NOTICE OF UNSAFE, UNLAWFUL, OR
UNFIT TO OCCUPY STRUCTURES
AND PREMISES
WARNING: These structures and premises are hereby declared to be unsafe, unlawful, and/or unfit for
human occupancy. As the owner(s), owner's authorized agent(s), or person(s) responsible for these
structures and premises, you are hereby required to complete tasks listed in the "Corrective Action
Measures Required" section below no later than the stated deadline. If you fail to comply, the City may
condemn these structures and premises and order the structures and premises to be immediately
vacated and structures boarded. In addition, the City may institute other proceedings at law or in
equity to restrain, correct, or abate the violation. Any action taken by the City shall be charged against
the real estate which the structure is located and shall be a lien upon such real estate.
Any person directly affected by this Notice, may appeal the Notice by requesting such appeal within 10
calendar days (March 24, 2022, by the end of business) after being served with the Notice. TMC
8.45.110. The request shall be in writing and include the applicable appeal fee as specified in the City's
fee schedule adopted by resolution of the City Council. Appeals must be sent to the City of Tukwila
Clerk's Office which is located in City Hall and can be found at 6200 Southcenter Blvd., Tukwila, WA

VIOLATIONS:
1. TMC 16.54.060(A). Standards.
All grading activities require erosion prevention and sediment control that prevents, to the
maximum extent practicable, the transport of sediment from the site to drainage facilities,
rights-of-way, water resources, and adjacent properties. Erosion and sediment controls shall be
applied commensurate with the degree of risk, and as specified by the temporary erosion and
sediment control measures, performance criteria, and implementation requirements of TMC
Chapter 14.30 and the Surface Water Design Manual.
2. TMC 18.54.030(A)(1). Tree Permit Required.

A Tree Permit is required prior to work within the Critical Root Zone of any Significant,
Exceptional or Heritage Tree or prior to the removal or destruction of any of these trees within
the City, unless the action is exempt from this chapter.
CORRECTIVE ACTION MEASURES REQUIRED:
1. A) Vacate all buildings and premises within 24 hours and remove all vehicles within 48 hours
after being served with this Notice. Buildings and premises must remain vacant until
completion of all Corrective Action Measures stated below, except for the purpose of securing
the structures and making the required repairs.
CORRECTIVE ACTION DEADLINES:
March 16, 2022 to vacate buildings and premises.
March 17, 2022 remove all vehicles.
B) Install Erosion and Sediment Control Measures on the adjacent hillside to prevent soils and
sediment from leaving the property which includes but is not limited to silt fencing around the
entire area of disturbed soil and where the trees were removed, straw waddles, and a minimum
of six (6) inches of straw mulch over all disturbed soils and the entire area where the tree
removals were performed. (Both Parcel # 0923049117 & 0923049102).
ALL EROSION AND SEDIMENT CONTROL MEASURES MUST BE MAINTAINED FOR THE LIFE
OF THE PROJECT.
The City of Tukwila highly recommends hiring a professional company, which installs all forms
of erosion and sediment control measures, to perform this work.
After installing the Erosion and Sediment Control Measures, obtain an inspection and approval
from Jim Toole, Tukwila Code Enforcement Officer.
CORRECTIVE ACTION DEADLINE:
Install all Erosion and Sediment Control Measures by March 23, 2022 or sooner
preferably.
C) Submit to the City of Tukwila a geotechnical evaluation report of the adjacent hillside to the
properties, which evaluates the stability of the slope and determines if slope stabilization
measures are recommended. This evaluation must be completed by a licensed State of
Washington Geotechnical Engineer.
SUBMITTAL DEADLINE: April 30, 2022
D) If the geotechnical evaluation report, referenced in C above, recommends stabilization
measures, submit a complete City of Tukwila Public Works Class C Permit application, plans,
and reports completed and submitted by a licensed State of Washington Geotechnical Engineer.

Obtain Public Works Class C Permit by June 30, 2022

Complete all stabilization work by October 1, 2022
2. Submit a complete Tree and Landscaping Modification Permit Application (Commercial), Tree
Replacement and Watering Plan, and Tree Maintenance Plan. Plans must be created by a
licensed in the State of Washington Landscape Architect.
SUBMITTAL DEADLINE: April 30, 2022
CORRECTIVE ACTION DEADLINE:
Obtain Landscaping Modification Permit by June 30, 2022
Complete all plantings by January 1, 2023
