BENAROYA COMPANY, a Washington corporation (the "Grantor in favor of the CITY OF TUKWILA, a municipal corporation of King County, State of Washington (the "Grantee WITNESSETH: For and in consideration of the sum of One Dollar ($1.00) and other valuable consideration, receipt of which is acknowledged, Grantor grants, sells, conveys and confirms to Grantee, its successors and assigns, a perpetual easement and right -of -way for underground water line or lines with necessary appurtenances under, across and upon the property described as follows: That portion of the southeast quarter of the southwest quarter of Section 26, Township 23 North, Range 4 East, W.M., in the City of Tukwila, King County, Washington, described as follows: Beginning at the southeast corner of said southeast quarter of the southwest quarter of Section 26; Thence North 87 45'47" West along the south line of said southeast quarter of the southwest quarter a distance of 481.05 feet to the west margin of Southcenter Parkway; thence North 11 1 59'33" West along said west margin a distance of 574.58 feet; thence South 78 0 00'27" West along said west margin a distance of 235 feet to the true point of beginning; thence South 11 0 59'33" East a distance of 127.00 feet; thence South 78 °00'27" West a distance of 20.00 feet; thence North 11 °59'33" West a distance of 180.50 feet; thence South 78 0 00'27" West a distance of 14.00 feet; thence. South 47 °06'15" West a distance of 132.50 feet; thence North 42 °53'45" West a distance of 15.00 feet; thence North 47 0 06'15" East a distance of 157.79 feet; thence North 78 0 00'27" East a distance of 10.00 feet; thence South 11 °5933" East a distance of 79.36 feet; thence North 78 0 00'27" East a distance of 10.00 feet to the true point of beginning. Grantee shall have the right without prior institution of suit or proceeding at law, at such times as may be necessary, to enter upon said property for the purpose of operating, maintaining, repairing, replacing or reconstructing water line or lines, or making any connections therewith, without incurring legal obligation or liability therefor; provided, said operating, maintaining, repairing, replacing or reconstructing of water line or lines shall be accomplished in such a manner that private improvements shall not be disturbed or destroyed. In'the event they are disturbed or destroyed, they will be replaced in as good a condition as they were immediately before the property was entered upon by Grantee. Grantor shall retaI the right to use the surface of said easement and right -of -way so long as the use does not unduly interfere with the maintenance and repair of the water line or lines and so long as no permanent buildings or structures are erected on said easement and right -of -way. Benaroya Company, the corporation that executed the within and foregoing instrument, and acknowledged to me that he was authorized to sign the same on behalf of the corporation as its free and voluntary act and deed for the uses and purposes mentioned therein.
