Resolution No. 1255 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
TUKWILA, WASHINGTON, TO AUTHORIZE PROCEEDING
WITH THE DIRECT PETITION ANNEXATION OF CERTAIN
PROPERTIES AND INITIALLY ESTABLISHING ANNEX-
ATION PROVISIONS.
WHEREAS, the owners of certain properties (as described in Exhibit A) have submitted
notice of their intention to commence annexation proceedings to the City of Tukwila (Exhibit
A), and
WHEREAS, this notice has been submitted pursuant to RCW 35A.14.120 and is on file
with the Tukwila City Clerk, and
WHEREAS, the City Clerk has certified that said owners represent not less than 10 of
the value of property in a potential annexation area (Exhibit B), and
WHEREAS, the City Council is required to meet with the property owners giving notice,
to initially establish annexation provisions pursuant to RCW 35A.14.120, and
WHEREAS, initial conditions are subject to later modification by the Council after
detailed review, but must be finalized prior to circulation of an annexation petition to all
property owners, and
WHEREAS, City staff has reviewed their initial findings with the City Council;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA,
WASHINGTON, HEREBY RESOLVES AS FOLLOWS:
Section 1. Annroval to Proceed. The City Council hereby approves staff proceeding with
the Direct Petition annexation process pursuant to RCW 35A.14.120.
Section 2. Initial Annexation Provisions Established. The City Council hereby
establishes the following initial annexation provisions, subject to later review:
A. The annexation area boundary shall be as described in Exhibit C,
B. Assumption of bonded indebtedness shall not be required, and
C. Simultaneous annexation zoning shall be established.
PASSED BY THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, at a
regular meeting thereof this day of 1993.

Dear Mayor Rants and Council President Ekberg:
As has been previously discussed with representatives of the City
of Tukwila, please accept this letter as notice of our intent to
begin annexation proceedings relating to what is commonly known
as the Oxbow area. This area abuts the City of Tukwila and is
located generally to the west of East Marginal Way at
approximately the Boeing access road, and to the east of West
Marginal Place South.
In conjunction with other property owners in this Oxbow Area,
whom we understand will also be submitting requests similar to
this one, we would like to consider circulating a petition for
annexation of this property by the City of Tukwila. Please set a
hearing within 60 days after receipt of this notice so that we
may determine the specifics of the annexation petition.

CERTIFICATION
The undersigned, for and on behalf of the City of Tukwila, certifies that
owners of certain properties have given notice of their intention to
commence annexation proceedings to the City of Tukwila. These owners
represent not less than 10% of the assessed value of property in the
proposed annexation area generally known as the Oxbow Area, lying
between West Marginal Way and the Duwamish Waterway (legal
description attached).

LEGAL DESCRIPTION
for
OXBOW AREA
BETWEEN WEST MARGINAL WAY AND THE DUWAMISH WATERWAY
BEGINNING at the intersection of the south line of the John
Buckley Donation Land Claim number 45 and the westerly
right -of -way line for Primary State Highway No.1 (S.R.99) as
shown under Deeds, volume 4099, page 666, Records of King County,
Washington, in the northwest quarter of Section 4, Township 23
North, Range 4 East, W.M.;
Thence northerly along said westerly margin to the north line of
tract 55 in Moore's Five Acre Tracts as recorded under volume 9,
page 28 under Plats, records of King County, Washington;
Thence easterly along said north line of tract 55 and continuing
along the easterly extension thereof to the thread of the
Duwamish Waterway and the existing Tukwila City Limit Line
(Tukwila Ordinance 1503 and 1515);
Thence southerly along the thread of the said Duwamish Waterway
and River also being the existing Tukwila City Limit Line to the
west margin of Pacific Highway South (State Rd. No. 1);
