HomeMy WebLinkAbout22-091 - Peter Mayer - Interim Parks and Recreation Director22-091 Council Approval N/A CITY OF TUKWILA Employment Agreement (Interim Parks and Recreation Director) THIS EMPLOYMENT AGREEMENT ("Agreement") is made and entered into effective August 1, 2022 between the City of Tukwila (hereinafter referred to as "City") and Peter Mayer (hereinafter referred to as "Employee"), an individual. The City and the Employee are referred to collectively herein as "the Parties." WHEREAS, the City is in need of an interim Parks and Recreation Director as it determines next steps regarding permanently filling the position; and WHEREAS, the Employee has the qualifications and experience to serve as the Interim Parks and Recreation Director on the terms and conditions stated herein, including Exhibit A; NOW, THEREFORE, in consideration of the mutual covenants and conditions set forth herein, the Parties agree as follows: Section 1. Term. Parties understand that this Agreement shall become effective August 1, 2022 and remain in full force and effect for a period of six months, unless extended by mutual agreement of the Parties. Section 2. Duties. Employee shall perform the duties set forth in Exhibit A, Scope of Duties, attached Administrator for the performance of specific duties under this Agreement. Section 3. Compensation. In Consideration of the duties performed by the Employee, the City agrees to pay the Employee a rate of $13,168 per month. Section 4. Working Hours and Schedule. The working hours of the Employee shall be the equivalent of forty (40) hours per week on an annualized basis, exclusive of the meal period. The interim Parks and Recreation Director position is exempt from overtime under the Fair Labor Standards Act. The Employee and City may negotiate a mutually agreed upon work schedule. Section 5. benefits: Benefits. The City shall provide the Employee with the following fringe 5.1 Vacation — Two weeks shall be added to the Employee's vacation bank upon initiating employment. Ongoing vacation leave will accrue at the normal non - represented rate of vacation accruals. The Employee will be able to cash out unused vacation leave balances on termination of the contract. 5.2 Sick Leave — Four hours per pay period with carry over provisionsh)rthe duration of this Agreement. No pay -out of accrued sick leave balance upon termination of this Agreement. 5.3 Retirement — Position is not eligible for retirement benefits through the State of Washington Public Employees Retirement System for the duration of this agreement. 5.4 Medical Insurance — The Employee shall receive medical insurance for himself only through Kaiser Permanente or the City's SeIf-Insured plan at the choice of the Empoyee. Coverage for any eligible dependents must be paid for out of pocket and is not included. 5.5 Dental |nourance—The Employee shall receive dental insurance for himself only through the City's SeIf-tnsured plan. Coverage for any eligible dependents must be paid for out of pocket and is not included. 5.6 Vision Insurance — The Employee shall receive vision insurance for himself only through the City's SeIf-Insured plan. Coverage for any eligible dependents must be paid for out of pocket and is not included. 5.7 Holidays — 11 holidays recognized by the City throughout the duration of this Agreement. 5.8 Direct Deposit — Yes. Section 6. Taxes. All federal income tax, FICA tax, industrial iDsu[anme, retirement and other payments as they pertain to the Employee's contributions under this Agreement shall be deducted by the City and appropriately distributed. The City will make all required employer payments for FICA, netirennant, industrial insurance and similar accounts. Section 7. Termination. This is an employment at -will agreement and can be cancelled for any reason by either party upon 30 days written notice to the other party. Termination will cease the obligations of both Parties under this Agreement and no salary or benefits will be due the Employee past the effective termination date. Section 8. General. 8.1 This Agreement sets forth the entire agreement and understanding of the Parties, and supersedes all prior agreements, arrangements, and understandings. 8.2 No representation, promise, or inducement has been made by either party that is not embodied in this Agreement, and neither party shall be bound by or liable for any alleged [ep[eseOtmtioO, pnmmiee, or inducement not so set forth. The section headings contained herein are for reference purposes only and shall not in any way affect the meaning or interpretation of this Agreement. 8.3 This Agreement may be amended, nnVdified, oupereaded, omnoeUed, renewed or extended, and the terms or covenants may be waived, only by a written instrument executed by both of the Parties, or in the case of a waiver, by the party waiving compliance. The failure of either party at any time or times to require performance of any provisions hereof shall in no manner affect the right at a later time to enforce the same. No waiver by either party of the breach of any term or covenant contained in this Agreement, whether by conduct or otherwise, in any one or more instances, shall be deemed to be, or construed as, a further or continuing waiver of any such breach, or a waiver of the breach of any other term or covenant contained in this Agreement. 8.4 This Agreement shall be governed by and construed according to the laws of the State of Washington. Scope of Duties: 1 Establishes goals and objectives for the department to ensure compliance with the policy directives of the Mayor and City Council and all applicable local, state or federal laws, rules, and regulations. 2. Develops, interprets and implements plans, policies and procedures to accomplish departmental goals and objectives. 3. Supervises the activities of department personnel to include scheduling, assignment and review of work; providing assistance; administering discipline; evaluating performance and making hiring, termination, and pay change recommendations. 4. Provides professional, technical and advisory assistance to other departments on issues related to the department assigned. 5. Prepares and submits reports regarding department activities. 6. Maintains reasonable, predictable, and regular attendance during the standard work week. 7. Develops, recommends, and monitors the department budget including the incorporation of individual division budgets by reviewing past expenditure, analyzing future needs and making determinations regarding the necessary resources to accomplish departmental goals. Approves expenditures to ensure compliance with budgetary guidelines. 8. Represents the department at City Council, commission, and other meetings to present the departments plans and accomplishments and to discuss the development and implementation of programs, policies, etc. 9. Serves as a liaison to civic and special interest groups, local service organizations and other municipal agencies to coordinate activities and to arrange the use of City services and/or resources. Responds to citizen concerns and issues and determines appropriate resolutions to maintain positive community/customer relations for the department and City. 10. Develops and implements plans, policies and procedures to ensure smooth and continued business operations of their department in the event of an emergency.
