HomeMy WebLinkAboutOrd 0230 - Traffic Violations and Penalties (Repealed by Ord 495)ORDINANCE NO 230 REPEALED BY ORD 495 AN ORDINANCE ADDING SECTIONS 5 AND 6 TO ORDINANCE NO. 211, ORDINANCES OF THE TOWN OF TUKWILA, MAKING IT A VIOLATION OF THE TRAFFIC FAILURE TO POST BAIL AND PERMITTING THE POLICE JUDGE TO SET PENALTIES BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF TUKWILA; that Ordinance No. 211 be revised by adding Sections 5 and 6 to read as follows: Section 5. Traffic Slips or Notices. (a) Whenever any person is arrested for any violations of this Ordinance, except as otherwise provided in subdivision (b) of this section, the arresting officer shall take his name, address., operator's license number, and the registration number of the motor vehicle involved and issue to him on a form provided by the Marshal or Chief of Police, a notice in writ- ing to answer to the charge against him at a time agreed upon and at a A place specified in the notice. The officer shall thereupon release such person from custody upon his written promise to answer and appear as specified in said notice. The arresting officer shall send one copy of such notice to the Marshal or Chief of Police. (b) The provisions of subdivision. (a) Of this section not apply to any person arrested and charged with an offense causing or contributing to an accident resulting in injury or death to any person or to any person charged with Reckless Driving, ro to any person char with driving while under the influence of intoxicating liquor or nar- cotic drugs or to any person whom the arresting officer shall have good cause to believe has committed any felony, and the arresting officer shall take such person to the police station to be booked. (c) Any person who wilfully violates his written promise to appear, given accordance with subdivision (a) of this section, shall be guilty of a violation of this Ordinance regardless of the dis- position of the charge on which he was originally arrested, and his bail may be doubled. Section 6. This ordinance shall take effect immediately upon its final passage and posting, as required by law.
