AN ORDINANCE RELATING TO CRIMINAL TRESPASS AND
AMENDING ORDINANCE NO. 977 AND T.M.C. 8.04.530.
THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTO DO
ORDAIN AS FOLLOWS:
Paragraph (3) of Ordinance No. 977 and Subsection (c)
of T.M.C. 8.04.530 are amended to read as follows:
In any prosecution under this section it is an
affirmative defense that the actor reasonably
believes that: (1) the premises involved at
the time were open to members of the public and
the actor complied with all lawful conditions
imposed on access to or remaining in the premises;
or, (2) the owner of the premises or other person
with power to license access thereto, would have
licensed him to enter or remain.
