AN ORDINANCE OF THE CITY OF TUKWILA, WASHINGTON, RELATING TO MALICIOUS MISCHIEF; AMENDING ORDINANCE #989, SECTION 1 TO ADD RCW 9A.48.090 AND DELETING RCW 9A.48.080. WHEREAS, ordinance #989 adopted certain provisions of the revised Washington State Criminal Code, and WHEREAS, it appears necessary in order to preserve the peace, safety and welfare of the citizens of the City of Tukwila to occasionally amend the list of criminal acts. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. Ordinance #989, Section 1, (TMC 8.04.005 Criminal Acts), is hereby amended to add the following statute of the State of Washington which is hereby adopted by reference: RCW 9A.48.090 Malicious mischief in the third degree. (1) and (2). The penalty for violating any of the provisions of this section shall be as now provided for in the Tukwila Municipal Code. (8.04.005 (C). Section 2. The following statute of the State of Washington previously adopted by reference in Ordinance #989, Section 1, (TMC 8.04.005 Criminal Acts), is hereby deleted: RCW 9A.48.080 Malicious mischief in the second degree. (1) A person is guilty of malicious mischief in the third degree if he knowingly and maliciously causes physical damage to the prop- erty of another, under circumstances not amounting to malicious mischief in the first or second degree. (2) Malicious mischief in the third degree is a gross misde- meanor if the damage to the property is in an amount exceeding fifty dollars; otherwise, it is a misdemeanor. 9A.48.080 Malicious mischief in the second degree. (1) A person is guilty of malicious mischief in the second degree if he knowingly and maliciously: (a), Causes physical damage to the property of another i_ n an amount exceeding two hundred and fifty dollars; or (b) Creates a substantial risk of interruption or impairment of service rendered to the public, by physically damaging or tam- pering with an emergency vehicle or property of the state, a po- litical subdivision thereof, or a public utility or mode of public transportation, power, or communication. (2) Malicious mischief in the second degree is a Class C fel- ony.
