In no event shall any portion of the easement be within seven feet of the southwest corner of the residence presently located on the surrounding property. 2. City will construct and maintain on the Easement Property a storm drainage system sufficient to provide drainage control at the low point of the property surrounding the Easement Property to drain a sump area in an orchard located thereon. City will limit construction activities in connection with construction of the storm drainage system to an area agreed to by Garrisons. Garrisons will by staking sufficiently delineate the construction area to enable the City's contractor to easily see the limits of the construction area. In no event will construction activities be permitted upon the septic drain field located to the east of the single family residence located upon the property commonly known as 14950 57th Avenue South, Tukwila, Washington. 3. GARRISON and GARRISON (hereinaf e "Garrisons and the CITY OF TUKWILA, a municipal corporation tt� (hereinafter "City in consideration of Garrisons granting to CD City a temporary construction easement and a permanent use and C maintenance easement for the purposes of locating a storm drain- age system upon certain real property owned by Garrisons, and in consideration of City locating on certain property owned by M co Garrisons a storm drainage system providing drainage control at CD the low point of said property to drain a sump area in an orchard located thereon, and in consideration of the terms and covenants set forth below, agree as follows: 1. Garrisons will grant to City an easement covering sufficient property (hereinafter "the Easement Property owned by Garrisons to enable the City to construct thereon, and to maintain, a storm drainage system. In no event shall any portion of the easement be within seven feet of the southwest corner of the residence presently located on the surrounding property. 2. City will construct and maintain on the Easement Property a storm drainage system sufficient to provide drainage control at the low point of the property surrounding the Easement Property to drain a sump area in an orchard located thereon. City will limit construction activities in connection with construction of the storm drainage system to an area agreed to by Garrisons. Garrisons will by staking sufficiently delineate the construction area to enable the City's contractor to easily see the limits of the construction area. In no event will construction activities be permitted upon the septic drain field located to the east of the single family residence located upon the property commonly known as 14950 57th Avenue South, Tukwila, Washington. 3. City will at its own expense promptly repair any damage caused by the construction of the storm drainage system con- templated herein to structures located upon the construction site or on the septic tank drain field referred to in paragraph 2 above, and will restore those structures to their original condition before such damage. 4. City will at City's expense temporarily fence in an en- closure of approximately 30 feet x 40 feet to accommodate the geese now on or near the Easement Property, and will locate and maintain that enclosure during the construction period in such a manner that the geese are not unreasonably disturbed. City will at City's expense at the end of the construction contemplated herein remove this temporary enclosure. �7 5. City will at City's expense restore the Easement Property and the surrounding property which was affected by any of the C1� construction activities contemplated herein to a condition reasonably approximating its condition prior to such construction. Such restoration shall include, but not be limited to, removal of all brush and debris left by the construction, and the replanting of wild -grass seedlings throughout the disturbed area. 6. To the extent that the Vine Maple trees are removed in the course of the construction activities contemplated herein, such trees shall be moved and stored at City's expense according to Garrisons reasonable requirements. 7. City will at City's expense after completion of the construction contemplated herein completely overlay the asphalt driveway presently located upon the property commonly known as 0 14950 57th Avenue South, Tukwila, Washington. �r° B.
