PERMIT CONDITIONS: 1: ***BUILDING PERMIT CONDITIONS*** 2: All permits, inspection record card and approved construction documents shall be kept at the site of work and shall be open to inspection by the Building Inspector until final inspection approval is granted. 3: Remove all demolition rubble and loose miscellaneous material from lot or parcel of ground, properly cap the sanitary sewer connections, and properly fill or otherwise protect all basements, cellars, septic tanks, wells, and other excavations. Final inspection approval will be determined by the building inspector based on satisfactory completion of this requirement. 4: All plumbing and gas piping work shall be inspected and approved under a separate permit issued by the City of Tukwila Building Department (206-431-3670). 5: All electrical work shall be inspected and approved under a separate permit issued by the City of Tukwila Permit Center. 6: VALIDITY OF PERMIT: The issuance or granting of a permit shall not be construed to be a permit for, or an approval of, any violation of any of the provisions of the building code or of any other ordinances of the City of Tukwila. Permits presuming to give authority to violate or cancel the provisions of the code or other ordinances of the City of Tukwila shall not be valid. Traffic Control Plans shall be submitted to the Inspector for prior approval. 15: Any material spilled onto any street shall be cleaned up immediately. 16: Temporary erosion control measures shall be implemented as the first order of business to prevent sedimentation off-site or into existing drainage facilities. 17: The site shall have permanent erosion control measures in place as soon as possible after final grading has been completed and prior to the Final Inspection. 18: From October 1 through April 30, cover any slopes and stockpiles that are 3H:1V or steeper and have a vertical rise of 10 feet or more and will be unworked for greater than 12 hours. During this time period, cover or mulch other disturbed areas, if they will be unworked more than 2 days. Covered material must be stockpiled on site at the beginning of this period. Inspect and maintain this stabilization weekly and immediately before, during and following storms. 19: From May 1 through September 30, inspect'and maintain temporary erosion prevention and sediment at least monthly. All disturbed areas of the site shall be permanently stabilized prior to final construction approval. Background Proposed City of Tukwila Justice Center On November 6, 2017 the Tukwila City Council adopted Ordinance No.2554, which identified nine parcels in the Tukwila International Blvd neighborhood as the preferred location for the City's new Justice Center and authorized the use of the City's eminent domain authority. The Justice Center will house the City's Police Department, Municipal Court, and Emergency Operation Center. The Justice Center building will be approximately 46,000 square feet and thus is subject to review under SEPA. There are seven separate owners of the nine parcels identified in Ordinance No. 2554. In the fall of 2017 the City sent out purchase and sale agreements to the various property owners. The property owner of JC -9, Lui Luey Ming, accepted the City's purchase and sale agreement and the City took title on April 27, 2018. The City is still in the process of acquiring the remaining parcels for the Justice Center. These properties will be acquired on a rolling basis as either 1) the City reaches agreements with the property owners or 2) the property is acquired by order of King County Superior Court through the City's eminent domain proceedings. The eminent domain proceedings could take anywhere between six months and two years (depending on any legal challenges). Since the City does not have ownership of all the Justice Center parcels and because possession and use of each individual parcel could be spread out over time, the City is unable to start the formal SEPA process for the Justice Center. The building is vacant. Previous tenants on the building included a restaurant and driving school. Of the buildings being acquired as part of the Justice Center location, this is the only building that does not have tenants and is vacant. Both the City's Police Department and Code Enforcement have incidents, calls for service, and actions related to the property. Small fires have been set in the rear of the building. Despite signs saying "No Trespassing" individuals keep going on the property and though the building has been secured, there is evidence of squatters' use of the building, including considerable human waste and trash. Further, the layout of the building on the property allows individuals to be on the property without being seen from passersbys on TIB or the City's cameras on TIB. Various national research links abandoned buildings with criminal activity and other activities which represent a threat to public safety. Jon Shane, with the "Center for Problem -Oriented Policing'" states several issues with abandoned buildings, many of which are currently associated with this structure: 1. Abandoned vehicles being left on the premise; 2. Risk of Arson; 3. Drug Dealing 4. Graffiti 5. Illegal occupation of the building or premise (encampments) 6. Illegal Dumping; 7. Prostitution and other illicit public sexual activity; 8. Noise; 9. Break In of structures to look for items of savage value; 10. Trespassing; and 11. Public urination and defecation. Based upon the risks identified above, it is the opinion of the Mayor's Office and Chief of Police that the building on JC -9 poses an imminent and continued threat to public safety and the public welfare and thus should be demolished as soon as possible. Justice Center SEPA Process The development of the Justice Center is subject to SEPA and once the City has possession and use of the remaining properties and/or agreements with the property owners it will initiate the formal SEPA process. As the City acquires the remaining properties, it is the City's intent to allow existing businesses to continue to operate until March 31, 2019, thus there should not be other vacant buildings associated with this project.
