Mayor Van Dusen requested that Council meet in Executive
Session to consider the Windmark lawsuit. The session should
last about 30 minutes.
Mayor Van Dusen read a letter from a Special Agent of the FBI
in appreciation for the outstanding assistance given them by
members of the Tukwila Police Department.

Mayor Van Dusen called the Regular Meeting of the Tukwila City
Council to order and led the audience in the Pledge of
Allegiance.

Judith Pierce of King County Emergency Medical Services spoke
on the Medic I levy. This is a county -wide levy to be voted on
November 5. The levy rate has been set at 25 cents per $1,000
in valuation. All of the funds being collected are put back in
the EMS Fund and are used for services.

Attorney Haney read by title only a resolution relating to

and taxed at the same rate and upon the same basis as other
property within the City, directing the City Clerk to publish
notice of the ordinance and establishing an effective date.

Council President Bauch said there are some items in the
Capital Improvement Plan that have not had adequate discussion
at the Council level so he will vote against the Resolution.
Don Morrison, City Administrator, read the thirteen changes
that have been incorporated in the Capital Improvement Plan.
It was noted that the items read by Mr. Morrison are included
in the motion. Council Member Phelps asked for amended pages
to the C.I.P.

amending the official street map of the City and establishing

Formal Motion is to deny the request for the vacation of
South 151st Street east of 52nd Avenue South.
Mr. Ralph Hatton, 3935 South 113th, Seattle, said last
week he asked for this street vacation request to be denied
because he owns parts of Lots One and Two. He did not want
this property land locked. Inthe past week he and Mr. Blume
reached an agreement for TSD Building Associates to purchase
his property. The new owners will own all of the property
along the south side of South 151st Street and there should
be no problem in vacating this street.
Mr. Bruce Blume, President of Bruce Blume and Company, the
developer and co -owner of the TSD Building said they have
been able to clarify the concerns of the neighbors. The
Rochons support this action and have signed the petition
for vacation. The problems with access have been resolved.
The location of the loading zone will be safer off South
151st. The Planning Department recommended that they apply
for the street vacation as the most logical solution to the
design problems. The street will be paved and curbed.
Mr. Zen McManigal, architect for the project, said that they
planned an 8,000 square foot building on the site and the
easiest way to do this, and save the ravine and the mature
trees, was to hug the building on the south end of the
property and put the parking area on the north end. The
north end was the only area that required fill. The logical
thing was to use South 151st as a driveway to the building.
It would be improved to a 22 -foot roadway.
Mr. Joe Sacotte, contractor on the site, said technically
it is a very difficult site to build on. They have had
problems fitting a building, parking area and access to the
property on the site. The primary reason for the street
vacation is to solve some of the complexities of the site;
one being the loading zone access that the City required.
This was added to the south end of the property. By vacating
the street they can provide a better loading zone and
give more continuity to the site. It also provides better
access for the Rochon property. They feel that the interests
of all the adjoining property owners will be best served by
the approval of this vacation.

Mr. Timothy Thomas said he is president of Transport
Storage who is a future tenant of the building and is also
a co -owner of the building. They have been long -time
residents of Tukwila and have decided to stay here but have a
need to expand their business. They are a good member of
the community. They are not trying to do anything to harm
the people of Tukwila. Favorable consideration on this
matter will be appreciated.

Mayor Van Dusen called the Regular Meeting of the Tukwila
City Council back to order with Council Members present as
previously listed.
Visit to disaster area. Fire Fighter Marty Grisham gave a slide presentation
on his trip to Mexico City. He was included with a medical
team sponsored by the Salvation Army to go to Mexico City
to help the victims of the recent earthquake disaster.
He explained his involvement in serving the people in the
clinic where they were assigned. He thanked the City for
their support in allowing him the time off from work to
participate in this tremendous experience.

Councilman Bohrer asked what the City's contribution to the
trip to Mexico was? He was told it was $140 plus the paid
leave of absence which was treated as training experience.
The rest was donated by other agencies.
Councilman Bohrer questioned that the use was a proper expendi-
ture of City funds. There is no budgeted account that
adequately covers this expenditure and it was not a legal action
by the City or the administration. It may have been an admirable
thing to do, but it was a misuse of City funds and City resources
to participate in it officially.
Council Member Phelps said the probability of an earthquake
of this size happening in the northwest is quite high. The
experience Marty had is valuable and he should have the
opportunity to talk with the police officers and fire fighters
as to what is an appropriate long -term response to this sort
of disaster because of the likelihood of it happening here.
We need to be better prepared.
Councilman Bohrer covered one additional point. Council
opinions were solicited individually. In order for there to
be a valid commitment of City funds, there should have been a
Special Meeting called. It involved an expenditure of City
funds which was not budgeted and for a purpose which was not a
province of the City Council.

The Executive Session was called to discuss the Windmark Homes
lawsuit.
