PERMIT CONDITIONS: 1: ***BUILDING PERMIT CONDITIONS*** 2: Work shall be installed in accordance with the approved construction documents, and any changes made during construction that are not in accordance with the approved construction documents shall be resubmitted for approval. 3: All permits, inspection record card and approved construction documents shall be kept at the site of work and shall be open to inspection by the Building Inspector until final inspection approval is granted. 4: The special inspections and verifications for concrete construction shall be as required by IBC Chapter 17, Table 1705.3. 5: The special inspections for steel elements of buildings and structures shall be required. This procedure is in addition to any requirements for special inspection. 11: Remove all demolition rubble and loose miscellaneous material from lot or parcel of ground, properly cap the sanitary sewer connections, and properly fill or otherwise protect all basements, cellars, septic tanks, wells, and other excavations. Final inspection approval will be determined by the building inspector based on satisfactory completion of this requirement. 12: Preparation before concrete placement: Water shall be removed from place of deposit before concrete is placed unless a tremie is to be used or unless otherwise permitted by the building official. All debris and ice shall be removed from spaces to be occupied by concrete. 13: VALIDITY OF PERMIT: The issuance or granting of a permit shall not be construed to be a permit for, or an approval of, any violation of any of the provisions of the building code or of any other ordinances of the City of Tukwila. Permits presuming to give authority to violate or cancel the provisions of the code or other ordinances of the City of Tukwila shall not be valid. The issuance of a permit based on construction documents and other data shall not prevent the Building Official from requiring the correction of errors in the construction documents and other data. 14: ***PUBLIC WORKS PERMIT CONDITIONS*** 15: The applicant or contractor must notify the Public Works Inspector at (206) 433-0179 upon commencement and completion of work at least 24 hours in advance. All inspection requests for utility work must also be made 24 hours in advance. 16: Prior to construction, all utilities in the vicinity shall be field located. NOTE: For City of Tukwila utility locates, call 811 or 1-800-424-5555. 17: Permit (work not within the S. 180th Street right-of-way) is valid between the weekday hours of 7:00 a.m. and 10:00 p.m. only. Coordinate with the Public Works Inspector for any work after 5:00 p.m. and weekends. 18: Work affecting traffic flows shall be closely coordinated with the Public Works Inspector. Dear Ms. Anderson: Thank you for your June 11th, 2018 letter requesting an exemption from both SEPA and a shoreline substantial development permit to repair and extend a retaining wall section along south 180th street levee, located on King County Parcel # 3623049079 within a "Flood Protection Levee Easement." Work is being conducted to restore proper functions of the levee and to prevent potential flooding at this location in the result of a flooding event. The project is described in more detail below. The purpose of this project is to extend the retaining wall at the 35.5' elevation to the bridge abutment and construct a return wall parallel to the bridge. This wall extension will assist to restore proper function of the levee and prevent potential flooding at this location in the result of a flooding event. Background The existing retaining wall on the south side of the South 180th Street bridge tapers from an elevation of 35.5' to 31.9' as it tapers under the existing bridge along the pile cap. The gap leaves a vulnerable hole in the levee that could potentially flood the nearby parcels in a flooding event. Proposed Project 1. Retaining Wall work and Bank Excavation: The retaining wall work shall be done on the upland side (west) side of the Green River Trail, and there shall be no bank excavation. The existing projects limits is out of the ordinary highwater mark (OHWM), and the Retaining Wall is the boundary for the FEMA 100 -yr flood event. Clearing and excavation will be required to expose the existing retaining wall footing at an approximate elevation of 24.5'. All excavation will be done within the existing planter strip between the Green River Trail and private parcel. This grading areas is approximately 230 square feet. The excavation will remove approximately 33 cy of existing planter and base material. After the footing and extension wall are formed and poured with concrete, approximately 30 cy of gravel backfill for walls will be replaced behind the retaining wall and on the new footing. At no point will excavation occur on the Green River Trail or river bank. 2. Erosion Control and Better Management Practices The following items will contribute, but are not limited to the erosion control, spill control and better management practices that will be applied to mitigate any adverse impacts the surrounding area and nearby Green River during construction: • Temporary Erosion Control will be installed at the downgradient edge of the disturbed area as required to prevent sediment transport. This may include silt fence, wattles and other geotextiles. • Excavation work will be complete in the dry months. • Secondary containment and spill kits will be on-site when heavy equipment is present and during concrete pours • Excavated materials will be disposed of at an approved upland location approved by the City of Tukwila • The source and nature of all fill material will be imported from a WSDOT certified pit source. No material at this site will be placed in the waterbody. Discussion WAC 197-11-800 (3) states that the following activities shall be categorically exempt from SEPA regulations: "The repair, remodeling, maintenance, or minor alteration of existing private or public structures, facilities or equipment, including utilities, recreation, and transportation facilities involving no material expansions or changes in use beyond that previously existing; except that, where undertaken wholly or in part on lands covered by water, only minor repair or replacement of structures may be exempt (examples include repair or replacement of piling, ramps, floats, or mooring buoys, or minor repair, alteration, or maintenance of docks). WAC 173-27-040 (2) (b) defines normal maintenance or repair as "...a means to restore a development to a state comparable to its original condition, including but not limited to its size, shape, configuration, location and external appearance...Replacement of a structure or development may be authorized as repair where such replacement is the common method of repair for the type of structure or development and the replacement structure or development is comparable to the original structure or development including but not limited to its size, shape, configuration, location and external appearance and the replacement does not cause substantial adverse effects to shoreline resources or environment." The proposed project is considered normal maintenance and repairs of an existing levee retaining wall, including comparable size, shape, configuration, location, and external appearance of the replacement Page 2 of 3 09/14/2018 A14-0008 2018 Small Drainage Program SEPA and Shoreline Exemption Request September 14th, 2018 portion of the wall. There will be no substantial adverse impacts to the shoreline resources or environment. Potential impacts are limited to short term water quality impacts (elevated turbidity, potential for spills) and habitat disturbance. These impacts will be temporary, localized, and minimal, and will be further minimized by adhering to project BMPs. No long term impacts are anticipated. SEPA Exemption A SEPA exemption has also requested for this project under WAC 197-11-800 (3), Repair, remodel and maintenance activities. This section of the WAC states that "...repair, remodeling, maintenance or minor alteration of existing private or public structures, facilities or equipment, including utilities involving no material expansions or changes in use beyond that previously existing; except that, where undertaken wholly or in part on lands covered by water, only minor repair or replacement of structures may be exempt..." is exempt from SEPA. . I have a few open ends that I could use your help with. 1. On 4/13/17 I sent you a pdf letter with the request for SEPA and Shoreline Exemption for the Bridge Site. The SEPA and Shoreline Exemption letter I drafted is attached. Please check if you ever coordinated this with Carol Lumb. There is a permit fee involved with the formal exemption submittal of $380.10. See attached email from Carol where she mentions exemption is likely for the S 180th Bridge site, but to get a formal determination of non -significance we had to submit a letter. If it is determined this exemption was never submitted and executed I can update the letter with this year's 2018 Program and date and we can resubmit. Let me know. 2. Do you know the status on the building permits for the S 180th Bridge and Gilliam Creek Outfall Site? Looking back at old emails, it appears Charlie Conway may have dropped them off at the Permitting office around 4/18/17. I haven't seen a copy of approved or reviewed permits. About the time KPG submitted the permits these two project locations were removed from the 2017 SDP Scope so I don't know how far the building permit review got. At this particular location the City is proposing to raise an existing retaining wall and connect to the S 180th St Bridge abutment on the south side of the bridge. The site addresses a freeboard deficiency that was identified in the recent Levee Certification analysis. The existing S 180th St Retaining Wall Levee is located adjacent to the Green River Trail within NW 1/4 Section 36, Township 23N, Range 4E at Latitude: 47.441 and Longitude: -122.246. The existing retaining wall is located on King County parcel 3623049079 within a "Flood Protection Levee Easement." On behalf of the City of Tukwila Public Works Department, KPG, Inc. is requesting Exemption from the Shoreline and SEPA Permit Process. The location of this project is outside the Green River Ordinary High Water and there will be no adverse impacts to a waterbody. The minor project excavation requirements are upland of the river bank, and environmental mitigation will take place during construction to prevent any adverse impacts to the surrounding area. Per the Shoreline Environment Designation the project location is within the "Urban Conservancy — Levee — 125' Buffer." Current Condition of S 180th St Retaining Wall The existing retaining wall on the south side of the bridge tapers from elevation 35.5' to 31.9' as it tapers under the existing bridge along the pile cap. This gap leaves a vulnerable hole in the levee that could potentially flood the nearby parcels in a flooding event. Project Description The purpose of this project is to extend the retaining wall at the 35.5' elevation to the bridge abutment and construct a return wall parallel to the bridge. This wall extension will assist to restore proper function of the levee and prevent potential flooding at this location in the result of a flooding event. The retaining wall work shall be done on the upland side (west) of the Green River Trail, and there shall be no bank excavation. The existing project limit is out of the ordinary high water (OHW), and the Retaining Wall is the boundary for the FEMA 100 -yr flood event. Clearing and excavation will be required to expose the existing retaining wall footing at approximately elevation 24.5'. All excavation will be done within the existing planter strip between the Green River Trail and private parcel. The excavation will be limited to the minimum grading limits shown on the Contract Plans. This grading area is approximately 230 sq ft. The excavation will remove approximately 33 cy of existing planter and base material. After the footing and extension wall are formed and poured with concrete, approximately 30 cy of gravel backfill for walls will be placed behind the retaining wall and on the new footing. At no point will excavation occur on the Green River Trail or river bank. Construction Methods The Contractor will use an access easement to haul in any heavy equipment to excavate the existing embankment soil to expose the retaining wall footing. Erosion Control and Better Management Practices These following items will contribute but are not limited to the erosion control, spill control, and better management practices that will be applied to mitigate any adverse impacts the surrounding area and nearby Green River during Construction: • Temporary Erosion Control will be installed at the downgradient edge of the disturbed area as required to prevent sediment transport. This may include silt fence, wattles, and other geotextiles. • Excavation work will be completed in the dry months. • Secondary containment and spill kits will be on-site when heavy equipment is present and during concrete pours. • Excavated material will be disposed of at an approved upland location approved by the City of Tukwila • The source and nature of all fill material will be imported from a WSDOT certified pit source. No material at this site will be placed into the waterbody. SEPA Exemption This retaining wall extension project falls under the Washington Administrative Code (WAC) 197-11-800(3) Repair, remodeling and maintenance activities, which stipulates SEPA exemption for "the repair, remodeling, maintenance, or minor alteration of existing private or public structures, facilities or equipment, including utilities, involving no material expansions or changes in use beyond that previously existing; except that, where undertaken wholly or in part on lands covered by water, only minor repair or replacement of structures may be exempt." This project proposes minor alteration of a public structure. The alteration will not change the use of the said structures, will improve the wall's operability, and will not impact the aquatic environment. As such, an exemption from SEPA review by the City of Tukwila is requested. Shoreline Exemption With the aforementioned project elements, we suggest that the described retaining wall extension project construction elements are exempt from substantial development permit requirements (Tukwila SMP 14.2B and WAC 173.27.040). The proposed retaining wall "shall be constructed no further waterward of the existing bulkhead than is necessary for construction of new footings" (WAC 173.27.040 (b)&(c)). The proposed project is a minor alteration of an existing retaining wall. There will be no substantial adverse impacts to the shoreline resources or environment.
