AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUKWILA,
WASHINGTON, AMENDING ORDINANCE 1533 AND SUBSECTION
8.50.040(b) OF THE TUKWILA MUNICIPAL CODE REGARDING THE
DEFINITION OF PROSTITUTION LOITERING; PROVIDING FOR
SEVERABILITY; AND ESTABLISHING AN EFFECTIVE DATE.
WHEREAS, the current language of the prostitution loitering ordinance is not broad enough to
encompass illegal sexual acts that do not entail the exchange of a fee for such criminal behavior; and
WHEREAS, the language of this ordinance requires clarification to ensure that the intent of the
ordinance be carried out;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA,
WASHINGTON, DO ORDAIN AS FOLLOWS:
Section 1. Prostitution Loitering. Ordinance 1533, as codified at subsection 8.50.040(b) of the
Tukwila Municipal Code, is hereby amended to read as follows:
(b) A person is guilty of prostitution loitering if he or she is in or remains in a public
place and intentionally solicits, induces, entices or procures another to commit an illegal sex act
including but not limited to those enumerated in or adouted by TMC Chanter 8.50.
Section 2. Severabilitv. Should any section, paragraph, sentence, clause or phrase of this
ordinance, or its application to any person or circumstance, be declared unconstitutional or otherwise
invalid for any reason, or should any portion of this ordinance be preempted by state or federal law or
regulation, such decision or preemption shall not affect the validity of the remaining portions of this
ordinance or its application to other persons or circumstances.
Section 3. Effective Date. This ordinance shall be published in the official newspaper of the City,
and shall take effect and be in full force five (5) days after the date of publication.

No. 75 clarifying the language of the prostitution loitering ordinance to encompass
illegal sexual acts that do not entail the exchange of a fee for such criminal behavior;
providing for severability and establishing an effective date.
The full text of this ordinance will be mailed without charge to anyone who submits a
written request to the City Clerk of the City of Tukwila for a copy of the text.
