AN ORDINANCE OF THE CITY OF TUKWILA RELATING TO DISORDERLY
CONDUCT, PRESCRIBING PENALTIES, AND REPEALING ORDINANCE NO.
570, SECTIONS 1, 2, AND 3 AND AMENDING ORDINANCE NO. 989, 1.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA,
WASHINGTON, DO ORDAIN AS FOLLOWS:

Section 1. Disorderly Conduct Defined. For purposes of this
ordinance, a person engages in disorderly conduct if he, in a public place,
A. Fights, challenges another to fight, or agrees to fight;
B. Engages in conduct which tends to, or does, disturb the
public peace, provoke disorder or endanger the safety of
others. For purposes of this subsection B, "conduct" shall
not include speech which is uttered in a conversational tone
of voice.
C. Uses loud, obscene language, which tends to, or does, disturb
the public peace, provoke disorder or endanger the safety of
others.
D. Uses language which has a direct tendency to cause acts of
violence by persons hearing it.
E. Without lawful authority disrupts any lawful assembly or
meeting of persons.
F. Without lawful authority obstructs vehicular or pedestrian
traffic.
Section 2. Disorderly Conduct Prohibited. No person shall
intentionally engage in any disorderly conduct.
Section 3. Penalty. Any person who violates this ordinance
shall be guilty of a misdemeanor and on conviction thereof shall be punished
by a fine not to exceed $500 and /or imprisonment not exceeding 90 days.
Section 4. Severability. If any section, subsection, paragraph,
sentence, clause or phrase of the ordinance is declared unconstitutional or
invalid for any reason, such decision shall not affect the validity of the
remaining portions of this ordinance.
Section 5. Amend. Ordinance No. 989, 1, adopted September 7,
1976, is hereby amended to delete 9A.84.030, Disorderly Person, as adopted
by reference and codified under Tukwila Municipal Code 8.04.005.
Section 6. Repealer. The following is hereby repealed:
Ordinance No. 570, Sections 1, 2, and 3 adopted August 4, 1969 and codified
under Tukwila Municipal Code 8.04.010, 8.04.020, and 8.04.030.
Section 7. Effective Date. This ordinance shall take effect
