ORDINANCE NO. 1113
AN ORDINANCE RELATING TO OPENING OR
CONSUMING INTOXICANTS IN PUBLIC AND PRESCRIBING
PENALTIES, AND REPEALING ORDINANCE NO. 1078
The City Council of the City of Tukwila do ordain as
follows:
Section 1. Definition: Public Place. In addition to its or-
dinary meanings, for purposes of this ordinance, "public
place" shall include (a) any property owned, operated
or leased by the City or other muncipal body, and (b)
any vehicle which itself is located in a public place.
Section 2. Conduct Prohibited. Except as provided in section 3
of this ordinance, it is unlawful for any person in a
public place to drink, or to have in his or her
possession any open container of, intoxicating liquor.
Section 3. Exceptions. It shall not be unlawful to drink or
possess open intoxicating liquor in the following places:
(a) Municipal buildings where the sale and /or con-
sumption of intoxicating liquors is permitted by ad-
ministrative policy which is concurred in by the City
Council; or
(b) Any place which is authorized by the Washington
Liquor Control Board to sell or permit the consumption
of liquor.
Section 4. Penalty. Any person who violates this ordinance shall
be guilty of a misdemeanor and on conviction thereof
shall be fined not more than $500 hundred dollars and /or
imprisonment for not more than 90 days.
Section 5. Repealer. The following is hereby repealed:
Ordinance No. 1078, approved October 2 1978,
relating to opening or consuming intoxicants in public;
and codified as Tukwila Municipal Code section 8.04.520.
