Grantee shall have the right without prior institution of suit or 0% proceeding at law, at such times as may be necessary, to enter upon said o property for the purpose of operating, maintaining, repairing, replacing or reconstructing said storm line or lines, or making any connections there 0 with, without incurring any legal obligations or liability therefore; provided UN that such operating, maintaining, repairing, replacing or reconstructing of said o storm line or lines shall be accomplished in such a manner that private im- 0 provements in this right -of -way shall not be disturbed or destroyed, or in the event they are disturbed or destroyed, they will be replaced in as good a con dition as they were immediately before the property was entered upon by Grantee. Grantor shall retain the right to use the surface of said right -of -way so long as said use does not unduly interfere with the maintenance and repair of the storm line or lines and so long as no permanent buildings or structures are 1 EXCISE TAX NOT REQUIRE erected on said right -of -way.
