BENAROV w C0MPANY, a Washington Corporation, hereinafter called "Grantor in favor of CITY OF TUKWILA, a municipal corporation of King County, State of Washington, hereinafter called "Grantee WITNESSETH: For and in consideration of the sum of One Dollar ($1.00) and other Viiiu isle consideration, receipt of w h i ch is hereby acknowledged, Grantor does O hereby grant, sell, convey, and confirm unto Grantee, its successors and assigns, a perpetual easement and right -of -way for underground water line or lines with necessary appurtenances under, across and upon that certain property more fully described on Exhibit A attached hereto. Grantee shall have the right without prior institution of suit or pro- ceeding at law, at such times as may be necessary, to enter upon said property co T-1 for the purpose of operating, maintaining, repairing, replacing or reconstruct- or CD rs ing said water line or lines, or making any connections therewith, Without in- l r� CD curring any legal obligations or liability therefore; provided that such t operating, maintaining, repairing, replacing or reconstructing of said eater line or lines shall be accomplished in such a manner that private improvements 0 v shall not be disturbed or destroyed, or in the event they are disturbed or de- stroyed, they will be replaced in as good a condition as they were immediately Before the property was entered Upon by Grantee.
