Dear Mr. Ezzeddine,
The City would like to outline the steps needed to bring your property into compliance with City codes
and regulations. With the dismissal of your appeal of the Hearing Examiner decision in case CE18-0149
you must now comply with the Hearing Examiner's Order listed below.
Hearing Examiner Decision and Order, March 5, 2021
Because substantial evidence supports the conclusion that the Appellant violated TMC
18.50.220 and .230, by performing or directing extensive construction work be performed on
Building 2, at 4004 S. 150th Street, without benefit of permits or inspections, and continues to
rent the property to others without it being appropriately registered, the appeal is DENIED.
The Appellant is directed to:
1. Immediately remove listings advertising Building 2 on any and all residential rental
websites including but not limited to Airbnb. Fines of $250/day will begin accruing for any
continued rental of Building 2 prior to necessary permits, inspections, and registrations
being obtained.
2. Immediately discontinue all use and occupancy of Building 2 until all applicable permits
have been submitted, approved, issued, inspected. As noted above, fines of $250/day will
begin accruing for any continued use of Building 2 prior to necessary permits, inspections,
and registrations being obtained.
3. Prior to further rental of Building 2, after all necessary permits and inspections have been
obtained, Mr. Ezzeddine shall obtain necessary permits and submit required registration
information to the City, including submitting a complete and signed registration form,
signing and recording an affidavit of owner occupancy, and obtaining a Residential Rental
Business Inspection and License. An additional fine of $250/day (separate from the
$250/day fine detailed above related to use of Building 2) will begin accruing immediately if
the property is rented without necessary registrations and inspections, as required by TMC
18.50.230.

The fines in the Hearing Examiner Order above will begin accruing on December 1, 2021'
Steps to Compliance
Building 2 with two Rental Units
Apply for an after -the -fact development permit from the City for the additions / alterations of Building
2 to create two separate rental units by January 31, 2021. Any corrections required to bring the
building into compliance with the 2018 International Building Code (IBC), International Residential
Code (IRC), International Property Maintenance Code, (|PW4C),Tukxvi|a Municipal Code (TK4C) Title 1G
Building and Construction, and all other applicable codes, will need to be submitted, approved, and
finaled prior to occupancy. Immediately discontinue the use of the attic as habitable space, remove
all furnishings, and secure the attic access Iadder to unpermitted access.

Yurt
While the above enforcement action was underway for Building 2 you constructed a yurt on the
property without development permits or approved utility connections. This does not qualifyfor the
tent/yurt exemption to WAC 51-50-3103 because it is heated by a wood stove. Therefore, it is not
acceptable as a permanent structure and must be removed in its entirety by January 31, 2022 along
with all electrical, water, and sanitary sewer back to where they were connected.
It appears that the yurt, patio, hot tub, and fountain have been constructed in the area mapped as
wetland under permit L18-0007. If you wish to retain the patio, hot tub, or fountain you will need to
submit a revision to the wetland special permission application to identify the extent of encroachment
and develop a revised mitigation plan by January 31, 2022.

Short Plat
The short plat that was given preliminary approval on the property, L17-0087, is valid until March 9,
2022. If you wish to continue to pursue the short plat you will need to meet the conditions of approval
and make any modifications to the drawings necessary to reflect current site conditions.
