HomeMy WebLinkAboutOrd 1754 - Assault Against Police Officers and Firefighters f ILA, .........�1'q i Q O r 1908 Tu kwfla it o Washington Ordinance No. 7 5 y AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, CREATING A NEW SECTION 8.30.070 OF THE TUKWILA MUNICIPAL CODE REGARDING ASSAULTS AGAINST POLICE OFFICERS OR FIREFIGHTERS; PROVIDING FOR SEVERABILITY, AND ESTABLISHING AN EFFECTIVE DATE. WHEREAS, RCW 9A.36.031 creates a Class C felony for assaulting a police officer or firefighter; and WHEREAS, most minor assaults against police officers and firefighters are declined for filing by the King County Prosecuting Attorney; and WHEREAS, the City Council desires to provide criminal sanctions for assaults against police officers and firefighters; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. Section Created. A new Section 8.30.070 of the Tukwila Municipal Code is hereby created to read as follows: 8.30.070 Assault Avainst Police Officer or Firefiv-hter. A person is guilty of assault against a police officer or firefighter if he /she knowingly and wilfully touches, strikes, expectorates, or makes other unwelcome physical contact with a police officer or firefighter when such officer or firefighter is engaged in his /her lawful duties. The touching, striking, expectorating, or other unwelcome physical contact must be of such nature that it would offend an ordinary person who is not unduly sensitive. Assaulting a police officer or firefighter is a gross misdemeanor. Section 2. Severabilitv. Should any section, paragraph, sentence, clause or phrase of this ordinance, or its application to any person or circumstance, be declared unconstitutional or otherwise invalid for any reason, or should any portion of this ordinance be preempted by state or federal law or regulation, such decision or preemption shall not affect the validity of the remaining portions of this ordinance or its application to other persons or circumstances. Section 3. Effective Date. This ordinance shall be published in the official newspaper of the City, and shall take effect and be in full force five (5) days after the date of publication.
