'COUNCIL ACTION' MEETIN AGEt.DA j TYPE DATE i ACT!GN E IiEbi 1 Ph ISM WHEREAS, the existing ordinance creating the Tukwila Planning Commis- sion was adopted while the City of Tukwila was a third class city operating under the rules and regulations of RCW 35.63; and, WHEREAS, the City of Tukwila is presently operating under the Optional Municipal Code, in this case, RCW 35A.63 specifically. FOLLOWS: NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA DO ORDAIN AS Section 1. Creation, Membership. Pursuant to the authority conferred by Chapter 35A.63 of Ch. 119, Laws of 1967, Ex. Sess., as amended by Ch. 81, Laws of 1969, Ex. Sess., there is hereby created a City Planning Commission, consist- ing of seven (7) members who shall be appointed by the Mayor and confirmed by the City Council. Section 2. Term of Office, Residency. The terms of office shall expire on midnight of March 31. The terms of present Commissioners shall stay in effect, however, their expiration date shall be extended until March 31 of the year their term of office ends. Each term of office shall be for six years. Section 3. Vacancies, Removal, Selection. Vacancies occuring otherwise than through the expiration of terms shall be filled for the unexpired terms. Members may be removed, after public hearing, by the Mayor, with the approval of the City Council, for inefficiency, neglect of duty or malfeasance in office. Notice of the charge and pendency of the hearing with respect to the removal of a member of the Planning Commission shall be given by mail addressed to the resi- dence of the accused member at least five days before the date of said hearing. The members shall be selected without respect to political affiliations and they shall serve without compensation; PROVIDED, HOWEVER, they may be reimbursed for expenses nl:cessarily incurred in performing their official duties. Section 4. Powers, Duties. The Planning Commission shall have all of the powers and perform each and all of the duties specified by Optional Municipal Code provisions pertaining to planning and zoning in code cities (Ch. 35A.63 of Ch. 119, Laws of 1967, Ex. Sess., as amended by Ch. 81, Laws of 1969, Ex. Sess.). Section 5. Recommendations, Reports. The City Council or Mayor may refer to the Planning Commission, for its recommendation and report, any ordi- nance, resolution or other proposal relating to any of the matters and subjects referred to in said Optional Municipal Code provisions pertaining to planning and zoning in code cities, and the Commission shall promptly report to the Council or Mayor thereon, making such recommendations and giving such counsel as it may deem proper. Section 6. The Planning Commission shall adopt rules of procedure not inconsistent with state law. Section 7. Repealer. City of Tukwila Ordinance Numbers 242 and 839 are hereby repealed.
