Research: According to City records, the gate was installed across a portion of 34th Avenue South that is dedicated City right-of-way. Researching the City's permit tracking system, 1 did not find any applied -for or issued permit, authorizing the installation of a gate across 34th Avenue South. Corrective Action: 1. Remove the entire gate Iocated across 34th Avenue South. 2. Once the gate has been removedmaintain 34th Avenue South to this condition. All grading activities require erosion prevention and sediment control that prevents, to the maximum extent practicable, the transport of sediment from the site to drainage facilities, rights-of-way, water resources, and adjacent properties. Erosion and sediment controls shall be applied commensurate with the degree of risk, and as specified by the temporary erosion and sediment control measures, performance criteria, and implementation requirements ofTMC Chapter 14.30 and the [King County] Surface Water Design Manual. Research The north side of the house / side yard has been filled with soil, and it appears there has been a tremendous amount of soil deposited since it is level with the area on the west / front side of the house. The area of fill extends east approximately sixty (60) feet and is baren with no erosion measures to prevent sediment leaving the property or entering Riverton Creek. Looking towards the north side of the property, a gate has been installed across 34th Ave S and on either side of the road concrete ecology blocks have been installed to create areas to park vehicles and trailers. These two areas have been filled and covered with gravel to be level with the area on the west side / front of the house. The south side of the house / side yard has been filled with sail and covered in gravel to be level with the west side / front of the house. The area of fill extends south of the house approximately one hundred (100) feet and extends east past the east side of the house / backyard, potentially if the Riverton Creek buffer. Standing in front of the gate located on 34th Ave 5, I observed the two (2) areas on either side of the road. The parking area on the west side of the road has been constructed with two (2) rows of ecology blocks along the north and east sides. The parking area on the east side of the road has been constructed with two (2) rows of ecology blocks on the west side and the north side begins with two (2) rows then becomes five (5) rows to compensate for the slope of the property. Looking towards TIB a row of ecology blocks has been constructed near the base of the concrete wall which supports TIB. There are two (2) rows of blocks to create the wall and it extends north to south / parallel to TIB approximately twelve (12) blocks. These are the same blocks I observed from TIB. Behind / TIB side these blocks, fill material has been deposited to create a flat area covered in gravel, approximately twenty (20) feet wide and covers most of the area behind the row of blocks. The north end of this area is tapered down to the area in front / west side of the house. The soil on the west side of this graveled area has been contoured to create a slope and is approximately ten (10) feet wide. On June 20, 2023, I observed the same conditions I observed on May 3, 2023. Researching the permit tracking system, I did not find any applied -for or issued permit(s) for any land clearing activities or the construction of block walls. Also, a tremendous amount of soil has been brought onto the property to create the two parking areas located next to the gate and to fill the areas on the south, west, and north sides of the house. (See attached photographs) Reviewing the 2016 Google Street View, the slope towards TIB begins approximately twenty (20) feet to the west / front of the house. In the 2018 Google Street View, land clearing and slope alterations had begun. From 2018 to 2022, the majority of the slope has been removed. The remaining slope next to TIB has been reduced to approximately ten (10) feet wide. (See attached photographs) 1. IMMEDIATELY CEASE ALL LAND CLEARING / ALTERATION ACTIVITIES AND DO NOT BRING ANY ADDITIONAL SOIL, GRAVEL, RECYCLED CONCRETE MATERIAL, OR HOGFUEL ONTO PROPERTY. 2. Obtain a Right of Way Use — Non -Franchise permit for the required mitigation of the Tukwila International Blvd. (TIB) and 34th Ave S Right of Way. (NOTE: This permit is ONLY for the mitigation work, not permission to use the RoW.) The permit and plans submittal must include but not limited to site plan, civil plans (erosion control, grading, utilities, etc.), Geotechnical Report for the area within the TIB and 34th Ave 5 RoW, location of Riverton Creek and the associated buffer, all manholes: storm and sewer, pipes: sewer, storm, water, and gas, above and below ground utilities, swales, riprap, etc. Once the permit is approved and issued, you must conduct a Pre - Construction meeting within fifteen (15) days of permit issuance with the City's Site Development Inspector before ANY work commences. 4. Once this meeting is held, ALL required erosion and sediment control devices MUST be installed, inspected, and approved before ANY mitigation work commences. The installation of all control devices must meet or exceed the standards set forth in the King County, WA Surface Design Manual, July 23, 2021. See Exhibit D for the required silt fencing and location of silt fencing for Riverton Creek. All other erosion and sediment control measures and locations will be discussed at the Pre -Construction meeting. Compliance Date: Submit complete application, plans, Geotechnical Report, and all other required documents by: August 31, 2023 Violation # 3 Code Reference: TREE PERMIT REQUIRED TMC 18.54.030 Tree Permit Required A. Permit Required. 1. A Tree Permit is required prior to work within the Critical Root Zone of any Significant, Exceptional or Heritage Tree or prior to the removal or destruction of any of these trees within the City, unless the action is exempt from this chapter. TMC 18.54.160 SoiI Preparation, Plant Material and Maintenance Standards B. Plant Material Standards. 1. Plant material shall be healthy, vigorous and wellformed, with well- developed, fibrous root systems, free from dead branches or roots. Plants shall be free from damage caused by temperature extremes, pre -planting or on'si1es1orage,|ackofor excess moisture, insects, disease, and mechanical injury. Plants in leaf shall show a full crown and be of good color. Plants shall be habituated to outdoor environmental conditions (i.e. hardenedoff). 2. Evergreen trees shall be a minimum of 6 feet in height at time of planting. 3. Deciduous trees shall have atleast a 2 -inch caliper at time of planting as measured 4.5 feet from the ground, determined according to the American Standard for Nursery Stock as it now reads and as hereafter amended. Observed Conditions: OnMay 3,2O23,|observed from TIB and 34'Ave Sthe land between the west side / front of the house to TIB. 1 did not observe any trees over four (4) inches in diameter taken at breast height (DBH). (See photographs below). On June 20, 2023, I observed the same conditions I observed on May 3, 2023. Research: Reviewing the permit tracking system, I did not find any permits applied for or issued for the removal of trees anywhere on this property. Reviewing the 2018 Real Estate photograph, Google Street View, and King County Assessor's Localscape / Analytics beginning in 2016 through 2022, it appears that many large (>18" DBH) conifer and deciduous trees were removed from the west side / front of the house, and all trees Iocated on the bank next to TIB were removed, including the root wades. (See attached photographs) Corrective Action: 1. IMMEDIATELY CEASE ANY FURTHER TREE REMOVALS. 2. Obtain a Tree Permit — Single Family for the removal of all trees removed throughout the property. 3. The permit and plans submittal must include but not limited to site plan, location of all sensitive areas, building footprint, tree protection measures for the remining trees, proposed tree maintenance which includes but not limited to watering, Best Management Practice. 4. Once the permit has been issued, conduct a Pre -Tree Planting field meeting with the City's Urban Environmentalist. This meeting will include but not limited to the discussion of the location of the plantings, best practice for the plantings, watering, maintenance. NOTE: ALL plantings must be performed between October 1, 2023 and December 31, 2023 for the health and viability of the plants. Compliance Date: Compliance date to submit complete permit application, plans, and any other required documents: August 31, 2023 Violation # 4 LAND CLEARING IN AN ENVIRONMENTALY SENSITIVE AREA Code Reference: TMC 18.45.070 Critical Area Permitted Activities B. Permitted Activities Subject to Administrative Review. The following uses may be permitted only after administrative review and approval of a Type 2 Special Permission application by the Director: See TMC 18.45.070 for complete text. On May 10, 2023, I observed an area approximately twenty five (25) feet west Observed Conditions: of Riverton Creek has been excavated and two rows of ecology blocks have been constructed. These blocks create an "L" shape, three (3) to four (4) blocks in length each and are two (2) to three (3) blocks high each. There are dimensional lumber and wood pallets stored in this area. To the north and west of this location, additional areas are being used for storage. This location is accessed from the area located on the south side of the house. On June 20, 2023, I observed the same conditions I observed on May 3, 2023. Corrective Action: Reviewing the City's permit tracking system, 1 discovered permit PW18-0167 for land clearing in an Environmentally Sensitive Area. Permit was issued on December 5, 2018 and expired on July 28, 2021. No inspections performed. Reviewing Tukwila iMap, I discovered the property is encumbered by Riverton Creek, including the area where 1 observed the land clearing, fihling, and materials storage. (See attached photographs) 1. IMMEDIATELY CEASE ALL LAND CLEARING ACTIVITY UNTIL ALL REQUIRED PERMITS HAVE BEEN REVIEWED, APPROVED, AND ISSUED. 2. Apply for and receive an approved Type 2 Special Permission permit for the enhancement / mitigation including Iandscaping with native plants that requires heavy equipment. 3. Remove all dimensional Iumber, gates, windows, dollies, trellises, playground equipment, plastic chairs, plastic and metal drums, landscaping blocks, cast iron tub, within the Environmentally Sensitive Area. Remove all of these items ONLY by July 31, 2023 4. Remove all ecology blocks and unpermitted fill AFTER the Type 2 Special Permission permit has been issued and a Pre -Construction meeting has been held with the City's Project Inspector and Urban Environmentalist. 5. Once this area has been restoredplanted, approved, and finaledyou must maintain this condition and all required plants for the Iife ofthe property. NOTE: The removal ofthe ecology blocks and unpermitted fihl can only be performed between July 1 and August 31. Cease use of the property as a contractor storage yard. 2. "Vacant Building" means a building or structure that has not been occupied for over 30 days. Observed Conditions: On May 3, 2023, 1 observed a small, single family home that appeared unoccupied. The windows were boarded, siding was missing, guttering was detaching from the facia boards, and facia boards were detaching from the roof. On June 20, 2023, I observed the same conditions I observed on May 3, 2023. Research: This property was sold on April 13, 2018 and has remained vacant since. (See attached photographs) Corrective Action: 1. Board the entire house in accordance with the International Property Maintenance Code (IPMC). 2. Maintain this condition until the house is no longer vacant or the house is demolished. Compliance Date: Board the entire house by August 31, 2023.
