HomeMy WebLinkAboutOrd 1078 - Sale and Consumption of Alcohol in Public Places (Repealed by Ord 1113) REPEALED BY 1113 ORDINANCE NO. 1078 AN ORDINANCE OF THE CITY OF TUKWILA, WASHINGTON, RELATING TO THE SALE AND CONSUMPTION OF ALCOHOLIC BEVERAGES IN PUBLIC PLACES. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, DOES ORDAIN AS FOLLOWS: Section 1. That Section 8.04.520 of the Tukwila Municipal Code be amended as follows: 8.04.520 Alcoholic Beverage Consumption or sale in public places is unlawful. Itshall be unlawful for any person to open a package containing alcoholic beverages, or to sell or consume alcoholic beverages on public school grounds. Sale and /or consumption of alcoholic beverages in municipal buildings is permitted as allowed by Administrative Policy and concurred with by the City Council. Every person who violates any provision of this section shall be guilty of a misdemeanor and on conviction thereof shall be fined not more than one hundred dollars. Section 2. Section 1 of Ordinance 945 and Ordinances No. 1015 and 1021 are hereby repealed. STATEMENT OF POLICY: 1. The control of alcoholic beverages at the Foster Municipal Golf Course will be established under Administration Policy Procedure No. 01 -20. Control of alcoholic beverages in other City buildings will be established in accordance with RCW 66.20.010(3). 2. Alcoholic beverages shall not be transported or consumed in any motor vehicle owned or operated by the City. This section does not apply to police vehicles which are transporting alcoholic beverages being held as evidence in the investigation or prosecution of a crime. 3. Alcoholic beverages shall not be stored or consumed in or on any municipal facility, except as provided in Paragraph 1 above, at any time, by any person except during a social event. This social event shall be approved in writing in advance by the Mayor. 4. Employees of the City of Tukwila shall not consume alcoholic beverages during scheduled working hours except as provided in Paragraph 3 above. The consumption of alcoholic beverages during off premise lunch hours is at the discretion of the employee. This does not apply to on -duty police or fire personnel. The employee is to use judgment in this matter to insure that such consumption will not adversely affect work performance or create an unsafe working condition. Intoxication during working hours will not be tolerated under any circumstances. STATEMENT OF POLICY: 1. The control of alcoholic beverages shall be in accordance with the rules and regulations of the State Liquor Board for a Class D License. 2. The procedure will be revised to incorporate the rules and regulations of the golf course by October 15, 1978.
