BE IT ORDAINED BY THE TOWN COUNCIL OF TF TOWN OF TUK ILA, AS follows: SECTION 1. This ordinance is hereby declared to be an exercise of the police power of the Town of Tukwila, for the public safety, and its provisions shall be liberally construed for accomplishment of that purpose. SECTION 2. DEFINITIONS The words and phrases herein used for the purpose of this Ordinance• have the meanings relatively ascribed to them. (a) "Person" shall include avert' natural person, firm or copartner- ship, association or corporation. (b) "Fuel Oil" shall mean any liquid used as fuel and having a flash point not less than 110 Fahrenheit. The Pensy- Martens closed cup tester shall be authoritative. The test shall be made in accordance with the methods of test adopted by the American Society of Testing Materials. (c) "Oil Burning Equipment" shall consist of oil burners, and oil burning units, all equipment connected thereto, including internal and external supply for storage tanks, piping, wiring and all accessories. (d) "Oil Burners" shall mean any device designed and arranged for the purpose of burning or preparing to burn "Fuel 0i1" as soecified in (b) of this Section. (e) "Other Heating Equipment" shall mean any other type of heating installation. SECTION 3. DEFINITIONS Wherever used in this Ordinance, in referring to oil burners and /or oil burning equipment, the following words and expressions are used in the sense defined in this Section: AUTOMATIC OIL BURNERS An oil burner to which all fuel is delivered by a pump, and is provided with a device that will ignite the oil fuel upon being turned into the combustion chamber. GRAVITY OIL BURNERS An oil burner to which fuel is delivered from a gravity tank. GGRAVITY OIL TANKS An 0i1 storage or supply tank from which oil is delivered to an oil burner by means of gravity flow, provided this definition small not apply to an oil reservoir which is elsewhere defined. GIL BURNER Any device designed, arranged or used to burn oil. GIL BURNING EQUIPMENT A1S equipment connected to an oil burner, including tanks, piping pumps, burners, oil burning stoves, units, electric wiring and other accessories thereto. OIL BURNING STOVE A sell contained stove or heater designed by the manufacturer to burn oil fuel in which the combustion chamber and oil burner are con- structed as an integral part. OIL FULL Any liquid used as fuel and having a flash point not lower than 11,0' Fahreteit. page 2. For the purpose of enforcing these Police Actions the Fire Chief shall appoint a Fire Inspector, subject to the approval of the Town Council. In the event of a disagreema t arising during an inspection the Inspector may call in the Fire Ckiief. SECTION 4. CERTIFICATL OF APP i ;VA.L It shall be unlawful to install, sell or offer for sale or use, with- in the Town of Tukwila, any type of oil, burner as hereinbefore defined, or any oil burning furnace, oil burning heater, or oil burning boiler unless such heating equipment bears the seal of approval of the Under- writers Laboratories, Inc. or some other recognized testing laboratory, or its equivalent to the standards of the recognized approved units. Tanks and piping need not bear.the seal of approval, but tanks shall bear the manufacturer's name and the gauge, as required in Section :o.1O of this Ordinance. This Section shall not be dunned to prohibit the installation of an approved or standard all burner in a solid fuel furnace, heater or boiler unless the Tukwila Fire nspector rejects the installation of such equipment as unsafe to persons or property or as otherwise in violation of this Ordinance. SECTION 5.. PERMITS Every person, firm or corporation selling an oil burner, unit or equipment, which is to be installed by them or their agent, used, stored or delivered within Tukwila, shall secure an installation permit from the Tukwila Fire Dept. within forty eight (43) hours after such sale, and shall report the name and type of such burner, and the name and address of the purchaser and ansta.11er. It shall be unlawful to maintain or use, or cause to be used or maintained, any oil burning equipment, or oil burner, without complying with all provisions hereof relating to the maintenance and use of oil burners and oil burning equipment, and it shall be unlawful to install alter or repair, or to begin the installation, alteration or repair of any oil burner, oil burning equipment or underground tank for the storage of flammable liquids where the cost or expense or the estimated cost or expense of such installation, alteration or repair, exceeds the sum of seventy -five dollars( w75.00 ),without first obtaining from the Tukwila Fire Dept., a written or printed permit to do so, and without complying with all provisions hereof relating to the installation, alteration or repair of same. Permits as herein required shall be issued in accordance with the following terms: (a) Such permit shall be issued without charge gpon written appli- cation therefor by the owner of the premises or the dealer installing an oil burner, whereon such burner, equipment or tank is to be installed, altered or repaired, or his agent. in such application, such owner' or agent shall state the location of said premises, the name of the owner thereof, the name and address of the person who is to make installation, alteration or repair, the type and ::lake of burner, equipment or tank to be installed, altered or repaired and the use for which it is intended. The Fire Inspector, shall inspect all oil burners, oil burning equipment, and/or oil tanks installed, altered or repaired pursuant to such permit, and if same comply with the provisions of this Ordinance, shall endorse his approval on such permit. No such oil burner or oil burning equipment or tank shall continue in use without such. endorsement. Page .3. SECTION 6. TYPES PERMITTED (a) Where oil burning systems using a pump to deliver oil fuel from an above ground oil storage or supply tank to the burner are installed or used, the construction of the tank and its distance from the heating device containing the oil burner, and all piping in connection therewith shall comply with the provisions hereof relating to gravity oil burning systems. (b) If the suction outlet from an oil supply tank of such system is located.below the level of the oil burner or an approved antisyphoning device is provided in the oil feed pipe to the burner, such oil burning system may be installed and used in any story of a building and in pre mises of any type occupancy, notwithstanding the restrictions hereinafter provided for gravity oil burning systems. In all other respects oil burn- ers to which oil fuel is'delivered by pumping from an above ground stor- age tank, shall comply with the requirements of the ordinance relating to oil burners connected to tnderground tanks. (c) All burners and oil burning stoves which are designed to burn oil having a flash point not less than one hundred (110) degrees Fahren- heit, and which are provided with an integral oil storage or supply tank having an 011 capacity in excess of six(6) gallons, are prohibited. It shall be unlawful for any person to use any such oil as a fuelnor as a primer for any oil burner, in any oil burning system using an oil supply tank of a capacity in excess of six(5) gallons. (d) No oil burning or gas fired furnaces are permitted entirely in the attic. (e)LIQUEFIED PETROLEUM GAS CONTAI, r S: ivon- portable containers for the storage of liquefied petroleum gases(propane and butane are the principal constituents) shall be constructed in accordance with the Unfired Pressure Vessel Code of the American Society of Mechanical Engineers Storage containers shall be so located with respect to the nearest building or group of buildings, or line of adjoining property which may be built upon; subject to the approval of the Fire Inspector. Storage and handling of liquefied petroleum gas shall be governed by National Board of Fire Underwriters Pamphlet No. 58, which we are adopting by reference. (f) FLOOR FURNACES Placement shall be so that no door drapery, or similar object can be nearer than twelves inches(12") to any portion of the floor furnace or register. The floor round the floor furnace shall be braced and headed with a framework of material not lighter than joists. The inside dimensions of the framework shall be approximately i inch longer and wider than the furnace to be installed. Means to,be provided to support the furnace when the floor grille is removed« The bottom of the floor furnace shall have at least six(6) inch clearance from the ground, obtained when necessary by excavating the ground below and to the sines to fora a "basin -like" pit tender the furnace et that there is a six inch(5 clearance beneath the furnace and a twelve inch(12 clearance on all sides, except the control side, which shall have an eighteen inch(13 clearance. This facilitates any servicing that may be required and allows angle air for proper combustion Whenever the excavation exceeds twelve inches(12), or water seepage is apparent under the house, a water tight copper pan, concrete pit, or other suitable material shall be used for seepage pan. The copper pan shall be made of not less than sixtoen(1G) oz. sheet copper and shall extend at least four(4) inches above the ground level, with twelve(12) inch clearance from the furnace on all sides except the control side, which shall have an eighteen(13) inch clearance. Page 4. Floor furnaces shall be readily accessible. Openings in foundation walls shall not be smaller than 24 inches by 43 inches. Underfloor passage ways to the furnace shall not be less than G© inches high by 24 inches wide. All gas floor furnaces, including those having single or dual wall register outlets, shall be installed without alterations, extensions or changes of any kind in the furnace, Gas floor furnaces may be installed in an upper floor, provided the furnace assembly projects below into a utility room, closet, garage or aimilar non- habitable space. In such installations, the furnace shall be completely enclosed, with .means for air intake, with provisions for ser- vice, with furnace clearance of six. (6) inches, on all sides and bottom, and with enclosure constructed of Portland cement plaster or metal lath or material of equal fire resistance. All gas floor furnaces except j using liquefied petroleum gases, shall be equipped with gas pressure regulators, which shall be adjusted and sealed so that the gas input does not exceed the approved input rating. SECTION 7. AUTOMATIC SYSTEMS Automatic Oil Burners for installation in ranges, stoves, furnaces and boilers, other heating devices and all oil burning equipment in connection therewith, shall comply with the following requirements of this section. (a) Only such automatic oil burners as have been inspected and approved by the National Fire Underwriters t Laboratory and the Tukwila Fire Inspec- tor as elsewhere herein provided, shall be installed or used within the Town of Tukwila. (b) The Fire Inspector may reject or disapprove any automatic oil burner which is not provided with adequate safeguards against fire or explosion or which is otherwise unsafe for use within the Town of Tukwila. (c) The reeomnendations and regulations pertaining to oil Burners of the Automatic type for installation in boilers and hot air furnaces and other heating devices as provided from time to tLae by the National Board of Fire Underwriters and standards of construction as promulgated by Underwriters Laboratories or any other organization of equivalent standing properly equipped and qualified for experimental testing and inspection, may be accepted by the Tukwila Fire Inspector as prima facie evidence that any automatic oil burner 'complying with such regulations is safe for use within Tukwila, and the Fire Inspector may at his discretion permit the installation and use of any such automatic oil burner, subject to the special provisions herein provided. (d) All automatic devices used in connection with oil burners shall be of the type and shall comply with provisions hereof relating to automatic shutoffs. Wall heaters shall not be installed in walls of combustible construction unless approved by a Nationally recognized testing laboratory for such installation. Wall heaters which are approved by any recognized testing laboratory for installation on a combustible floor shall have the mounting consist of one layer of finch asbestos :will board placed over two layers of inch plasterboard. Wall furnaces within a partition emitting heat through louvers on one or both faces shall have two(2) inch clearance to all combustible wood. All fuel- burning appliances shall be assured a sufficient supply of fresh air for proper fuel combustion.. _Space: If the volume, in cubic felt, of the space in which fuel burning appliances are located is less than: 1. One- twentieth(1 /20 th.)of the maximum rated input in the B.t.0 ►s of all gas- burning appliances in such space plus 2. One- tenth(1 /l0th.) of the maximum rated input in L.t.uts of all solid and liquid fuel burning appliances in such space; provisions shall be made to supply this space with fresh air. Methods of Supplying_ Fresh Air: Where provisions for fresh air are required in this Section, the Fire Inspector shall specify which of the following methods shall be used: 1.. Permanent openings or duets leading from appliance location to the out side of the building. For gas- burning appliances, such openings or ducts shall have a total unobstructed area of not less than one square inch (1 sq.in.) per 1000 B.t.u. maximum input rating of all such appliances in the spaces. =Far solid and liquid fuel- burning appliances, such openings or ducts shall have a jrotal unobstructed area of not less than two square inchee(2 $q.in.) per B.t.u. maximum input rating of all such appliances in the space. 2.Permanent openiinga or ducts leading from appliance location to other interior areas which meet the minimum required ,Tnluune specified in Section "space- of thin Section. Such openings e .}d r s.tshall be not less in size than those specified in Section ("Method Fresh Air of this Section. Where openings or ducts are used, they shall consist of two(2) Or more, of approximately equal area, one (1) or more within six(6) inches of the ceiling of the appliance enclosure and one(1) or more within six(6) inches of the floor of the appliance enclosure. Gravity oil burners for installation in ranges, stoves, furnaces,boilers and other heating devices, and all oil burning equipment in connection therewith, shall comply with the following requirements of this Section. (a) Only such gravity oil burners as have been inspected and approved by a nationally recognized laboratory and the Tukwila Fire Inspector, as elsewhere herein provided, shall be installed or used in Tukwila. (b) The Fire Inspector may reject or disapprove any gravity coil burner which is not provided with an adequate safeguard against fire or explosion or which is otherwise unsafe for use within Tukwila. (a) The recommendations and regulations pertaining to oil burners of the gravity type for installation in stoves, ranges and other heating devices as provided from time to time by the National Board of Fire Underwriters gnd the standards of construction as promulgated by Underwriters torlea, or by any other organization of equivalent standing, properly equipped and qualified for experimental testing and inspection, may be accepted by the Fire Inspector as prima facie evidence that any gravity oil burner complying with such regulations is safe for use within Tukwila and the Fire Inspector may, at his discretion, permit the installation and use off any such gravity.oil burner, subject to the special provisions herein provided. (d) No gravity oil burner having an oil supply tank of a capacity exceed- ing six(6) gallons, shall be installed or used in any portion of a build- ing used for the purpose of a hotel, apartment house or an assembly hall, or a rooming house, school, theater, church, department store or place of refuge or detention, unless such burner is equipped with an approved auto- matic device in accordance with the provisions of this ordinance, relating to automatic shutoff. Page 7. SECTION Si(Continued) No oil burner connected to a gravity tank having a capacity in excess of six(6) gallons shall be located above the lowest story of any building in which installed, or be less than ten(10) feet away from any stove,fur- nace, or other heating device. No gravity oil tank shall be located more than 36 inches above the oil burner to which it is connected. (f) Gravity oil tanks of a capacity exceeding six(6) gallons shall be con- structed of galvanized steel or open hearth steel or wrought iron painted on the outside with a good grade of asphaltum paint or other rust resist- ing paint.. Tanks of a metal(noj less than 0.6 U.S.Standard) gauge in thick- ness, shall be used. (g) No glass bottle oil container and no oil supply tank of the vacuum feed type shall have a capacity in excess of one(1) gallon. (h) Every gravity oil burner shall be provided with an approved automatic safeguard to prevent flooding of the burner or a proper arrangement of the burner equipment to maintain a constant or fixed level of oil to prevent abnormal discharge of oil. (i) No. gravity oil tank or container shall be provided with an oil level gauge which leaks or is likely to leak. Glass gauges except as permitted for glass bottle containers are prohibited. (j) No damper which may entirely close the chimney uptake shall be installed or used in any smoke pipe between e gravity oil burner and the chimney, and the air regulating device on the front of the stove, range, furnace or other heating device:, shall be permanently fastened in the open position. (k) Standard full weight wrought iron or steel pipe not less khan one fourth inch(e) inside diameter, xlikmaxwailxiNiakasxsxmatxtexx or brass or copper tubing, not less than five- -sixteenth inch(5 /10) outside diameter, with a wall thickness not less than -,032 inches for small sized, and correspond- ingly heavier where necessary, shall be used for oil supply lines. All piping and tubing shall be tightly put together with due allowance for expansion, contraction, jarring and vibration and where necessary, pro- tection against mechanical injury. (1) Gravity oil burning equipment shall comply with the requirements of this ordinance relating to oil burners to which oil fuel is delivered to the burner by pumping in so far as the same is practicable and does not conflict with the requirements of this Section. SECTION 9. OIL BURNING STOVES All gravity oil burners and /or oil burning stoves, shall comply with the following requirements (a) Only such oil burning stoves as have been approved by the -rational Board of Fire Underwriters' Laboratories and inspected by the Tukwila Fire inspector shall be installed or used in Tukwila. (b) The Tukwila Fire Inspector may reject or disapprove of any oil stove which is not provided with adequate safeguards against fire or explosion or which in his judgement is otherwisw unsafe for use in Tukwila. (c) The recommendations and regulations pertaining to oil burning stoves as provided from time to time by the National hard of .tire Underwriters, and the standards of construction as promulgated by Underwriters' Labora- tories, or by any other organization of equivalent standing, properly equipped and qualified for experimental testing and inspection, may be accepted by the Tukwila Fire Inspector as prima facie evidence that any oil burning stove complying with such regulations is safe for use within Tukwila, and the Fire Inspector may at his discretion, permit the installat- ion and use of any such ce urnin; stove, subject to the special provisions herein provided. SECTION 9.(continued) Page 3, (d) The oil reservoir supplying oil to the burner in oil burninL; stoves shall have a capacity not exceeding six(v) gallons. 011 reservoirs shall be substantially constructed of metal and shall be firmly supported and secured against overturning. No oil reservoir shall be located more than thirty -six (36) inches above the level of the oil burner to which it is connected. (e) No glass bottle oil supply container or gravity oil tank of the vacuum type shall have a capacity in excess of one(1) gallon nor shall more than two(2) such oil containers or tanks be connected to a single heating unit. (f) Gravity oil tanks used in connection with oil burning stoves shall be constructed, installed and maintained as hereinbefore provided for oil tanks used in connection with gravity oil burners, except as otherwise permitted in this section. (g)Every oil burning stove shall be provided with an approved automatic safeguard to prevent flooding of the burner, as elsewhere provided for gravity oil burners. (h) Oil gauges on oil reservoirs and oil supply tanks, and dampers in smoke pipes between oil burner stoves and chimneys, shall comply with the requirements elsewhere provided gor gravity oil burners. (i) The provisions of this ordinance limiting of gravity oil burners to the lowest story of such Installation or use in the premises of a occupancy, shall apply equally to oil burning 1 551 1501 4001 12001 20001 550 1500 4000 12000 20000 30000 the installation and /or use a building and restricting specifically mentioned stoves. SECTION 10.INSTALLATIGN OF ST0RAG TANKS) FOR FUEL OIL: (a)Underground tanks shall be thoroughly coated on the outside with tar, asphaltum or other suitable rust resisting material. (b) Above ground tanks shall be coated with a good quality rust resisting paint. The design and construction of tanks shall conform to generally accepted good proctice, and shall be approved by the Fire Inspector. Tanks labeled by the Underwriters' Laboratories Inc., and tanks conforming to the Standards of the National Board of Fire Underwriters or of the Ameri- can Petroleum Institute, shall be deemed to conform to generally good prectice; other tanks shall be marked with the manufacturer's name and the gauge of the tank. In no case shall the thickness of an underground tank for the storage of flammable liquids be less than specified in the following table: CAPACITY GF TANKS IN GALLONS MINIMUM THICKNESS 0i MATERIALS Shell Heads to No.12 gauge No .12 gauge to 3/16" 3/16" to 3/16" 1/4" to 1/4 5/16" to 5/16" 3/3 to 3/8 1/2 (b -1) In no case shall any underground tank for the keeping or storing of Class 1, 2 or 3 flammable liquids, be located underneath any building or within the enclosed walls of any building, before obtaining permission from the Fire Inspector. Except as hereinafter provided, underground tanksshall be so buried that there shall be at least: Two(2) ft. earth coverage for 7 bbl. tank Three(3)" 7 to 16 bbl.tank Four (4) over 16 bbl.tank In lieu the earth covering, tanks may be buried under 12 inches of earth cover, and reinforced concrete, at least 5 inches in thickness, provided; concrete to extend at least one(1) foot beyond the outline of the tank in all directions. SECTION 1©. (continued) Under ;round tanks, in connection with the stora of fuel oil, for oil burning equipment, shall be installed a distance of three(3) feet from any building. (b •2) Storage of fuel oil in connection with oil burning equipment shall not be permitted in buildings; all fuel oil tanks shall be buried beneath the ground with the exception that a 55 Callon drum may be allowed; a second 53 gallon drum may be provided if connected to an approved 3 -way valve so that not more than 55 gallons can be discharged at any time, and properly installed as hereinafter provided. (c) Where underground tanks are used for the storage of fuel oil in connection; -with oil burners, and are so located that the top of the tank is above the level of the suction inlet of the pump supplying oil to the burner assembly, a siphon- breaking device, consisting of an anti- eyphonong valve, and /or a vacuum tank for the prevention of syphoning Shall be required to be installed at the highest point of the suction pipe lines. i'ht anti syphoning device must not be install- ed in the furnace casing. Where fuel oil is delivered to an oil burner by means of a pump, an overflow or return pipe shall be provided be- tween the pump and tank, which pipe shall not be less bhan 3/S inch in diameter. (d) Storage tanks shall have an open vent, or an approved automatic- ally operated vent pipe, Vent pipes shall conform to the standards of the National Board of Fire Underwriters' pamphlet ra. 30, or shall not be smaller than specified in the following table: CAPACITY IN GALLONS 1 to 300 3/4 inch 301 to 1000 1. inch 1001 to 30u0 li inch 3001 to 10000 2 inch 10001 to 25000 2- inch 20701 to 50000 3 inch' The vent pipe shall be connected to the tank by two(2) swing joints at the tank and two(2) swing joints above the tank; the vent pipe shall continue a distance of eight (2) feet above the ground, and shall not extend through the tank far a distance of more ,hen one (1) inch. In all piping systems, proper allowance shall be ::lade for expansion and contracjCion, jarring and vibration. No pipe connecting any oil burner with any fuel oil storage tank, shall be installed where it will be exposed to the heat of a fire box. (g) PUMPS: All auxiliary pumps used for pumping all from storage tanks to auxiliary tanks shall be of the approved type. They shall be rigidly mounted. (b) Garages shall be provided with .::Leans for occasional :ventilation subject to operating conditions. Natural ventilation may be employ- ed where practical to maintain open windows or other openings at any time. All fans used few circulating air within a ar age, or exhaust air from a garage, shall be of the non-spark type. (c) Floors shall be kept clean and free from oil; approved metal receptacles with self closing lid covers for the storage of oily waste shall be provided. (d) Smoking shall be prohibited except in offices or rooms provided for this purpose. Signs to this effect should be prominently displayed. A pressure test shall be made before any underground tan k is used for etor gg flammable liquids; this test to be made in the preaenoe of the Fire Inspector, or an affidavit oust be submitted to the Fire Inspector's office advising of the test, and a clear ance of the test results must be obtained before installation is covered. Pressure test shall be construed to call for an air pressure of 5 to 10 pounds per square inch; all seams to be applied with a proper soap and water solution t.3 detereine leaks; all leaks developed to be properly correct- and re- tested. (a) The filling operation ;:lust bo physicallyaccompllshed by the attendant, (b) The tank of the motor vehicle shall not be re- fueled while the motor is running or when a person is smo near the pump. SECTION 13.(continued) (b) Pump islands shall contain not more than two(2) pumps and shall be located at least 25 feet from any other pump. (c) One approved type fdtre extinguisher shall be provided for each pump island. Page 12. (d) Control room or office shall be so located and constructed to provide unobstructed view of all pump islands. (e) There shall be no less than one(1) able bodied attendant (13 years or older) on duty at or near the Control Room at all times while the Station is open to the public. (f) Each nozzle for dispensing gasoline shall be equipped with an approved "dead man" control valve and an approved vacuum operated overflow valve. (g) All pumps and facilities fbr delivering gasoline shall be of-a type approved by the National Board of Fire Underwriters and the Fire Inspector and shall be equipped to provide effective means to prevent public access to supplies of gasoline during times when station operators, eiuplovees or authorized representatives are absent from the premises. Coffin_ o Aerated gasoline vending facilities are__ ereby prohibited, (h) Automotive repair facilities "shall not be operated in conjunction with self service stations. Garages and repair facilities shall be considered a separate premises and all buildings and storage incidental thereto shall be located at least 50 feat from gasoline pumps. (i) The control tower-and all other buildings in connection with a self service station shall be constructed entirely of incombustible materials. (j) The tank of a motor vehicle shall not be re- fueled while the motor is running, or when a person is smoking near the pump."NO SMOKING-STOP YOUR MOTOR" signs shall be prominently displayed. (k) Self service pump islands shall not be located in any building nor enclosed in any manner, except that canopies, one(1) to each pump island, constructed of non- combustible material and open in all sides, may be permitted. (1) There shall be provided in each control room, or office, an individual switch to control the motor on each gasoline delivery pump. (m) Underground tanks shall be buried so that there will be at least four (4) feet of earth around the entire tank, provided that Where it__is_ im- practicable to provide four(4) feet of earth over the top of an under ;round tank, the Fire Inspector mar permit in lieu thereof that the tank be buried under fifteen(15) inches of earth and a cover of at least nine (9) inches of reinforced concrete be provided, which shall extend at leash one(1) foot beyond the outline of the tank in all directions. (n) Except as otherwise hereinbefore provided, when two(2) or more tanks are installed, there shall be no less than four(4) feet of earth or a brick or concrete dividing wall not less than twelve(12) inches in thick- ness, between, and for the entire length of each tank and extending at least one(1) foot beyond the ends and above the top of the sa.e. (o) An underground tank for Class i or 11 flammable liquids shall be located not less than the distance indicated in the following table, measured horizontally from the nearest point of the shell to the near- est line of adjoining property that may be built upon and the nearest hillside wall of any basement or pit, of which the floor is lower in elevation, than the top of such tank. where such location causes un- necessary hardship, an underground tank may be placed closer than the distance specified if enclosed, encased or otherwise protected from physical damage. Tanks shall be covered with a :minimum of 2 ft. of earth, or shall be cover- ed with not less than 1 ft. of earth on top of which shall be placed a slab of reinforced concrete not less than 4 inches thick. When sub- jected to traffic, tanks shall be protested against damage from ve- hicles passing over there by at least 3 ft. of earth cover, or 13 iri. of well- .tamped earth, plus either 3 inches of asphaltic concrete pre- tAAnches of reinforced concrete. When asphaltic or reinforced concrete paving is used as part of the protection it must extend at least 1 ft. horizontally beyond the outline of the tank in all directions. ANCHORAGE: Where a tank may become buoyant due to a rise in the level of the water table or due to location invan area that may be subjected to flooding, the applicable precautions outlined in Appendix I; of the National Board of Underwriters+ phamplet No.30, shall be observed to anchor the tank in place) which pamphlet, namely ho.30, we are adopt- ing by reference. SECTION 14- FLOORS UNDER FURNACES- BOILLhS Combustible floors wider furnaces or boilers containing oil burners shall be covered with four(4) inches of concrete, or covered with six(6) inches of hollow tile, wLich in turn shall be covereu with a good quality of fire brick laid in clay. The floor coverinL small extend beyond the sides and ends of the boiler lino. furnace as re- quired by the Fire Inspector, unless oil fired units are listed and approved by a recognized testing; laboratory for safe installation on a combustible surface. The fire box containing, an oil burner shall be provided with an inspection opening, so locates that the fire box can be readily inspected when the burner is in use. Inspe ion openings shall be provided wit% covers. SECTION 15- AUTOMATIC SHUT-OFF: Location Page 13. If top of tank is above the lowest floor, basement, or part of any building which is not les than: All controls must be of the type recce:emended by authorizes Testing Laboratories, or as approved by the Fire Inspector. SECTION 16-CHIMNEY No oil burner shall be installed in convection with any boiler or heater unless said boiler or heater is connected with a chimney having sufficient draft to insure the safe operation of the burner, nor unless the room containing; such boiler or heating unit is provided with adequate ventilation, which cannot be closed to assure contin- uous complete combustion, which ventilator shall be by means other than doorways. Chimneys shall be constructed of brick or eiasonry, flue lined, supplied with clean -out, and duly supported on a concrete foundation. SECTION 16. (continued) Page 14. No manually operated dampers shall be installed or used ina smoke pipe between the burner and the chimney, and any regulation or draft necessary, shall be accomplished thrdngh the dampers in front only, or through automatic draft regulators in the smoke pipe. When no increase in fire or explosion hazard will be caused, air inlets to chimneys may be permitted by the Fire inspector. No oil burner shall be used or installed in connection with any steam or hot water boiler or wawa air furnace unless the boiler or furnace is enclosed as required by the Fire Inspector. This applies to places of public assembly, places of refuge, convalescent homes, places of detention, and multiple swellings; not to private dwellings. SECTI +.N 17- OPERATION OF BOILER Oil burners and oil burning equipment Etha11 be operated and maintained in accordance with the following provisions: (a) No oil shall be placed in any tank connected to an oil burner until suc4 tank has been duly inspected and ap=p by roved b the Fire inspectors f (b) Oil storage and supply tans connected to burners shall contain only that type of oil for the combination and combustion of which the type of burner is deemed by the manufacturer. (c) Except when installed in one or two family residences, it shall be the duty of the person in charge of every oil burner used to heat air or water, to make periodical inspections of t_:e oil burner while same is in operation, and the fire box in which installed. (d) Complete legible instructions for correctly operating and main- taining oil burning equipment shall be posted at all times in the room containing the oil burner, with the principal directions for proper operation and maintenance, shown in bold face type in concise non technical terms.. These instruction: sheets shall be subject to the approval of the Fire Inspector and shall include instructions for proving the correct operation of all impottant parts while in service. (e) It shall be the duty of the person in charge of every oil burner installed in any building, to inspect and ^:aintain the equipment for proper operation, free from unnecessary fire hazard or oteer denser- ©us conditions, and to have necessary adjustments made by a competent person, and no other duties shall interfere with such attention as often required by the nature of the installation and the working oonaitions (f) It shall be the duty of every person in charge of every oil burner installed in any building to allow no accumulation or leakage of oil in the furnace pit or in the fire box, or on the basement oiz boiler floor; to keep the nozzle of the oil burner clean from carbon taxicsap att and dirt; to keep the fire box free from excessive de- posits of carbon; to keep oil piping through which tail is delivered from the oil storage tank to the burner, absolutely tight and free from oil leaks; to keep all packing glands of the oil pumping ap- paratus tight and free from oil leaks and to keep tte oil burner in proper working condition at all times. In case of carbon forming ping within two(2) Beet of the nozzle of the oil burner, such carbon deposits shall be in.nediately removed and the cause thereof corrected. (g) It shall be unlawful to use or cause to be used, any oil burning equipment that has become unsafe, or is in i ninent dcnp er of becom- ing so. SECTION 19. The National Board of Fire Underwriters' pamphlet Do. 90, governing Air Conditioning, Warm Air Teatinv-, Air Cooling and tien,tilating Systems is considered a part of this Ordinance, and is hereby adopted by reference. SECTION 21. SECTION 20 PENALTIES SECTION 18 ELECTRIC WIRING All electric wiring in connection with installations covered by this Ordinance shall comply with the Electrical Code of the State of Washington. Any person who shall violate any of the provisions of this Ordinance or who shall counsel, aid or abet any such violation, shall be deemed guilty of a misdemeanor and,upon conviction thereof, shall be punish- ed by a fine in any sum not exceeding $300.00 or by imprisonment for a term not to exceed ninety (90) days or both such fine and imprisonment.
