MINUTES This meeting was conducted both on-site at Tukwila City Hall and virtually via Microsoft Teams. The phone number for public participation that was provided via the agenda distribution process was: 1-253-292-9750, access code 670077847# as well as a link to join the Microsoft Teams Meeting. COMMITTEE OF THE WHOLE CALL TO ORDER/PLEDGE OF ALLEGIANCE Council President McLeod called the Tukwila City Council meeting to order at 7:00 p.m. and led the audience in the Pledge of Allegiance. OFFICIALS Present at the meeting were Council President McLeod (on-site); Councilmembers Kathy Hougardy (on- site), De'Sean Quinn (on-site), Kate Kruller (on-site), Mohamed Abdi (on-site), Tosh Sharp (on-site). Councilmember Delostrinos Johnson was not in attendance. LAND ACKNOWLEDGEMENT Mayor Ekberg stated "The City of Tukwila is located on the ancestral lands of the Coast Salish people. We acknowledge their continuing connections to land, waters and culture. We pay our respects to their elders past, present and emerging." PUBLIC COMMENTS 1. Greg Sherlock discussed his several -year history with addressing the noise emitted from the Intergate West Sabey Data Center's rooftop cooling units from the time of its construction in 1999. He expressed his frustration that his current problem with Intergate East has yet to be resolved and emphasized the solution is to enforce the plainly audible section of the Tukwila noise code. 2. Joe Duffie praised the City, Fire, and Police Departments for hosting an outstanding Night Out Against Crime event. He mentioned that the residents in attendance were very impressed and would like to see more of these events. He thanked the Fire Department forgiving him the opportunity to experience a day in the life of a firefighter, and commended Public Works for the sidewalk improvements on Macadam Road. Council President McLeod asked for consensus to amend the agenda to introduce the Interim Parks and Recreation Director. Consensus existed to amend the agenda as requested above. Tukwila City Council Committee of the Whole Minutes August 8, 2022 Page 2 of 5 INTRODUCTION (per agenda amendment) David Cline, City Administrator, introduced Peter Mayer, Interim Parks and Recreation Director, who comes recommended through Tracy Gallaway, former Parks and Recreation Director. Mr. Mayer will be under contract with the City for4 - 6 months. Mr. Mayer thanked the Council, City and community and stated it is an honor to step in and be able to bring some of his experience in local government, public service and parks and recreation. The Councilmembers welcomed Mr. Mayer. PUBLIC HEARING 2022 Code Amendment Ordinances: Title 8: An ordinance amending Tukwila Municipal Code (TMC) Title 8, "Public Peace, Morals and Safety," and Ordinance No. 2293 §13, as codified at TMC Section 8.22.120.b, to amend language on public notice requirements for residential parties; repealing Ordinance No. 2370 §13, as codified at TMC Section 8.22.120.B. Title 17: An ordinance amending Tukwila Municipal Code (TMC) Title 17, "Subdivisions and Plats," including Ordinance Nos. 2649 §2 and 1833 §1 (part), as codified at TMC Section 17.08.030, "Preliminary Approval," to add clarifying language regarding zoning requirements for boundary line adjustments. Title 18: An ordinance amending various ordinances as codified in Tukwila Municipal Code (TMC) Title 18, "Zoning," as delineated herein, to incorporate a variety of housekeeping code amendments including Definitions (TMC 18.06), and regulations related to: Nonresidential Development (TMC 18.41), Shoreline Conditional Use Permits (TMC 18.44), Single -Family Dwelling Design Standards and Exceptions (TMC 18.50), Landscaping Requirements (TMC 18.52), Tree Exception Permits and Procedures (TMC 18.54), Nonconforming Structures (TMC 18.70), and Classification of Project Permit Applications (TMC 18.104); as well as revisions to the Basic Development Standards in various sections of the TMC as detailed herein; and an update to Table 18-6, "Land Uses Allowed by District." Title 19: An ordinance amending Tukwila Municipal Code (TMC) Title 19, "Sign and Visual Communication Code," including Ordinance Nos. 2375 §6 and 2303 §5 (part), as codified at TMC Section 19.20.030.b.7; Ordinance Nos. 2375 §7 and 2303 §5 (part), as codified at TMC Section 19.20.040; and Ordinance No. 2375 §10, as codified at TMC Section 19.32.075, to amend language regarding changes to sign copy and to clarify language on freestanding and monument sign regulations. 7:20 p.m. Council President McLeod opened the public hearing and called for a staff report. Nora Gierloff, Community Development Director, and Max Baker, Development Supervisor, provided an overview of four ordinances updating Tukwila Municipal Code Titles 8, 17, 18 and 19. The proposed amendments are for housekeeping purposes and range from code clarification to updating development regulations and permit processes. The Planning Commission held a public hearing on the proposed changes on April 28, 2022 and May 26, 2022 and their recommendations are reflected in the draft ordinances. 7:51 p.m. 7:59 p.m. Councilmember Abdi left the Council Chambers. Councilmember Abdi returned to the Council Chambers. 8:08 p.m. Council President McLeod called for public comments. Council President McLeod asked if there was anyone who wished to make a public comment on this topic to speak now or press *6 on the phone to unmute. The Councilmembers asked clarifying questions regarding the proposed changes. 8:14 p.m. Council President McLeod closed the public hearing. SPECIAL ISSUES a. 2022 Code Amendment Ordinances. The Councilmembers discussed the amendments and offered comments regarding the frequency of housekeeping amendments, the need for clarity around hospitals in a future revision, and the need for clarity around the use of acronyms in the proposed ordinances. 8:19 p.m. 8:23 p.m. Councilmember Hougardy exited the Council Chambers. Councilmember Hougardy returned to the Council Chambers. CONSENSUS EXISTED TO FORWARD THIS ITEM TO THE NEXT REGULAR MEETING. b. Economic Development Plan — Community Engagement. Derek Speck, Economic Development Administrator, stated following Council authorization to execute a contract with Community Attributes, Inc. to create an Economic Development Plan, staff are returning with a proposal fora community engagement process that will include "influencers" and partnering with community-based organizations to engage with stakeholders through various venues and tools. The Councilmembers asked clarifying questions and offered comments regarding additional engagement opportunities. 9:12 p.m. Councilmember Sharp left the Council Chambers. CONSENSUS EXISTED TO PROCEED WITH THE COMMUNITY ENGAGEMENT PROCESS AS OUTLINED ABOVE. c. A contract for Program Management Quality Assurance (PMQA) services. Laurel Humphrey, Legislative Analyst, indicated the Council expressed intent to hire a new Program Management Quality Assurance (PMQA) consultant to provide advice on activities associated with the Public Works Shops Phase 2 Project. The proposed contract with John Palewicz goes through Decemb er 31, 2026 and is for an amount not to exceed $45,000.00. 9:15 p.m. Councilmember Sharp returned to the Council Chambers. The Councilmembers welcomed Mr. Palewicz and indicated they look forward to leaning on his expertise. CONSENSUS EXISTED TO FORWARD THIS ITEM TO THE NEXT REGULAR MEETING. REPORTS a. Mayor Mayor Ekberg shared that he was recently awarded the Advanced Certificate of Municipal Leadership (CML) through Association of Washington Cities. The Advanced Certificate recognizes those who demonstrate community service, earn an additional 30 CML credits, and participate in training in diversity, equity, and inclusion. He also participated in the Mayors Innovation Project hosted in Tacoma by Mayor Victoria Woodards. Tukwila City Council Committee of the Whole Minutes August 8, 2022 Page 4 of 5 b. City Council Councilmember Hougardy indicated the Community Services and Safety Committee discussed the 2nd Quarter Fire Department report. She participated in National Night Out against Crime and rode along with Police Commander Andi Delic. She attended an Airport Luncheon through Seattle Southside, an Equity and Social Justice Commission meeting and a ribbon -cutting ceremony forAssurion Tech Repair & Solutions. Councilmember Quinn reported the Finance and Govemance Committee discussed the City Hall Siding Repairs project that will be forwarded to the next Regular Meeting. They also discussed City Council Compensation, the City Naming Policy, and heard a proposal from Westfield Southcenter's General Manager and Assistant General Manager. Councilmember Kruller participated in National Night Out against Crime and rode along with Police Deputy Chief Eric Lund. She relayed a resident request for small pocket parks for the Cascade View/Riverton Heights neighborhoods. She shared applications for leadership and membership positions through National League of Cities will be open through September 27, 2022. She will be attending an Ecosystem Coordination Board meeting through Puget Sound Partnership, and relayed the Boeing Classic will be taking place August 12 - August 14. Councilmember Abdi attended the annual Seattle Somali soccertoumament that took place at Foster High School and helped staff hand out awards to participants. Council President McLeod participated in National Night Out against Crime and was able to attend 8 gatherings with Commander Dale Rock. c. Staff There was no report. EXECUTIVE SESSION — Potential Litigation — Pursuant to RCW 42.30.110(1)(1) (30 minutes) Council President McLeod announced the Council will now go into an Executive Session to discuss: Potential Litigation — Pursuant to RCW 42.30.110(1)(i) (30 minutes) The total amount of time will be no more than 30 minutes, and no decisions will be made during the Executive Session. No action will be required in the Open Meeting after the Executive Session has concluded. He declared the meeting adjourned as of the conclusion of the Executive Session. The Executive Session will not be extended beyond the announced time, and they will not be returning to open session to adjoum or for any other reason. 9:47 p.m. Council President McLeod declared a brief recess.
