HomeMy WebLinkAboutOrd 1006 - Comprehensive Land Use Fees otv h, 4 loos )2_ 01 CITY OF TUK WILA I LA WASHINGTON ORDINANCE NO. 1006 i'z' a Cg AN ORDINANCE AMENDING TITLE 18 OF THE TUKWILA MUNICIPAL CODE BY ADDING A NEW CHAPTER 18.10 TO ESTABLISH NEW LAND USE APPLICATION FEES AND AMENDING SECTIONS 18.64.010, 18.72.030, 18.76.010 AND 18.84.010. WHEREAS, the Tukwila Planning Commission, after public hearing, found the current fees required for various land use applications to be insufficient to compensate the City for the expense of inspection and supervision required to assure compliance with applicable regulations, and; WHEREAS, the Planning Commission has recommended a new schedule of land use application fees be establsihed, and; WHEREAS, the Tukwila City Council has considered the recommenda- tion of the Planning Commission. N0W, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. That Title 18 of the Tukwila Municipal Code be amended by adding a new Chapter 18.10 to the Tukwila Municipal Code to read as follows: Chapter 18.10 APPLICATION FEES Sections: 18.10.010 Application fees. 18.10.010 Application fees. The following fees shall be paid by any applicant for a land use permit at the same time that said application is filed with the City of Tukwila: Type of Application Fee Comprehensive Plan Amendment $200 Rezone 200 Variance 150 Conditional Use Permit 175 Special Use Permit 175 Shoreline Permit 100 Street Vacation 150 Threshold Determination 50 Section 2. That Section 18.64.010 concerning conditional uses of the Tukwila Municipal Code be amended as follows: 18.64.010 Permission of planning commission required. The uses in this chapter may be located in any district (where otherwise not permitted), by special permission of the planning commission under such conditions as the commission may impose and after public hearing and payment of the appropriate fee prescribed in Chapter 18.10; Provided that in the judgment of the commis- sion such use will not materially injure the appropriate use of neighboring property, and will conform to the general intent and purpose of this title, including the necessary off street parking and loading facilities for such uses. Section 3. That Section 18.72.030 concerning variances of the Tukwila Municipal Code be amended as follows: 18.72.030 Application Fee. An application to the board of adjustment for the issuance of a variance may be made by any property owner, tenant, authorized agent or any government officer, department, board or bureau affected. Such application, together with all plans, specifications and other papers pertaining to the application, shall be filed with the e4ty -e4enk Planning Division. Each application shall be accompanied by feee4pt -te- the -e4ty- treasurer- sbew4ng payment by- the- appl4eant of a the appropriate fee ef- seventy- f4ve- de44ans prescribed in Chapter 18.10. Section 4. That Section 18.76.010 concerning special uses of the Tukwila Municipal Code be amended as follows: 18.76.010 Buildings and structures allowed by special permit Hearing. Public utility buildings, telephone exchanges, sewage pumping stations, electrical distribution sub stations, and similar uses necessary for the operation of a public utility may be permitted by the issuance of a special public utility use permit by the city council after it has considered the recommendation of the planning commission. The planning commission shall hold a public hearing upon the application of any public utility for such a permit. The application shall be accompanied by payment of the appropriate fee prescribed in Chapter 18.10. Such uses may be permitted in the R -A and C -N districts, provided the requirements in this chapter are complied with, the abutting and nearby properties are not detrimentally affected, and the purposes and objectives of the comprehensive plan and this title are furthered and not violated. Section 5. That Section 18.84.010 concerning rezone requests of the Tukwila Municipal Code be amended as follows: 18.84.010 Submission to planning commission. Any request for a change in zoning of any district or area, or of any boundary lines thereof as shown on the zoning maps (as distinguished from a variance or modification, in a specific case, of the application of any of the rules or regulations or -2- provisions of this title relating to the use, construction or alteration of buildings or structures, or to the use of land, because of practical diffi- culties or unnecessary hardships), shall be submitted to the e4ty planning eemi -ss4eR threagb- the- effi.ee -ef- the- e9ty -e4erk division. Said requests shall be made on such formal application forms as specified by the planning eeffilii*ss4ee division and all supporting data deemed pertinent by the planning ee1W }ss4eR division shall be supplied by the petitioner along with a -epe hwAdr-ed- del}ar- fil4mg- fee- paya64-e -te- the -e4ty the payment of the appropriate fee prescribed in Chapter 18.10.
