HomeMy WebLinkAboutOrd 1009 - Classification of NonCharter Code CityCITY OF TUKWILA WASHINGTON ORDINANCE NO. 1009 AN ORDINANCE OF THE CITY OF TUKWILA, WASHINGTON, ADOPTING FOR SAID CITY THE CLASSIFICATION OF NONCHARTER CODE CITY, WITHOUT REORGANIZATION, TO BE GOVERNED BY THE PROVISIONS OF CHAPTER 35A.12 OF THE REVISED CODE OF WASHINGTON UNDER THE MAYOR- COUNCIL PLAN OF GOVERNMENT FOR THE CITY OF TUKWILA. WHEREAS, the City Council of the City of Tukwila, by Resolution No. 553, passed on the 7th day of September, 1976, declared its resolution to adopt for the City of Tukwila the classification of noncharter code city, retaining the mayor council plan of government under which the City is presently operating, pursuant to Chapter 35A.02 of the Revised Code of Washington; and WHEREAS, said Resolution No. 553 was duly published in the time and manner provided by law and more than 90 days has expired from, but excluding, the date of first publication of said Resolution No. 553, and no referendum petition has been filed as prescribed by said Chapter of the Revised Code of Washington as determined by Section 35A.29.170 of the Revised Code of Washington; and WHEREAS, the City Council now desires to effectuate the intent expressed in said Resolution No. 553 by enacting an ordinance adopting for said City the classification of noncharter code city in the manner provided hereinafter, now, therefore, THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1: Adoption of Optional Municipal Code. There is hereby adopted for the City of Tukwila, Washington, the classification of Noncharter Code Ctiy, retaining the mayor council plan of government under which the City of Tukwila is presently operated, as provided in Chapter 35A.12 of the Revised Code of Washington, endowed with all the applicable rights, powers, privileges, duties, and obligations of a Noncharter Code City as the same now exists, or may be provided hereafter, including any and all supplements, amendments, or other modifications of said Title hereafter at any time enacted. Section 2: Effective Date. The City Clerk is hereby authorized and directed to forward to the Secretary of State a certified copy of this ordinance for filing pursuant to Section 35A.02.040, as amended, of the Revised Code Washington on the effective date of this ordinance and upon which filing the City of Tukwila shall thereafter be classified as a Noncharter Code City as herein provided. Section 3: City Council Positions. The City Council shall continue to hold office until their successors are elected and qualified at the next biennial municipal elections to be conducted as provided in Chapter 35A.29 of the Revised Code of Washington. Thereafter the requisite number of City Council positions shall be filled by election biennially as the terms of their predecessors expire and shall serve for terms of four years. The positions to be filled on the City Council shall be designated by consecutive numbers and shall be dealt with as separate offices for all election purposes as provided by Revised Code of Washington, Chapter 35A.29. Section 4: The elected Treasurer shall continue to hold office until the expiration of her term on January 10, 1978. The treasurer shall perform the duties of his office according to RCW 35A.42.010. Section 5: Department Created. There is created the Department of Finance of the City of Tukwila which shall be responsible for general supervision over the financial affairs of the City. Section 6: Duties. The functions of the department shall be executed under the supervision and control of a Director of Finance. The director shall be appointed for an indefinite term by the Mayor, subject to confirmation by a majority of the members of the City Council. The director shall serve at the pleasure of the Mayor. (a) The Director of Finance shall be the chief financial officer of the City. He shall perform all of the duties of the City Treasurer as set forth in RCW 35A.42.010. beginning at such time as the term of office of the current elected treasurer ends. The Director of Finance shall also perform such duties of the City Clerk which, in the opinion of the Mayor, are solely and directly related to the City's financial affairs. (b) The Director of Finance shall be designated City Treasurer to perform in such capacity whenever the laws of the state or the ordinances of the City make reference to such position. The director may appoint a subordinate employee from the Department of Finance to assist in the performance of the duties of City Treasurer. (c) If the director is appointed and confirmed prior to the time that the term of office of the current elected treasurer ends in January, 1978, the Director of Finance shall perform such duties related to the financial affairs of the City which are not specifically delegated by law to the City Treasurer and to the City Clerk. (d) In all cases where the fiscal affairs of the City are not expressly or otherwise charged by the laws of the state to another department or office, the Director of Finance shall have control and supervision over such fiscal affairs and shall act to promote, secure and preserve the financial interests of the City. (e) The finance director shall serve as the chief financial and accounting advisor to the mayor and city council and shall advise the mayor and city council of the plans, functions and needs of the department of finance. (f) The finance director shall be responsible for all financial and accounting matters in divisions of the department of finance of the city and for the administration of all department of finance matters. Section 7: Oath and Bond. Before entering upon the performance of his duties, the Director of Finance shall take an oath or affirmation for the faithful performance of his duties, and shall furnish an official bond in the amount of $5,000. Section 8: Compensation. The Director of Finance shall receive such salary and in such amounts as the City Council may from time to time establish by ordinance and as fixed by the City's annual budget. Section 9: Effective Date. The office of Director of Finance shall be effective on June 1, 1977, at which time the director shall perform all those duties not specifically reserved herein for the current elected City Treasurer. Until such time as the Director of Finance is duly appointed and confirmed, the City Treasurer and City Clerk shall continue to perform all duties heretofore prescribed to them by the laws of the state and ordinances of the City. Section 10: Existing City Laws and Regulations. All ordinances, resolutions, and orders adopted under the third class city classi- fication, where not in conflict with state law, shall continue in force until repealed or amended by the City Council under the newly adopted Optional Municipal Code classification of Noncharter Code City under the mayor-council form of government. Section 11: This ordinance shall be in full force and effect five (5) days after its passage, approval and publication.
