AN ORDINANCE ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF TUKWILA, WASHINGTON, AMENDING
ORDINANCE NO. 2703 §6, AS CODIFIED AT
TUKWILA MUNICIPAL CODE SECTION 16.16.010, TO
MODIFY THE EFFECTIVE DATE OF THE 2021
EDITION OF THE INTERNATIONAL FIRE CODE;
ESTABLISHING THE 2018 EDITION OF THE
INTERNATIONAL FIRE CODE IN THE INTERIM;
PROVIDING FOR SEVERABILITY; AND
ESTABLISHING AN EFFECTIVE DATE.
WHEREAS, the City Council desires to protect the health, welfare, and safety of
Tukwila residents by keeping current with the most recent International Fire Code
regulations; and
WHEREAS, the City Council desires to update and clarify the effective date of new
fire code regulations in Tukwila to ensure life safety codes can be implemented
effectively and consistently in terms of timing; and
WHEREAS, these updates are intended to better align the City's fire code
regulations with the International Fire Code, National Fire Protection Association
(NFPA), and the Puget Sound Regional Fire Authority; and
WHEREAS, on May 1, 2023, the City Council adopted Ordinance No. 2703,
adopting the 2021 Edition of the International Fire Code and appendices; and
WHEREAS, on May 24, 2023, the State Building Code Council voted to delay the
effective date of the 2021 Codes by 120 days until October 29, 2023, starting on June
30, 2023, due to pending litigation; and
WHEREAS, in alignment with the State Building Code Council's adoption of the
2021 Codes, the City Council desires to postpone the effective date of the 2021 Edition
of the International Fire Code and appendices from J uly 1, 2023 until October 29, 2023,
or whichever date is established by the State Building Code Council;

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA,
WASHINGTON, HEREBY ORDAINS AS FOLLOWS:
Section 1. Adoption of Findings of Fact. The City Council hereby adopts the
foregoing recitals and incorporates them herein as support for these amendments.
Section 2. TMC Section 16.16.010 Amended. Ordinance No. 2703 §6, as
codified at Tukwila Municipal Code (TMC) Section 16.16.010, "Adoption of the
International Fire Code," subparagraph A, is hereby amended to read as follows:
16.16.010 Adoption of the International Fire Code
A. Effective on October 29, 2023, or whichever date is established by the State
Building Code Council, in accordance with RCW 19.27, the International Fire Code,
2021 Edition, including Appendix B, published by the International Code Council, Inc.,
together with any additions, deletions, and exceptions currently enacted or as may be
amended from time to time by the State of Washington through its Building Code
Council pursuant to WAC 51-54A, and as further amended in this ordinance, are
hereby adopted by this reference as if fully set forth, subject to the modifications and
amendments set forth in TMC Chapter 16.16.
Section 3. Interim Regulations Established. Effective retroactively to July 1,
2023, the 2018 Edition of the International Fire Code, including Appendices B, C, D,
F, H, I, K, and N, published by the International Code Council, Inc., shall be in effect
until the 2021 Edition of the International Fire Code and appendices are declared
effective by the State Building Code Council.
Section 4. Corrections by City Clerk or Code Reviser Authorized. Upon
approval of the City Attorney, the City Clerk and the code reviser are authorized to
make necessary corrections to this ordinance, including the correction of scrivener's
errors; references to other local, state or federal laws, codes, rules, or regulations; or
ordinance numbering and section/subsection numbering.
Section 5. Severability. If any section, subsection, paragraph, sentence, clause
or phrase of this ordinance or its application to any person or situation should be held
to be invalid or unconstitutional for any reason by a court of competent jurisdiction,
such invalidity or unconstitutionality shall not affect the validity or constitutionality of
the remaining portions of this ordinance or its application to any other person or
situation.
Section 6. Effective Date. This ordinance or a summary thereof shall be
published in the official newspaper of the City, and shall take effect and be in full force
five days after passage and publication as provided by law.

On August 7, 2023 the City Council of the City of Tukwila, Washington, adopted the
following ordinance, the main points of which are summarized by title as follows:
