AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUKWILA,
WASHINGTON, AMENDING CHAPTER 8.50 OF THE TUKWILA MUNICIPAL CODE
CREATING A NEW SECTION 18.50.050 REGULATING ILLEGAL SEXUAL
CONDUCT, AND PROVIDING FOR SEVERABILITY, AND ESTABLISHING AN
EFFECTIVE DATE.
WHEREAS, officers are presently unable to criminally charge individuals who are engaged in sexual acts in
public without proving prostitution is occurring, and
WHEREAS, the City has determined it necessary to regulate illegal sexual acts that occur in cabarets, dance
halls, and other establishments;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, DO
ORDAIN AS FOLLOWS:
Section 1. Section Created. A new Section 8.50.050 of the Tukwila Municipal Code is hereby created to read
as follows:
8.50.050 Illicit Conduct.
(a) No person shall touch, caress or fondle the genitals, pubic area, or adult female breast, of that person or
another, whether under or through clothing, for the purpose of sexual arousal or exciting the sexual desires of either
party, in a place open to the public; provided, however, this subsection shall not apply to any class, seminar, or lecture
held for serious scientific, artistic or educational purposes.
(b) No person shall expose to view, in any place open to the public, any portion of the adult female breast
below the top of the areola, or any portion of the pubic hair, anus, anal cleavage, vulva and /or genitals, except as
permitted in a licensed adult entertainment cabaret pursuant to Chapter 5.56; provided, however this subsection
shall not apply to any class, seminar, or lecture held for serious scientific, artistic or educational purposes.
Section 2. Severabilitv. Should any section, paragraph, sentence, clause or phrase of this ordinance, or its
application to any person or circumstance, be declared unconstitutional or otherwise invalid for any reason, or
should any portion of this ordinance be preempted by state or federal law or regulation, such decision or preemption
shall not affect the validity of the remaining portions of this ordinance or its application to other persons or
circumstances.
Section 3. Effective Date. This ordinance shall be published in the official newspaper of the City, and shall
take effect and be in full force five (5) days after the date of publication.

No. 75,1 regulating illegal sexual acts that occur in cabarets, dance halls, and other
establishments; providing for severability and establishing an effective date.
The full text of this ordinance will be mailed without charge to anyone who submits a
written request to the City Clerk of the City of Tukwila for a copy of the text.
