KNOW ALL MEN BY THESE PRESENTS, that CHARLES

in consideration of the sum of A in hand
paid by the Town of Tukwila, a municipal corporation organized
under the laws of the State of Washington, do hereby grant
and convey unto said Town of Tukwila, its successors and
assigns, a right of way over the property hereinafter des-
cribed for any water pipes or mains which may be laid by said
Town of Tukwila, and the right to maintain such water pipes
or mains, including the use of so much land as is necessary
in laying down and maintaining such pipes or mains, and the
right to enter into and upon the lands hereinafter described
for the purpose of laying and maintaining said pipes or mains,
and also at all times in the future for the purpose of repair-
ing, inspecting and maintaining said pipes or mains, provided,
that in no case shall such pipes or mains interfere with the
proper cultivation of the lands of the parties hereto. The
easements herein referred to are particularly described as
follows:
An easement 15 feet wide from the City of Seattle's
main water supply lines on Beacon Hill to the Town of
Tukwila. The easement to lie one -half on either side
of the said pipe line; the center line of which, or base
line, is described as follows: Commencing at a point
on the section line, dividing sections 13 and 14; T.
23 N. R. 4 E., which said point is 930.47 feet S. 11 0"
degrees, 13" 09" W. from the corner common to sections
11, 12, 13 and 14; T. 23 N. 4 E., and is the zero or
initial point of the line; the line bears thence S. 44
degrees 18' 43" W. for a distance of 3643.59 feet, more
or less, to a point on the northerly line of "Hillman's
Seattle Garden Tracts!', filed for record November 30th,
1903; the said point lies on the northerly line of
Edward Street and is 10 feet East of the East line of
lot 13, block 9, of the said plat, extended North. The
distances to the limits of the easement along the base
line are measured from the zero or initial point; and
also
An easement 15 feet wide over and across the str,i -p

of land lying between the Duwamish River and the right
of -way of the Northern Pacific Railroad, the center line
of which easement cuts the westerly line of the
said Northern Pacific right -of -way 375 feet, more
or less, northerly from the South line of Donation
Claim No. 41; the said 375 feet being measured along
the said westerly line of the Northern Pacific right
of -way; and also
An easement 15 feet wide over and across land be-
'`"�tween the Beacon Coal Mine road and the property of
the Beacon Coal Mines, Inc.; the most westerly point
k of the said easement is opposite a point on the base
line hereinbefore described, distant 1839 feet, more
t or less, from the initial .point measured along the
'j, n base line and the most easterly point is opposite a
point on the base line 1480 feet, more or less, from
the initial point; and also
An easement 15 feet wide over and across land
between property of Beacon Coal Mines, Inc., and State
Road No. 2; the most westerly point of the said ease-
ment is opposite a point on the base line hereinbefore
described, distant 1383 feet, more or less, from the
initial point measured along the base line, and the
most easterly point is opposite a point on the base
line 1149 feet, more or less, from the initial point;
and also

-4 4 Claim No. 41; the most westerly point of the said ease
ment is opposite a point on the base line hereinbefore
described; distant 971 feet, more or less, from the
initial point, measured along the base line, and the
most easterly point is opposite a point on the base
line 910 feet, more or less, from the initial point.
The several easements are all included in Donation
Claim No. 41, Section 14, T. 23 N. R. 4 E., King County,
State of Washington.
Said Town of Tukwila does further agree that if
at any time after said water mains are laid across said above
described lands it shall be determined that the same interfere
with the construction of buildings on said lands, said Town
will, at its own expense, cause said mains to be moved so as
not to interfere with such construction.
