbout1964 - Easement for Utility Line - Southcenter Corporation - 5792901t EASEMENT FOR UTILITY LINE F 14 r ,r The Grantor, SOUTHCENTER CORPORATION, a Washington corporation, for and in consideration of the sum of One Dollar in hand paid, receipt of which is hereby acknowledged, does hereby grant, sell and convey to the City of TUKWILA, Washington, a municipal corporation, Grantee, its successors and assigns, an easement and right -of -way over, through, under across, upon and in the following described real property situated in King County, Washington, to -wit: An easement 15 feet wide, the centerline of which is 90 feet southerly of the centerline of Tukwila Parkway, a roadway of the City of Tukwila deeded to the City -under King County Auditor's Receiving No. 5735981 and described in Exhibit "A" attached hereto, and the centerline of which is 90 feet easterly of the centerline of 57th Avenue South, a roadway of the City of Tukwila deeded under the same king County Auditor's receiving number, which said centerline is also described in Exhibit "A" attached hereto, (EXCEPT, that portion thereof lying southerly of a line at right angles to said 57th Avenue South438.15 feet northerly measured along said centerline from the south line of Section 23, Township 24 North, Range 4 East, W.M.) Together with that portion of the SW 1/4 of Section 23 and the NW 1/4 of Section 26, Township 23 North, Range 4 East, Willamette Meridian in King County, Washington lying within a strip of land 20 feet in width having 10 feet of said width on each side of the following described centerline: beginning at the SE corner of said SW 1/4 of Section 23; thence N 88 0 13 1 17" W along the southerly limits of said SW 1/4 a distance of 680.22 feet to the centerline of 57th Avenue South as described under King County Auditor's File No. 5735981; thence N 00 0 56'56" E along said centerline of 57th Avenue South a distance of 265.53 feet; thence S 89 6 03'04" E a distance of 2.00 feet to the True Point of Beginning; thence S 04 0 23 1 08" E a distance of 496.00 feet; thence S 00 0 54'11" W parallel to and 48.00 feet easterly of said centerline of 57th Avenue South a distance of- 500.00 feet; thence S 00 0 29 1 10" E a distance of 495.00 feet; thence S 35 0 11 1 36" W a distance of 142.00 feet to the terminus of this easement. EXCEPT that portion thereof lying within sdid'.'57th Avenue. South. 3 Together with that portion of the SW 1/4 of Section 23 and the NW 1/4 of Section 26, Township 23 North, Range 4 East, Willamette Meridian in King County, Washington lying within a strip of land 15 feet in width having 7 -1/2 feet of said width on each side of the following described centerline: beginning at the SE corner of said SW 1/4 of Section 23; thence N 88 0 13 1 17" W along southerly limits of said SW 1/4 a distance of 680.22 feet to the centerline of 57th Avenue South as described under King County Auditor's File No. 5735981; thence•N 00 0 56 1 56" E along said centerline of 57th Avenue South a distance of 438.15 feet to a point of curve on said centerline; thence S 89 0 03 1 04" E a distance of 80.00 feet to the 0 1 'Ot FAGS a w -2- True Point of Beginning; thence S 00 W a distance of 870.33 feet; thence S 07 0 13 1 50" E a distance of 198.00 feet; thence S 02 0 09 1 10" E a distance of 399.00 feet; thence S 09 0 58 1 00" W a distance of 266.00 feet to the terminus of this easement; said terminus being 100 feet easterly and 36 feet northerly (measured at right angles) from the intersec- tion of the centerlines -of said 57th Avenue South and South 164th Street. For the construction, operation, maintenance and /or repair and /or replacement of utility lines for water and sewer, together with the right of ingress and egress to and from said easement and right -of -way for all purposes necessary and related thereto. Such construction, operation, maintenance and /or repair and /or replacement of said lines shall be accomplished in such manner that the private improvements from time to time existing within the right -of -way shall not be disturbed or destroyed, or in the event that they are disturbed or destroyed, they shall ire replaced in as good condition as they were immediately before the property was entered upon by the Grantee. 'The Grantee also agrees to indemnify and save harmless the Grantor from any liability arising from activities of the Grantee contemplated herein. It is specifically understood that this easement shall not prevent the use of the property as a paved parking lot by the Grantor. DATED this day of Washington.
