AMENDED BY: REPEALED BY: 2351 §2-3, 3(a)-3(b), 5, 8-10, 13-14, 16 569 §3 (c) 2351 §15, 17-18 2466 ORDINANCE No. 232 AN ORDINANCE regulating the Keeping and I Maintaining of Livestock, Small Animals and Fowl, declaring a nuisance; setting up minimum health standards and naming Health and Enforce- ment officers. BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF TUKWILA: SECTION 1. That it shall be unlawful for any person, persons, firm or corporation to keep or maintain livestock, small animals or fowl within the town limits of the Town of Tukwila, except as hereinafter provided. SECTION 2. The word livestock, where used in this ordinance,, shall mean and include horses, cattle, sheep, goats and swine. SECTION 3. The words small aanmals and fowl, where used in this ordinance, shall mean rab- bits, chinchillas, guinea pigs „,,.hamsters, chickens, geese, ducks, turkeys; parakeets and pigeons. (a) Chinchillas, guinea -pigs, hamsters, parakeets and pigeons will be permitted in numbers as approved by the Health Officer. �h) `Rabbits, chickens, geese, ducks and turkeys will be permitted in numbers.as' defined in Section 2 of this ordinance (c) is not named in this ordinance nor in Kennel ordinance No. 1:88 will not be p exmit ed. SECTION 4. That all livestock, small animals and fowl shall.be kept within an inclosure adequately built and maintained to prevent said livestock, small animals and fowl froni breaking through out, over or under the same. All pens, coops, hutches and housing of any kind, used for the housing of livestock, small animals and fowl: must be built to include siding or shakes or.their equivalent, and must be painted'or stained to appear presentable. SECTION 5. The number of horses, cows or cattle, sheep, goats or swine allowed on any given piece or parcel of property shall be regulated by the duly appointed Health Officer e' the Town of Tukwila. SECTION 6._ That all livestock, except swine, may be kept or maintained within said town limits provided they are kept not less than 100 feet from the nearest residence. SECTION 7. That swine may be kept or maintained within said town .limits provided they are kept within an inclosure as herein described, the outside limits of which shall be not less than 200 feet from the nearest residence. SECTION 8. No livestock, small animals or fowl shall be kept on any property within the town limits of the Town of Tukwila where the said property does not a minimum of 10,000 square feet of area. (1) pap all animals and fowl shall be permitted as follows: (a) Twelve (12) chickens or twelva (12) rabbits .or any combination of chickens and rabbits., not to exceed a total of twelve (12) collectively, for 10,000 square feet of property. (b) The number of chickens or rabbits may be increased by 1 1 10 for each addi- tional 1,000 square feet of property. (c) Six (6) geese, six (6) ducks, six (6) turkeys or ar;y combination of geese, ducks or turkeys, not to exceed a total of six (6) collectively for 10,000 square feet of property. (d) The number of geese, ducks or turkeys may be increased 110 for each addi- tional 1,000 square feet of property. (e) At no time shall the total number of small animals or foul exceed a total of twelve (:12) for each 1 0,000 square feet of property. SECTION 10. Buildings for the housing of small animals and-fowl shall be built and located n ©.t less than 65 feet from any place of human habitation, other than.the.ownerts, or ..t f not loss tliari'tvueiity (20) "feet from the adjoining property; and prgviding° further that the roaming area for said small animals and fowl shall be fenced and located not less than thirty -4 (35) feet from`any adjacent place "of human habitation:' SECTION 1.1,. Not more than one building for the housing of livestock, small animals or fowl shall be allowed in any one building site. SECT.ION' 12. No livestock, small animals or fowl shall be kept in such a manner that a condi= tion' resulting from same shall constitute a nuisance. SECTION „1B. All manure must be kept in a covered water =tight pit or.ehamber and shall be re- moved xt least once a week during the period from April 1 to' October 1, and during the other months at sufficiently frequent to maintain a sanitary condition'satis- factory to the Health Officer. (a) Manure shall not be allowed to collect in any place where it can prejudicially aX ect any source of drinking water. fib) nur __iwhen.used..a .a._ferti:Lizer,_.must be plowved...or., spaded. under viithin twonty -four (24) hours, after application. SECTION 14. The Health Officer for the Town of Tukwila shall-be authorized to enforce this ordinance, unless otherwise provided. SECTION 15. The Building Superintendent shall issue all permits. for housing livestock,. small 'animals and fowl. Buildings must be completed,- including manure pit, vrith.in sixty (60) -days after' issuance of, permit-. SECTION'16. Any person, persons, firm or corporation who, at the time of the adoption of this ordinance, is or are keeping livestock, small aniinals or fowl within. the town "limits of the. Town of Tukwila, will not be affected by the Sections, 6,. 7, S, 9 and 10 of., this ordinance. �:(f2) SECTION ,16 (c6ntinue"d) (a) An,V person:, ;"persons­._ firm or corporation who discontinues the keeping or re— number of livestock, small animals or f owl for a period of more than ni nety (.90) days; or who shall sell or transfer his property, shall then become subject to all the provisions of this ordinance. SECTION 17. Any person violating any of the provisions of this ordinance shall be deemed guilty of "a misdemeanor and, upon conviction thereof, shall be punished by a fine not to exceed. $100:00. or by, imprisonment for a term not. to exceed thirty (30) days or both such fine and imprisonment, for each offense. SECTION 18. Each and every day on which a violation of this ordinance occurs and continues shall be considered a separate offense. SECTION 19. I If any section, paragraph or portion of this ordinance shall, for any reason, be held, by a Cpurt of competent jurisdiction, to be unconstitutional or invalid, such ru1ing...shall;_not affect the remaining items, parts or provisions of.this ordinance.
