B. Definitions. As used in TMC Chapter 8.28, the following definitions shall have
the meanings set forth below:
2. "Boarded" means covering of all entry points, including all doors and windows,
with plywood or other materials for the purpose of preventing entry into the
building by persons or animals.
7. "Vacant Building" means a building or structure that has not been occupied
for over 30 days.
8. "Vacant Nuisance Building" means a building, structure or portion thereof
that is vacant and exists with any one or more of the following conditions:
a. Unsecured against entry;
b. Old, dilapidated or has become so out of repair as to be dangerous, unsafe,
and unsanitary or otherwise unfit for human habitation or occupancy;
e. Not monitored and maintained in accordance with the IPMC;
f. Incomplete construction whereby the building permit has expired and the
construction project has been abandoned for more than 30 days;
g. An abandoned premises as defined in this section.
On April 27, 2022, I observed there is an unsecured opening in the north wall
which is large enough for a vagrants, criminals or immoral persons, children, and
rodents to enter the house. None of the windows or doors have been secured to
prevent unauthorized access too.
1. Immediately board all windows, doors, and the opening on the north end of
the house in accordance with the 2015 International Property Maintenance
Code (IPMC) Appendix A: Boarding Standard (as adopted by TMC 8.28.020) to
prevent unauthorized access, vagrants, criminals, immoral persons, children, or
rodents from entering the house. See Exhibit A

Exterior Structure
2015 IPMC SECTION 304 EXTERIOR STRUCTURE
IPMC 304.1 General. The exterior of a structure shall be maintained in
good repair, structurally sound and sanitary so as not to pose a threat to the
public health, safety or welfare.
• IPMC 304.2 Protective treatment. Exterior surfaces, including but not
limited to, doors, door and window frames, cornices, porches, trim, balconies,
decks and fences, shall be maintained in good condition. Exterior wood surfaces,
other than decay -resistant woods, shall be protected from the elements and decay
by painting or other protective covering or treatment. Peeling, flaking and chipped
paint shall be eliminated and surfaces repainted. Siding and masonry joints, as
well as those between the building envelope and the perimeter of windows,
doors and skylights, shall be maintained weather resistant and water tight.
Metal surfaces subject to rust or corrosion shall be coated to inhibit such rust
and corrosion, and surfaces with rust or corrosion shall be stabilized and coated to
inhibit future rust and corrosion. Oxidation stains shall be removed from
exterior surfaces. Surfaces designed for stabilization by oxidation are exempt
from this requirement.

• IPMC 304.4 Structural members. Structural members shall be maintained
free from deterioration and shall be capable of safely supporting the imposed dead
and live loads.
• IPMC 304.6 Exterior walls. Exterior walls shall be free from holes, breaks,
and loose or rotting materials; and maintained weatherproof and properly
surface coated where required to prevent deterioration.
• IPMC 304.7 Roofs and drainage. The roof and flashing shall be sound,
tight and not have defects that admit rain. Roof drainage shall be adequate to
prevent dampness or deterioration in the walls or interior portion of the
structure. Roof drains, gutters and downspouts shall be maintained in good
repair and free from obstructions. Roof water shall not be discharged in a
manner that creates a public nuisance.
IPMC 304.13 Window, skylight and door frames. Every window, skylight,
door and frame shall be kept in sound condition, good repair and weather tight.
On April 27, 2022, I observed multiple gaps in the OSB decking and the 1 x 4
decking for the roof which allows rain and snow to enter the interior of the
house. The OSB decking material has weathered and warped as well as the 1 x 4
decking over the past two years. The fascia board on both the front and back of
the house is missing and there is no siding on majority of the house. The wall on
the north end of the house has separated from the end rafter allowing rain,
snow, and rodents into the interior of the house. Majority of the house does
not have siding protecting the walls and the interior of the house.
1. Immediately board all windows, doors, and the opening on the north end of
the house in accordance with the 2015 International Property Maintenance
Code (IPMC) Appendix A: Boarding Standard (as adopted by TMC 8.28.020) to
prevent unauthorized access, vagrants, criminals, immoral persons, children, or
rodents from entering the house. See Exhibit A
2. Immediately secure the north wall to prevent it from collapsing, potentially
landing on the neighbor's property. (Neighbor's driveway is five feet from this
wall.) Inspect the remaining north wall and the entire south wall to confirm
there are no other immediate issues.
3. Immediately remove from the roof all of the tarps (whole and scraps), bundles
of shingles, and lumber which had secured the previous tarps, and secure the
roof to prevent additional rain from entering the interior of the home.
NOTE:
One tarp to cover the entire roof is required. The tarp must be secured
correctly to prevent lifting by the wind. The tarp must be maintained and when
the tarp shows signs of deterioration or tearing, the tarp must be replaced.

Interior Structure
2015 IPMC 305.1 General. The interior of a structure and equipment therein
shall be maintained in good repair, structurally sound and in a sanitary
condition....
• IPMC 305.1.1 Unsafe conditions. The following conditions shall be
determined as unsafe and shall be repaired or replaced to comply with the
International Building Code or the International Existing Building Code as required
for existing buildings:

2. The anchorage of the floor or roof to walls or columns, and of walls and
columns to foundations is not capable of resisting all nominal loads or load
effects;
IPMC 305.3 Interior surfaces. Interior surfaces, including windows and
doors, shall be maintained in good, clean and sanitary condition. Peeling, chipping,
flaking or abraded paint shall be repaired, removed or covered. Cracked or
loose plaster, decayed wood and other defective surface conditions shall be
corrected.
On April 27, 2022, I observed through the opening located on the north wall,
the area immediately inside the house is wet which includes but not limited to
ceiling, structural members, rafters, walls, and floors. There is insulation
installed between studs in some areas and it appears wet. Sunlight can be seen
in multiple areas above the exterior walls, rafter overhangs, and the roof.
Corrective Action: 1. Contact a Mold Removal and Remediation Company to inspect the entire
house to see if there is any mold present inside or outside of the house. If mold
was not found, an email from the company must be sent to Jim Toole to state
there was no mold found outside or inside the home. If mold is found, a report
from the company must be submitted to Jim Toole for review before any
remediation commences. This report must include but not limited to type of
mold, location of mold, extent of mold, and remediation of mold,
2. Contact a licensed in the State of Washington and the City of Tukwila Architect
or Structural Engineer to inspect the entire home to determine whether the
house is structural sound. If the inspection reveals no structural issues, an
email from the company must be sent to Jim Toole to state there was no
structural issues outside or inside the home. If structural issues are found, a
report from the company must be submitted to Jim Toole for review before
any corrective measures commences. This report must include but not limited
to type of structural issues, location of these issues, extent of each issue, and
corrective measures.
3. Before any permits can be renewed, extended, or applied for, Corrective
Measure #1 and #2 above must be performed and the reports must be
reviewed and approved by the City.

Violation # 4 Accumulation of Garbage and Rubbish
Code Reference: 2015 IPMC 308.1 (as adopted by TMC 8.28.020)
Accumulation of rubbish or garbage. Exterior property and premises, and the
interior of every structure, shall be free from any accumulation of rubbish or
garbage.

Conditions:
On April 27, 2022, I observed in the backyard and in front of the detached
garage broken glass, scraps of dimensional lumber, scrap metals, chunks of
foam, scraps of OSB board, rooted door, weathered dimensional lumber, and
piles of asphalt shingles and siding.
Corrective Action: Properly dispose of all rubbish and garbage, or store rubbish and garbage in
approved leakproof containers with close -fitting covers, or inside an enclosed
structure until garbage and rubbish is removed from the property. Maintain the
property to this standard at all times.

Violation # 5 Weeds and Overgrowth

2015 IPMC 302.4 (as adopted by TMC 8.28.020) WEEDS.
Premises and exterior property shall be maintained free from weeds or plant
growth in excess of 12 inches. Noxious weeds shall be prohibited. Weeds shall be
defined as all grasses, annual plants and vegetation, other than trees or shrubs
provided; however, this term shall not include cultivated flowers and gardens.
Observed On April 27, 2022, I observed grass of 12 inches in height, weeds, and overgrown
Conditions: blackberry throughout the property.
Corrective Action: Trim back all overgrowth to a height of 12 inches or less on entire property and
remove trimmings from the property. Maintain the property to this standard at all
times.

SECTION 108 UNSAFE STRUCTURES AND EQUIPMENT
[A] 108.1.5 Dangerous structure or premises. For the purpose of this code, any structure or premises
that has any or all of the conditions or defects described below shall be considered dangerous:
3. Any portion of a building, structure or appurtenance that has been damaged by fire, earthquake, wind,
flood, deterioration, neglect, abandonment, vandalism or by any other cause to such an extent that it is
likely to partially or completely collapse, or to become detached or dislodged.
5. The building or structure, or part of the building or structure, because of dilapidation, deterioration,
decay, faulty construction, the removal or movement of some portion of the ground necessary for the
support, or for any other reason, is likely to partially or completely collapse, or some portion of the
foundation or underpinning of the building or structure is likely to fail or give way.
7. The building or structure is neglected, damaged, dilapidated, unsecured or abandoned so as to
become an attractive nuisance to children who might play in the building or structure to their danger,
becomes a harbor for vagrants, criminals or immoral persons, or enables persons to resort to the
building or structure for committing a nuisance or an unlawful act.

9. A building or structure, used or intended to be used for dwelling purposes, because of inadequate
maintenance, dilapidation, decay, damage, faulty construction or arrangement, inadequate light,
ventilation, mechanical or plumbing system, or otherwise, is determined by the code official to be
unsanitary, unfit for human habitation or in such a condition that is likely to cause sickness or disease.

[AJ 108.2 Closing of vacant structures. If the structure is vacant and unfit for human habitation
and occupancy, and is not in danger of structural collapse, the code official is authorized to post a
placard of condemnation on the premises and order the structure closed up so as not to be an attractive
nuisance. Upon failure of the owner or owner's authorized agent to close up the premises within the
time specified in the order, the code official shall cause the premises to be closed and secured through
any available public agency or by contract or arrangement by private persons and the cost thereof shall
be charged against the real estate upon which the structure is located and shall be a lien upon such real
estate and shall be collected by any other legal resource.
SECTION 110 INSPECTIONS [A] 110.1 General.
Construction or work for which a permit is required shall be subject to inspection by the building official
and such construction or work shall remain visible and able to be accessed for inspection purposes until
approved. Approval as a result of an inspection shall not be construed to be an approval of a violation of
the provisions of this code or of other ordinances of the jurisdiction. Inspections presuming to give
authority to violate or cancel the provisions of this code or of other ordinances of the jurisdiction shall
not be valid. It shall be the duty of the owner or the owner's authorized agent to cause the work to
remain visible and able to be accessed for inspection purposes. Neither the building official nor the
jurisdiction shall be liable for expense entailed in the removal or replacement of any material required
to allow inspection.

Appeal Instructions
TMC 8.45.110 Appeal to Hearing Examiner
A. The person(s) responsible named on this Notice of Violation and Order issued by the
Code Enforcement Officer, pursuant to TMC Section 8.45.070, may appeal the Notice by
requesting such appeal within 10 calendar days after being served with the Notice pursuant
to TMC Section 8.45.070.
File the Appeal with the Tukwila City Clerk a written notice of appeal along with payment of
the $300 appeal fee, containing the following:
1.The Code Enforcement case file number.
2.A brief statement setting forth the names, mailing address(es), and legal interest of each of the
persons appealing this notice and order.
3.A brief statement of the specific order or action protested, together with any supporting facts.
4. A brief statement of the relief sought, and the reasons why it is claimed that the notice and order
should be reversed, modified, or otherwise set aside.
TMC 8.45.120 Penalties
A. VIOLATIONS OF THE TUKWILA MUNICIPAL CODE:
