Parties
1.1 This Covenant for Inspection and Ma eumc of Stormwater Facilities and 'Best
:Management Practices ("Covenant") 6 made by and between Tukwila School District No. 406, as Grantor,
and the City of Tukwila, 0 'Washington 'Nfunicipai Corporation, as Grantee. Grantor and Grantee (also denoted
as City herein) are each a Party and collectively the Parties to this Agreement.
2. Recitals
2.1 Grantor applied. to City fdr issuance of a Site 'Development Permit on November 1,6, 2017..
2.2 Pursuant to TMC 14.30,060, applicationfor and issuance of such permit requires the property
owner to enter into this Covenant,
2.3 The subject of the Covenant is the real property located in King County, Washington, bearing
King County Tax Parcel No, 152304-9108 and legally described in the attached Exhibit A incorporated herein
("Property"),
2,4 The City approved the applications which consist of the following docturients, attached and
incorporated herein:

3..1 The. foregoing Recitals and references to documents are incorporated as material terms of this
Covenant.
3.2 The Grantor(s) for itself and its successors in interest having any ownership interest in the
Property (collectively Owners) shall at their sole cost and expense retain, .uphold, operate., maintain:, and repair
the stonnwater facilities and best management practices ("13M.Ps") located on the Property pursuant to the
schedule within the Operations 84 Maintenance Plan.
3.3 The obligations required under Section 3.2 above shall be taken consistent th.e following:
3.3.1 The City shall have the right of ingress and egress over those portions of the Property
necessary to pert:bra) inspections of the stormwater facilities and I.31VIPs and conduct other activities specified
in this Ewlaration of Covenant and in accordance with Tukwila Municipal Code "TMC") 14.30.80. This
right of ingress and egress; right to inspect, and right to perform required maintenance or repair shall be as
provided for in subsection 3.3.2 below.

3.3.2 If the City determines that maintenance or repair work is required to be done to any
of the stormwater facilities or BMPs, the Director of 'Public Works or designee (the "Director") shall give
notice of the specific maintenance andior repair work required pursuant to TMC 14,30.080. The Director shall
also set a reasonable time in which such work: is to he completed by the Owner, If the above required
maintenance or repair is not completed within the time set by the Director, the City may perform the required
maintenance or repair, and is hereby granted access to the Property for such purposes. Written notice will be
mailed to the Owner stating the City's intention to perform such work. This work will not commence until at
least seven (7) days after such notice is :mailed. If, within the sole discretion of the Director, there exists an.
irnrninent or present danger, the seven (7) day notice period will be waived and maintenance andlor repair
work will begin immediately,
3,4 If at any time the City reasonably determines that a stormwater :facility or BMP on the
Property presents all imminent hazard, as identified by TMC... 14.30.080 and herein incorporated by reference,
the Director or equivalent municipal successor's official :may take measures specified therein,
3.5 The Owner shall assume all responsibility fib the cost of any maintenance or repair work
completed by the City as described in Covenant. Such responsibility shall include reimbursement to the City
within thirty (30) days of the receipt of the invoice for any: such work performed. Overdue paymenis wiEt
require payment of interest at the current legal rate as liquidated damages, All such costs and expense shall
constitute a lien against the Property:,
3.6 The Owners shall obtain a Type C .Public Works permit from the City prior to filling, piping,
cutting, or :removing vegetation (except in routine landscape maintenance such as replacement of plants and
pretreatment mulch) in open vegetated stormwater facilities (such as swales, channels, ditches. ponds, etc.),
or performing any alterations or modifications to the stormwater facilities and BMPs referenced in this
Covenant. Prior to the final approval and issuance of the new permit, a new Covenant with updated exhibits
reflecting the changes to the stormwater facilities shall be recorded at the Owner's sole cost, and a copy of the
new recorded Declaration of Covenant provided to the City.
3.7 Any notice or consent required to be given or otherwise provided for by the provisions of this
Declaration of Covenant shall be effective upon personal delivery, or three (3) days after mailing by Certified
.Mail, return receipt requested, to the address listed below for that party:

3.8 With regard to the matters addressed herein, this Covenant constitutes the entire agreement
between theparties, and supersedes all prior discussions„ negotiations, and 'all agreements whatsoever whether.
oral or written. This Covenant shall be governed by the laws of the State of Washington. Any suit to enforce
or relating to this Covenant shall only be .filed. in King County Superior Court, King County, Washington, and
the Parties consent to the jurisdiction thereof In the event of any legal action by either Party relating to this
Covenant, the Parties shall pay their own costs or fees.
3.9 This Covenant is intended to protect- the value and desirability of the real property described
in Exhibit A, promote the efficient and effective management of stormwater drainage, and shall inure to the
City of Tukwila Page 2.

benefit of all the citizens ofthe City and its municipal successors and assigns. References herein to the TMC
shall include subsequent amendments to such statutes and all successor statutes.
3.10 This Covenant shall run with the land and shall be binding upon the Owners as defined in
Section 3.2 above.
3.11 This Covenant may be amended or terminated only with the advance express written consent
of the City as determined. pursuant to its discretion.

1.0 Overall Project Summary
This Stormwater Operations and Maintenance Plan accompanes the civ engineering plans
submitted for the Showalter Middle School Addition project located on Parcel No. 1523049108
inKing County, VVaahing1on. The parcel is approximately 2464 acres in tota size and the area
affected by redevelopment is approximately 5.88 acres (see Appendix Al for the Vicinity Map).
The new improvements include a classroom addition, gym addition, entrance ramp and
pedestrian paving, supporting water, fire, and storm utilities, and a new stormwater detention
facility. Storn`waterwill becollected and channeled to either the new detention facility or the
existing conveyance system. Stormwater management will comply with the 2016 King County
Surface Water Design Manual (KCSWDM), as adopted by City of Tukwila.
This report presents a rnaintenance prograrn that meets the requirements ofthe 2016 King
County Surface Water Design Manual (KCSWDM). This document provides the guidelines for
facilities to be maintained in a timely and conscientious manner. If the stormwater facilities and
conveyance systems are not adequatey inspected and maintained periodicaUy, it could ead to
local flooding and increased erosion potential. SUiadon, debris, or lack of general maintenance
can reduce the performance capabHities of the facilities,
2.0 Maintenance Importance and Intent
The importance of maintenance for the proper functioning of stormwater controlfacilities cannot
he over emphasized, A substantia portion ot failures (clogging of filters,resuspension of
sediments, loss of storage capacity, etc.) are due to inadequate maintenance. Stormwater Best
Management Practice (BMP) maintenance is essential to ensure that BMPs function as
intended throughout their full life cycle. The fundamental goals of maintenance activities are to
ensure the entire flow regime and treatment train designed for this site continue to fully function,

Preserve soil and plant health, as well as stormwater flow contact with plant and soil
systems.

The intent of this section and manual is to pass on to the responsible party(ies) all the
information critical to understanding the design of the system, risks and considerations for
proper use, suggestions for maintenance frequencies, and cost so that realistic budgets can be
established.

4.0 Description of the Drainage System and Facilities Serving the Site
Conveyance Systems
New detention facilities will transport stormwater runoff frorn the redeveloped porton of the
property to the downstream system which runs north through existing ball fields and towards
Macadam Road South. To work properly, pipes must be kept free of silt and other debris.
CMP Stormwater Detention Tanks
CMP Detenbon Tanks w he installed to store water runoff from impervious surfaces, To
maintain proper function, the tanks will need to be cleaned out and maintained per
manufacturer's specifications.
F!ow Splitter Catch Basin
A Flow Splitter catch basin will be installed to route a specific volume of stormwater runoff into
the detention tanks and allow any flows beyond to be diverted to the existing stormwater
system, bypassing the tanks. To maintain pnoperfunodon. the catch basin structure will need to
be creaned out and maintaned per manufacturer's specffications.
5'0 Schedule
Maintenance of the stormwater facility shall follow the schedule specified in the 2016 King
County Surface Water Design Manual (KC,SWDM), Additional maintenance may be required to
respond to unusual storm events or reduced performance of the facilities. A copy of the
recommended maintenance schedule is included as Appendix and may be photocopied and
used as nspecton records, nspection reports should be competed annuaIy.
Routine inspecfion and rnaintenance apply to all the systems that are considered an integral
part of the onsite storrnwater and pollution prevention facilities.
6.0 Pollution Source Control Plan
Pollution source control is the application of pollution prevention practices on a developed site
to reduce contamination of storrnwater runoff at its source. Site-specific Best Management
Pracfices (BMPs) have been incorporated into the site plan to reduce the number of
contaminants used or discharged to the environment. Se.e Appendix C for Source Control
BMPs.
7.0 Vegetation Management Plan
The maintenance schedules in Appendix B provide guidance on vegetation control and
management within stormwater facilities and general ground maintenance. Irrigation and other
maintenance as necessary shall be provided to ensure that vegetation remains viable and that
hardy root structures form in the first year, Vegetation planting shall be provided as described in
the construction documents.

8.0 Instructions for Person Maintaining Storrnwater System
Appendix B contains a stormwater facility maintenance schedule. Plan to complete a checklist
for a system cornponents per the foowng schedule:

Usng photocopes of the attached pages, check off the probems Lhat are noted each tirne the
item is inspected. Document comments on problems found and the corrective action taken. The
inspection checklist sheets should be kept on the and used to prepare for annual reports.
This analysis is based on data and records either supplied to or obtained by AHBL. These documents
are referenced within the text of the analysis. The analysis has been prepared using procedures and
pract)ces within the standard acceted practices of tho industry.

Preventative maintenance and good housekeeping practices reduce the potential for stormwater to
corne into contact with pollutants and can reduce maintenance intervals for the drainage system and
sewer system.
Applicable BMPs:
°
Prevent the discharge of unliquid or solid wastes, process wastewater, and sewage
to ground or surface water, or to storm drains that discharge to surface water, or to the
ground. Conduct all oily parts cleaning, steam cleaning, or pressure washing of equipment or
containers inside a building, or on an impervious contained area, such as a concrete pad. Dir-
ect contaminated storrnwater from such an area to a sanitary sewer where allowed by local
sewer authority, or to other approved treatment.
°
Promptly contain and clean up solid and liuid pollutant leakoandmoUls including oils, solvents,
fuels, and dust from manufacturing operations on an exposed soil, vegetation, or paved area.
°
If a contaminated surface must be pressure washed, collect the resulting washwater for
proper disposal (usually involves plugging storm drains, or otherwise preventing discharge
and pumping or vactoring up washwater, for discharge to sanitary sewer or for vactor truck
transport to a waste water treatment ptant for disposat).
°
Do not hose down pollutants from any area to the ground, storm drains, conveyance ditches,
or receiving water. Convey pollutants before discharge to a treatment system approved by the
local jurisdiction.
^ Sweep all appropriate surfaces with vacuum sweepers quarterly, or more frequently as
needed, for the collection and disposal of dust and debris that could contaminate stormwater.
Use mechanical sweepers, and manual sweeping as necessary to access areas that a
vacuum sweeper can't reach to ensure that all surface contaminants are routinely removed.

Do not pave over contaminated soil unless it has been determined that ground water has not
been and will not be contaminated by the soil. Call Ecology for assistance.

Construct impervious areas that are compatible with the materials handled. Portland cement
concrete, asphalt, or equivalent material may be consdered,

Use drip pans to collect leaks and spills from industrial/commercial equipment such as cranes
at ship/boat building and repair facilities, log stackers, industrial parts, trucks and other
vehicles stored outside.

At industrial and commercial facilities, drain oil and fuel filters before disposal. Discard empty
oil and fuel filters, oily rags, and other oily solid waste into appropriately closed and properly
labeled containers, and in compliance with the Uniform Fire Code or International Building
Code.
For the storage of liquids use containers, such as steel and ptastic drums, that are rigid and

o Promptly repair or replace all substantially cracked or otherwise damaged paved secondary
containment, high-intensity parking, and any other drainage areas, subjected to pollutant
material leaks or spills. Promptly repair or replace all leaking connections, pipes, hoses,
vaves, etc., which can contaminate stormwater.
• Do not connect floor drains in potential poflutant source areas to storm drains, surfacwater,
or to the ground.
Recommended BRIPs:
• Where feasible, store potential stormwater pollutant materials inside a building or under a
cover and/or contanment.
o Minimize use oftoxic cleaning solvents, such as chorinated solvents, and other toxic chem-
icals.
• Use environmentafly safe raw materials, products, adchtives, etc. such as substitutes for zinc
used in rubber production.
o Recycle waste materials such as solvents, coolants, oils, degreasers, and batteries to the max-

to waterbody"
• Use solid absorbents, e.g., clay and peat absorbents and rags for cleanup of liquid spills/leaks,
where practicable.
• Promptly repair/replace/reseal damaged paved areas at industrial facilities.

° Recycle materials, such as oils, solvents, and wood waste, to the maximum extent prac-
ticable.
Note: Evidence of stormwater contamination by oils and grease can include the presence of visible
sheen, color, or turbidity in the runoff, or present or historical operational problems at the facility.
Operators can use simple pH tests, for example with litmus or pH paper. These tests can screen for
high or low pH levels (anything outside a 6.5-8.5 range) due to contamination in stormwater.

Description
of Pollutant Sources: Spills and leaks can damage public infrastructure, interfere
with sewage treatment, and cause a threat to human health or the environment. Spills are often pre-
ventable if appropriate chemical and waste handling techniques are practiced effectively and the spill
response plan is immediately implemented. Additional spill control requirements may be required
based on the specific activity occurring on site.

facility, including the owner's name, address, and telephone number; the nature of the facility
activity; and the general types of chemicals used at the facility.
