THIS INDENTURE made this

1961, between THE CITY OF SEATTLE, a municipal corporation of the
State of Washington, hereinafter called the "City" and the TOWN OF
TUKWILA, a municipal corporation of the State of Washington, here-
inafter called the "Grantee
WITNESSETH:
That the City, for and in consideration of the sum of
ONE THOUSAND FOUR HUNDRED AND SEVEN ($1,407.00) DOLLARS, receipt
of which is hereby acknowledged, hereby conveys and grants to the
Grantee, its successors and assigns, the right, privilege and auth-
ority to construct, operate, maintain sewer and water lines across
Rn the following described lands and premises situated in the
County of King, State of Washington, to wit:
One 8 -inch pressure sewer line across and under the
East 10 feet of the S.W. 1/4 of the N. E. 1/4 of Section 26, Town-
ship 23 North, Range 4 East, W.M.
Also, one 12 -inch sewer line across and under the North
40 feet of the West 573 feet more or less of the S. E. 1/4 of the
N.E. 1/4 of Section 26, Township 23 North, Range 4 East, W.M.
Also,one 8 -inch water line across and under the North 80
feet of the West 40 feet of the S.E. 1/4 of the N.E. 1/4 of Section
26, Township 23 North, Range 4 East, W.M.
Together with a temporary construction easement across and
over the East 30 feet of the S.W. 1/4 of the N.E. 1/4 of Section 26,
Township 23 North, Range 4 East, W.M., said temporary construction
easement shall remain in force during construction and until such time a
the sewers and water lines have been accepted by the Town of Tukwila.

The construction, operation and maintenance of said sewer

and water lines shall be at the sole cost and':.expense, the Grantee
and the use and occupancy of said property by the Grantee shall in no
way interfere with the present or future use of the said property by
the City for any purpose. Should any of the City's facilities be
damaged or disturbed by reason of the present or future construction,
operation, or maintenance of the said sewer and water lines, the City
may repair such facilities and the Grantee shall pay the cost of such
repair,
The use and occupancy of said property by the Grantee
shall not at any interfere with the City's access to and over
said property, and any roadway on said property disturbed by the
Grantee must be restored by said Grantee to its original condition.
In the event such sewer and water line systems are aban-
doned or removed by the Grantee or its assigns, this easement shall

the encumbrance of said easement.
The Grantee agrees that the City shall not be liable for
damages to any sewer or water lines by reason of any construction,
alteration, or maintenance of improvements performed on a.aid property
by the City, its agent or representative.
The Grantee agrees to indemnify and save harmless the City
from any and all claims, actions or damages of any kind or descrip-
tion which may accrue to or be suffered by any person or persons or
property by reason of the construction, operation, or maintenance of
said sewer or water line systems or the use afid occupancy of said
property by the Grantee, its agents, successors or assigns. In case
of any suit or action brought against the City by reason thereof, the
Grantee, its successors or assigns will, upon notice to it or them of
the commencement thereof, defend such action or suit at its or their
sole cost and expense and will fully satisfy the final judgment

rendered in any such action.
IN WITNESS WHEREOF, the City has caused this Agreement to
be executed by its Mayor and City Comptroller, pursuant to Ordinance
965:40.; and the Grantee has executed the same this c 2S day of

ly appeared GORDON S. CLINTON and C. G. ERLANDSON, to me known to be
the Mayor and City Comptroller, respectively, of the municipal corpora-
tion that executed the within and foregoing instrument and acknowledged
said instrument to be the free and voluntary act and deed of said
municipal corporation for the uses and purposes therein mentioned, and
on oath stated that they were authorized to execute said instrument,
and that the seal affixed is the corporate seal of said municipal
corporation.
