CALL TO ORDER In the absence of Mayor Van Dusen, Council President Bauch
and called the Regular Meeting of the Tukwila City Council to
PLEDGE OF ALLEGIANCE order and led the audience in the Pledge of Allegiance.

Don Morrison, City Administrator, reported that there was no
response to the City's Call for Bids for a Fire Pumper. The
State law allows Council to authorize the Administration to
enter into a contract without any further call for bids.
MOVED BY PHELPS, SECONDED BY MORGAN, THAT THIS ITEM BE PLACED
IN THE PUBLIC SAFETY COMMITTEE. MOTION CARRIED.
Council Member Morgan, reporting as a citizen, said there
will be a book sale at the Tukwila Library on Saturday,
October 12, from 1 to 5 p.m. There will also be baked goods
and plants available. Volunteer help would be appreciated.

c. Budget Transfer to provide funds to install a 30 -foot
aluminum flag pole and lights on the west side of the club-
house. Foster Men's Club will provide the flag.
d. A resolution to authorize the Mayor to apply to the King
County Community Development Block Grant Office to utilize
1986 Population Funds for the Upper Foster Playfield Project,
to apply to use any uncommitted 1983, 1984, and 1985
Population Funds to this same project and to apply for
$20,000 in 1986 Needs Funds for this project.
e. An ordinance of the City of Tukwila amending the 1985 budget
to appropriate unanticipated revenues in the Land Acquisition,
Building and Development Fund for the Foster Park Drainage
Project and establishing an effective date.

Council President Bauch reported that this Public Hearing was
continued from the meeting of September 23 because the
Environmental Review had not been completed. It is ready now
and the Public Hearing can continue.
Council President Bauch declared the Public Hearing open.
Brad Collins, Planning Director, explained that the Declaration
of Non Significance for the subject property was issued
September 28, 1985. A revised check list is included in the
Council Packet.
Mrs. Elizabeth Springer, 13325 42nd Avenue South, stated that,
as she understands, the zoning of this property on the
Highline Plan is S -R, Single Family Residence. They spent a
great deal of time studying the zoning in this area. The parcel
in question has two houses on it. Housing is short in King
County and, as we understand it, the owner of the property
is proposing to tear down these houses and replace them with
a building of some kind. In 1979 and 1980, some of the residents
of the area further north thought they could maintain their
single family status better in Tukwila. Those of us who have
lived in the area a long time know better than that. We got
out and campaigned against the attempt to annex to Tukwila.
When the election was held, it was 2 to 1 against annexation.
What will happen, two single- family residences will be
destroyed and we will be left with no buffer zone against
your Industrial Zoning. What bothers us, is that you do not
police the area. The trucks are still using Macadam Road.
The rumor goes even further that you will march across the
street to the west where we all have our homes. There is
little enough housing in King County, this is an excellent
buffer against your manufacturing area and I suggest you leave
it at that. I see no reason that it should be annexed to
Tukwila inasmuch as less than five years ago we voted to
maintain it single- family.
Mr. Bob Storseth, 15610 SE 24th, Bellevue, said he is the
contract- purchaser of the property. In answer to the question
if he had requested a zoning change from King County, he said
that he felt the property was a natural extension of the
boundaries of Tukwila. It would be to his advantage and the
City's advantage to make them one and coordinate his efforts
through one municipal authority.
Mr. Jim Guess, Kent, said he is owner of property right across
the street from this proposed annexation. He asked to go on
record as being in favor of the annexation. The housing in
that area is substandard including their own property. An
annexation and a rezone to warehousing would only improve the
area.
Mrs. Joan Poirer, 13405 42nd Avenue South, said the property is
a ridge that dips right down to East Marginal Way, beautiful
for trucking. Now, do you see the problem? As soon as warehousing
goes in on that triangle you jump across the street. My
only objection is trucking 24 -hour trucking and trucking on
Macadam Road. We cannot battle this progression of industrial
property. The battle right now is the quality that is going in.
The Fostoria warehouses have been very good facilities other
than for the problem with the Profit Company. If this property
can be maintained, controlled and built so it is not trucking
24 -hours a day it still can be compatible to the residential area.
We would like to maintain the availability of Macadam Road,
you can not make the turns easily with buses and semis and you
cannot run semis over that bridge continually. We would like to
see a water report. Where is the pressure for fire protection?
If we can work with the developer and be sure there is no
access from this property on to 42nd then it might be a feasible
situation. I am not against the annexation, I am against the
heavy trucking.

Mr. Jerry Knudson, 6421 South 143rd Place, said he is a
partner in the property across the street. As a property owner,
he feels very strong that they would welcome the annexation
of the property to the east into Tukwila. There are some
strong points into coming into Tukwila. They have rules and
regulations much tougher than what the County has to offer.
They do not oppose the annexation of the property in question
into Tukwila.
Mr. Don Radford said he is part -owner of the property at
13308 42nd Avenue South. There has been a lot of discussion
concerning the trucks. I have lived on that access for five
years and have not seen that many trucks on 42nd or Macadam.
I do not think the objection for the trucking should be consi-
dered a major problem. There should not be trucks up and down
Macadam, it was not designed for trucks. This should have no
bearing on the annexation.
Mr. Peterson, 13305 42nd Avenue South, said he is not against
the annexation to Tukwila. I have to agree that 42nd and
Macadam is not for trucks. I would like to see the area cleaned
up and see that the larger vehicles stay on 133rd and the
road below. I would like to see it annexed.
7:50 p.m. There being no further comment, Council President Bauch
closed the Public Hearing.

BE DRAWN UP TO ACCEPT THE ANNEXATION AND THAT THIS ITEM BE
PUT FORWARD TO A FUTURE COMMITTEE OF THE WHOLE MEETING AT THE
COUNCIL PRESIDENT'S DISCRETION. MOTION CARRIED.
Council Member Phelps commented that an issue that keeps coming
up is the concern over the trucks that miss their turns and
find their way into the neighborhood where they should not
be. She asked to have the Public Works Department look into
the signage within the City Limits. Maybe some directional
signage might help.
Council President Bauch said we need to confirm that the Air
Freight Company is keeping to their time limit and to the
size of thq trucks they agreed upon.

TO HEAR ITEM 9(C) AT THIS TIME. MOTION CARRIED.
Dev. proposal for Grp. Brad Collins, Planning Director, said this is a continuation of
5 Proj w /summary of a discussion started September 16 on a development proposed by
soils traffic reports.Group 5 under Planned Residential Development in the zoning
Council to consider code. At that time Council requested additional information
request act upon about soils and traffic which is included in the Staff
recommendation of Memorandum dated October 2, 1985. Staff's Conclusions were
Planning Comm. as follows:
Soils information indicates that normal excavation, landfill,
foundation construction and drainage are adequate for the
proposal. The recommendations of the soils engineer will
be followed, but the Building Official can and may also
require a construction bond for the project and /or a resident
inspector on the site during any construction activity.
This will adequately safeguard the hillside and ensure
approval plans are followed.
Traffic added to adjacent streets can be absorbed without
creating problems or undue delays. At least the traffic
projection numbers so indicate. However, adjacent residents
can reasonably be expected to notice the additional traffic.
Previous proposals are reflected in the current application to
a great extent. That the Council approved 76 units in 1981,
prior to adopting the current Zoning Code, does not prejudice
current 103 unit proposal via the new planned residential
development (PRD) procedure. The proposal has far less
density than the PRD will allow by at least 20 and a
significant increase in recreation space and facilities occurred.

Council Member Harris said the Transportation Committee is
recommending that 56th Place be broughtforward to the 1986
Residential Street Program.
Council President Bauch called the Regular Meeting back to
order with Council Members present as previously reported.

Council Member Phelps asked for research on conditions or
special comments that came out of the previous waiver process.

FIVE MINUTES TO ALLOW TIME TO RESEARCH THE PREVIOUS CONDITIONS.

Mr. Rick Ryerson, 13939 SE 47th Street, Bellevue, said he is
developer /owner. They are planning to have all of the work
completed within 12 months. He wanted to do all of the
excavating of the site to begin with and build the lower units
first through the winter. With time getting so short, they
may wait until spring. To not do all of the site work at
once would be a lot of extra expense.

FINDINGS, CONCLUSIONS NO. 2 AND 3 AND THE RECOMMENDATIONS OF
THE PLANNING COMMISSION IN THE STAFF REPORT OF AUGUST 22, 1985
AND THE LETTER FROM RICK UELER DATED AUGUST 23, 1985.

SO THAT THE DEVELOPER WOULD PARTICIPATE IN AN L.I.D. WHEN THE
STREET IS UPGRADED.
Attorney Haney suggested that the ownerssign an agreement that
they will not protest the formation of an L.I.D.

Attorney Haney said that a PRD is a rezone of property because
it imposes use restrictions on a particular piece of property,
because of this, he recommended that Council pass an ordinance
approving the PRD.

AN ORDINANCE FOR APPROVAL OF THE PLANNED RESIDENTIAL DEVELOPMENT
TO BE PRESENTED AT THE NEXT COUNCIL MEETING AT THE COUNCIL
PRESIDENT'S DISCRETION. MOTION CARRIED.
MOVED BY PHELPS, SECONDED BY BOHRER, THAT ADMINISTRATION TAKE
A LOOK AT THE INTERURBAN AVENUE ACCESS AND THE 56TH AVENUE
SOUTH ACCESS, THE DECELERATION LANES WE HAVE DISCUSSED
AND INCLUDE A BRIEF REPORT WHEN THIS COMES BACK TO COUNCIL.
Council Member Phelps said that the site plan shows the right
angle turns off of Interurban and the distance from the proposed
signal. She would like to be sure these are covered. Councilman
Bohrer wants to be sure 56th Avenue is included.

Don Morrison noted that realistically the Preliminary Engineering
and Planning Funds for the 56th Street Project will be in the
1986 budget. The construction is proposed for 1988. Council
Member Harris said that the Transportation Committee recommended
moving the planning for the 56th Avenue Street Project to 1985
and the construction to 1986. It was decided that each
committee will review the amendments and be sure they reflect
the intent of the committee.

Council President Bauch said he asked to have the Vouchers
removed from approval because vouchers continue to come through
between $100 and $500 for Capital Equipment under Object 31 and,
submittal of these for payment without committee approval is in
violation of the Code. He will not sign the vouchers. Don
Morris has offered to review the vouchers under question.
MOVED BY HARRIS, SECONDED BY BOHRER, THAT THE VOUCHERS UNDER
QUESTION BE WITHDRAWN AND THE REMAINING ONES BE APPROVED.

The withdrawn vouchers are for 8 chairs, 2 vacuum cleaners and
a drill motor.
Councilman Duffie asked if the flagpole could be installed by
Veteran's Day. This will be checked into.

NO 85 -10 IN THE AMOUNT OF $1,500 TO PROVIDE FUNDS TO INSTALL A
30 -FOOT ALUMINUM FLAGPOLE BE APPROVED. MOTION CARRIED.

Attorney Haney read by title only a resolution of the City Council
of the City of Tukwila, Washington, declaring the intent of the
City to annex an unincorporated island of territory located
wholly within the City in an area formed by the intersections
of Southcenter Boulevard, Interurban Avenue and Interstate 405,
describing the boundaries of the area to be annexed, stating
the number of voters residing therein as nearly as may be,
fixing the date for a public hearing on said annexation and
directing the City Clerk to give notice of such hearing.

166th annexation, City File No. 85 -28 -A, pursuant to the direct
petition method set forth in RCW Chap. 35A.14; requiring said
property to be assessed and taxed at the same rate and upon the
same basis as other property within the City; requiring said
property to be subject to the Comprehensive Plan; directing
the City Clerk to file a certified copy of this ordinance with
the County Council; and fixing the effective date of the
annexation.
