M I N U T E S
Mayor Van Dusen called the Regular Meeting of the Tukwila
City Council to order and led the audience in the Pledge of
Allegiance.

MOVED BY MORGAN, SECONDED BY DUFFIE, THAT COUNCIL MEMBER

Mayor Van Dusen is asking the City Council to concur with his
reappointments of Dick Goe to Position #5 on the Board of
Adjustment and Dwayne "Skip" Traynor to Position #1 on the
Civil Service Commission.
MOVED BY HARRIS, SECONDED BY DUFFIE, THAT COUNCIL APPROVE THE
APPOINTMENT OF BOTH DICK GOE TO THE BOARD OF ADJUSTMENT AND
DWAYNE TRAYNOR TO THE CIVIL SERVICE COMMISSION. MOTION
CARRIED.
Mayor Van Dusen read a Proclamation designating the week of
December 15 through 21 as "National Drunk and Drugged Driving
Awareness Week."
Council President Bauch notified Council that, pending any
emergencies, there would be no more Committee of the Whole
Meetings until after the first of the year.
Council Member Phelps congratulated Don Williams, Parks and
Recreation Director, for completing as many of the projects
and goals that he had listed for 1985 that he did. The work
program established at the beginning of the year is
completed.
Councilman Duffie commented that the banquet was outstanding;
everyone enjoyed it. The Renton Police stood by for the
Tukwila on -duty officers so they could attend the party and
the City was still being protected. It is good to have this
kind of communication with other cities. Mayor Van Dusen
commented that the members of the Boards and Commissions will
be invited next year.

Collin Bridge, P.O. Box 16, 2318, Seattle, said he is, what
is thought of as, a peddler or vendor. He explained that the
City's zoning ordinance prevents him from working. He asked
if anything could be done. Sales outside are denied and this
denies him the right to work.
Brad Collins, Planning Director, explained that Mr. Bridge
was trying to sell sheepskins on the lot next to the mini
mart. He was informed that the property is zoned for
Professional Office which doesn't allow retail sales and that
he would need to get a business license. He had obtained a
business license to sell in Southcenter Mall, but for some
reason, he is not selling at the Mall.

Councilman Duffie said he was notified about this salesman.
The City does not have on- the street selling, and he is
against both street sales and house to house sales. We do
not want this type of business in our neighborhood. We have
had problems caused by door to door salesmen. Our City is a
beautiful City and we want to keep it that way. If a person
wants to sell, he should obtain a business license, and do it
right. I am against selling on the street corners.
Mr. Bridge said he is just trying to make a living.
Council Member Harris noted that the ordinance allows local
grown produce to be sold at a stand and that is all. Not
only is he in violation of the zoning code, but also the
ordinances regulating sales.
Mr. Bridge said he realizes he was in violation of the codes,
but he thinks it is wrong, wrong to deny him the right to
work. He asked Council if they would make a temporary waiver
from now until Christmas. He said he is willing to contest
this in court.
Mayor Van Dusen said Council is not in a position to make a
temporary waiver. He suggested Mr. Bridge put his concerns
in writing and thanked him for coming.

Council Member Morgan commented that it was a thoughtful job
of preparing the budget. Council has, for the most part,
agreed with the Administration's proposals.

City Attorney Haney read a resolution of the City Council of
the City of Tukwila, Washington, amending the non -union posi-
tion list established by resolution No. 960 of the City and
establishing a salary and wage schedule for non -union
employees to be effective January 1, 1986.

City Attorney Haney read an ordinance of the City of Tukwila,

Green River Interchange Annexation which was annexed to the
City pursuant to said ordinance.

City Attorney Haney read a resolution of the City of Tukwila,
Washington, thanking Mario A. Segale of Segale Business Park
and the children from the Tukwila Elementary school for
decorating City Hall for the Holidays.

Councilman Duffie reported that he received a call about
this. It comes out of the Community Affairs Committee and he
questioned if a Public Hearing was held so that the citizens
would have a chance to voice their opinions. The citizen
that called does not approve of the policy. Mr Duffie recom-
mended that the proposed resolution be referred back to the
Committee. When this comes before the Committee, Mr. Bohrer
should be notified so he can attend the meeting.

AMENDED TO REFER THIS ITEM BACK TO THE COMMUNITY AFFAIRS
COMMITTEE.*
Council Member Harris said she also received phone calls.
When there are feelings against this, we need to give the
people of the City a chance to speak.
Council President Bauch read from the policies of the City.
This resolution says exactly the same thing.
Council Member Phelps said this was of particular interest to
the Parks and Recreation Committee because the City had
experienced a little difficulty dealing with the Kaiser
Development. The policies need to be stated more distinctly
than they are right now. This resolution is merely a state-
ment of what Council intends to do to move forward to imple-
ment what the City has now in the Park and Open Space Plan.

Council Member Morgan commented she is in favor of a trail
system in the City but the policy language needs to be as
clear as possible.
Council President Bauch asked to have his "NO" vote recorded
in the minutes on the passing of the ordinance on raising the
property tax.
MOVED BY MORGAN, SECONDED BY DUFFIE, THAT THE MINUTES BE
APPROVED AS CORRECTED. MOTION CARRIED.
Council Member Morgan commented that she was very pleased
with Mr. Gibbs' (Fire Marshall) presentation after the fire
at ParGas. The news commentator said, for the quick response
of our Fire Department, damage was kept to a minimum. This
shows clearly that we are able to look after the people in
the north end of the City. She asked that Administration let
Council know when our Departments are doing something of a
public nature.
Council President Bauch said Council is holding the Executive
Session on a Personnel Matter (about 15 minutes).
Councilman Bohrer arrived to join Council in the Executive
Session.
Council adjourned the Executive Session to go back into the
Regular Meeting.
Mayor Van Dusen reported that the Municipal Court Judge will
not be reappointed to another term. Applications are being
accepted from local attorneys to fill the position.

When Don Pierce, Police Chief, was hired, one of the condi-
tions was that he be allowed time off to go to the FBI
Academy. During his 11 week absence, the command position
will be split between the two Assistant Chiefs.
Council President Bauch informed Councilman Bohrer that the
resolution establishing a policy for developing recreation
trails was referred back to the Community Affairs Committee.
Councilman Bohrer said the policy on river access is in the
Comprehensive Plan. It has come forward because of a need to
strenghthen it. The river is a real amenity to the City and
should be preserved. He will meet with the Committee and
discuss this further.
MOVED BY BAUCH, SECONDED BY DUFFIE, THAT A PUBLIC HEARING BE
HELD AT THE SECOND REGULAR MEETING IN JANUARY ON THE POLICY
FOR DEVELOPING RECREATION TRAILS ALONG THE GREEN RIVER.*
Councilman Bohrer requested that Council notify a wide
variety of the groups that would be interested in this
subject.

It was suggested that the Public Hearing notice be posted
along the trail.

VERBATIM Tukwila City Council Regular Meeting December 16, 1985
SUBJECT: Peddler's License (CITIZEN'S COMMENTS)
My name is Collin Bridge and I am what is usually thought of as a peddler or vendor.
Mayor: Would you give your address?
Bridge: It is Box 16, 2318, Seattle, and I don't know the zip code.
Mayor: Go ahead.
Bridge: You have a zoning ordinance in town that prevents me from working and I want
to see if there is anything that can be done.
Mayor: I guess for the benefit of the Table you are going to have to explain a little more.
Bridge: Okay, outside sales are denied across the board and that in fact denies me the
right to work.
Mayor: Have you been involved with the staff? Are you aware, Brad, what let
Brad explain the situation.
Brad Collins, Planning Director: The gentleman has been trying to sell some sheepskins
at the corner next to the A/P Mini -Mart on the vacant lot that is there. He was
informed that that property is zoned for professional office which does not allow sales
on that property, and that he would need to get a business license.for the location
he was going to be selling his sheepskins. He had obtained a business license I believe
to sell the sheepskins at Southcenter Mall in the Mall where he would be inside the
facility, parking is provided through Southcenter and for some reason he is not selling
his sheepskins at the Mall, but rather on the site where the North Hill Office
Complex is proposed which is immediately to the east of the AM /PM Mini Mart on Southcenter
Blvd. The gentleman was informed that at that location he could not do a retail
activity. He did contact my staff and I talked to him myself, I believe, and indicated
to him that the problems he had with trying to sell his sheepskins at that location.
He would also, I believe, be in violation of the sign ordinance.and he really did not
have the proper permits to do business at that location and he was so informed. He
indicated that he wanted to come and address the Council. We informed him that the
Council met on Monday nights and that there was an opportunity for him to bring his
concerns to the Council. That is why he is here.
Mayor: Does the Council have any questions?
Councilman Duffie: Question.
Mayor: Mr. Duffie.
Duffie: I have been informed of what is going on with this gentleman. I was called
when he first appeared on the site. I was called in fact about three times while he
was on the site. I noticed him once when I was driving and I was the one who came down
here and addressed the officer about the problem we had there because we do not have
on- the street selling and I am one who is against on- the street selling. I am also
against house -to -house selling. I don't think that this City, as far as I am concerned,
our neighborhood, we do not want that type of business in our neighborhood. I feel that
when a person comes home from work he is entitled to his own privacy and I feel if
he is too lazy to go down town to shop, he should send his wife, but I do not believe
anyone should be coming to homes with door -to -door selling. I am strictly against that.
I was a Boy Scoutmaster for numbers of years and I do not believe in door -to -door sales-
men. We have had our problems by going door -to -door selling. I have been in places
where a lot of burglaries occur when you allow those activities. Our City is a beautiful

Duffie (contd.) City and I would like to keep it that way. I do not believe that we
should have on -the- street site selling. I think if a person wants to sell I do
believe he should obtain a business and do it right. But for selling on the street
corners, I am against that. I do not wish to see Tukwila become another Aurora.
This City is too beautiful and we have, I mean, the standard here is too great for
it to broken down for those kinds of facilities. I am one who is against on -the
street selling. I think if you want to sell then you should obtain your license
and go to Southcenter where your permit will allow you to sell.
Bridge: Yeah, where I was today was the place where I got the permit for, and I
was still kicked out, but it was outside. I did not know you couldn't be outside.
I am just trying to make a living here and I realize that some people say it is
not nice to look at that may be. But I don't see anything wrong with it.
Councilperson Harris: I believe our ordinance allows a farmer who grows produce
to sell his produce outside on the stand, I believe it even allows something like
if they grow their own chickens to sell, something like that, but that is the
extent that our ordinance allows in outdoor sales, So not only is the zoning
wrong but it is also in violation of the ordinance concerning sales.
Bridge: I realize that now. I just think it is wrong to deny me the right to work.
Harris: No, we are not denying you the right to work, you just have to work in the
right place,
Bridge: Right, but that is saying I have to rent a store and if I cannot afford to
rent a store then you are, in fact, saying you cannot work here.
Mayor: Anyone else want to comment?
Bridge: Well, I think, you know like the man said, there have been burglaries or
something with people going door -to -door, I figure that should be taken on a case
by case basis as opposed to making a class statement or action. I feel the police
are qualified to separate right from wrong, in that respect.
Harris: This is our City, we make the laws to try and protect the safety and welfare
of the citizens, if we have set up laws for our City they may not always be what other
people would like but this is what we have used to set up this law and we have to
abide by the laws of the City so I guess we are going to have to ask you to abide by
them also.
Bridge: I just wondered if you might make any sort of temporary waiver now, until
Christmas. I am willing to contest this in court but what I cannot have happen
is what the police threatened to do is bodily carry me away in handcuffs and impound
my vehicle,
Mayor: I don't believe the Council is in a position to make a temporary waiver. It
would not get passed by the time Christmas well, maybe it could, but it would be
close,
Bauch: Our ordinance does not provide for a waiver on zoning.
Mayor: To change it would take some publication time and w ?H a to override a veto.
If you would like to address the Council further on this I believe the best route
would probably be in writing.
Bridge: I really don't know what else to say.
Mayor: I think they appreciate you coming forward. I know it took some time out of
your day to come forward. I don't know if the Council wants to proceed further at this
point.

Harris: There is nothing further we can do at this point.
Mayor: Okay. Unless you have something further to say I believe...
Bridge: I appreciate it.
Mayor: Okay, thank you very much.
