C0MPANY, a Washington Corporation, hereinafter called "Grantor in favor of
CITY OF TUKWILA, a municipal corporation of King County, State of Washington,
hereinafter called "Grantee
WITNESSETH:
For and in consideration of the sum of One Dollar ($1.00) and other
Viiiu isle consideration, receipt of w h i ch is hereby acknowledged, Grantor does

hereby grant, sell, convey, and confirm unto Grantee, its successors and assigns,
a perpetual easement and right -of -way for underground water line or lines with
necessary appurtenances under, across and upon that certain property more fully
described on Exhibit A attached hereto.
Grantee shall have the right without prior institution of suit or pro-
ceeding at law, at such times as may be necessary, to enter upon said property

T-1 for the purpose of operating, maintaining, repairing, replacing or reconstruct-

rs ing said water line or lines, or making any connections therewith, Without in-

CD curring any legal obligations or liability therefore; provided that such

operating, maintaining, repairing, replacing or reconstructing of said eater
line or lines shall be accomplished in such a manner that private improvements

v shall not be disturbed or destroyed, or in the event they are disturbed or de-
stroyed, they will be replaced in as good a condition as they were immediately
Before the property was entered Upon by Grantee.
Grantor shall retain the right to use the surface of said easement and
right -of -way so long as said use does not unduly interfere with the maintenance
and repair of the water line or lines and so long as no permanent buildings or
structures are erected on said easement and right -of -way.

This shall be a covenant running with the land forever and shall be binding
on Grantor's successors, heirs and assigns.

Public in and for the State of Washington, duly commissioned and sworn, personally
appeared Jack A. Benaroya and Robert D. Sandwick to me known to be the President
and Secretary of the JACK A. BENAROYA COMPANY, the Corporation that executed the
foregoing instrument, and acknowledged the said instrument to be the free and vol-
untary act and deed of said corporation, and for the uses and purposes therein men
tioned, and on oath stated that they were authorized to execute the said instrument
and that the seal affixed is the corporate seal of said corporation.

in the City of Tukwila, King County, Washington lying within
a strip of land 10 feet in width having 5 feet of said width
on each side of the following described centerline:
beginning at the southeast corner of said southeast quarter
