An. ORDINANCE regulating Card Rooms and the operation of Card
Tables and /or Pool and Billiard Tables and providing a penalty
for the violation thereof.
BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF TUKWILA,
WASHINGTON:
SECTION 1. That the word person whenever used in this Ordinance
shall be held and construed to mean and include natural persons,
firms, co- partnerships and corporations whether acting by them-
selves or by a servant, agent or employee.
SECTION 2. That it shall be unlawful for any oerson to maintain
or operate any card rooms or place where tables are kept for the
playing of cards or games with cards or the playing of pool and /or
billiards, within the Town of Tukwila without first having paid the
license fee and procured the annual license therefor hereinafter
provided.
SECTION 3. That said license fee is hereby fixed at the sum of
§25.00 for the first four tables, or any number of tables less than
four, and the sum of $10.00 for each additional tables; provided,
however, that for any card, pool and /or billiard room, where the
person operating or managing the card, pool and /or billiard table
or tables therein, or his agent, does not participate in, for gain,
any games played thereat, the license fee shall be fixed at the sum
of 410.00.
SECTION 4. Every applicant for a license hereunder shall make
written application therefor to the Town Council, and file the same
with the Town Clerk who shall refer the same to the said Town Council
at the regular meeting of the Town Council next after the date of the
filing thereof. Each application shall describe the premises where
such business is to be conducted during the life of the license appli-
ed for, the number of tables to be operated thereunder, the name of
the person in charge thereof and that the applicant has not been con
vocted in any Court of any violation of the Laws of the State of
Washington or the Ordinances of the Town of Tukwila relating to Gambl-
ing or games of chance. The Town Council may, in its discretion and
in case said applicant has not been convicted as aforesaid, accept or
reject any such application and, if accepted, may order the license
issued as hereinafter provided.
SECTION 5. Upon the acceptance by the Town Council of such appli-
cation for license, the applicant shall forthwith,file,with the Town
Clerk, the official receipt of the Town Treasurer showing full pay-
ment of the license fee hereinabove fixed, and thereupon the Town
Clerk shall issue to such applicant an annual license specifying the be
in the number of tables authorized thereby, whether for cards, pool
or billiards, and a definite description of the premises where the
business thereby licensed is to be conducted Such license shall be
issued at the first of the year and shall be in effect up to January
first of the year following. Every such license shall be revocable at
any time by tje Town Council without notice or hearing, whenever the
holder thereof or any employee of such licensed place shall have been
convicted or shall have forfeited any bond upon a.charged violation,
in any Court, of this Ordinance or any other Ordinance of the Town
of Tukwila or laws of the State of Washington, or of the United States
relating to gambling and games of chance.-)The licensee. °ahall, upon being
notified of such revocation of license, immrdiately surrender his
license to the Town Clerk.
SECTION 6.That no license granted hereunder shall be assignable
or authorize the conduct of the business thereby licensed in any
other place or by any other person than as designated in such license
unless a written application is made therefor to the Town Council
and its consent thereto first had and obtained, and in case such
transfer or changes are approved by the Town Council the proper
changes shall be made in the original license.
SECTION 7. It shall be unlawful for any person operating any card
room or place where tables are kept for the playing of cards or
games with cards, or any room where tables are kept for the playing
of pool or billiards to admit or allow to remain therein. any per-
son under the age of twenty -one years. The owner shall be required
to comply with-all State and County regulations governing card rooms
and pool and billiardstables..
SECTION B. It shall be unlawful for any perdon under the age of
twenty -one years to enter or remain in any card room or plate where
tables are kept for the playing of cards or games with cards, or
where tables are kept for the playing of pool or billiards.
SECTION 9. Any person who shall violate any of the provisions of
this Ordinance shall be deened guilty of a misdemeanor and upon
conviction thereof, shall be fined in any sum not to exceed ONE
HUNDRED DOLLARS 3100.00) and in addition thereto shall pay all
costs of prosecution.
SECTION 10. This Ordinance shall be in full force and effect
from and after its passage, signing and posting as required by
law..
