Council President Delostrinos Johnson called the Tukwila City Council meeting to order at 7:00 p.m. and
led the audience inthe Pledge ofAllegiance.

LAND ACKNOWLEDGEMENT
Cmunoi|memberMcLeod stated "The City nfTukwila is located onthe ancestral lands ofthe Coast Sa|ish
people. We acknowledge their continuing connections to land, waters and culture. We pay our respects to
their elders past, present and emerging."
PUBLIC COMMENTS
1. Greg Sherlock provided a background of his ongoing noise complaint regarding the Sabey Data
Center and indicated he has filed multiple complaints regarding the noise issue. He expressed
concern regarding City Administration's response to this issue.
2. Joe Duffie thanked the City for recently holding the Back to School Beach Bosh at Joseph Foster
Memorial Park and requested the Council help keep the community informed on events of interest.
He expressed appreciation for recent work completed by the City along 53rd Avenue South and
Seattle City Light for their customer service during a recent power outage.
3. Kelle Symonds shared her concerns regarding the Allentown Truck Reroute Environmental Impact
Statement (EIS) process. She relayed recent safety incidents she has experienced along 42"u
Avenue South along the DuwamiahRiver.

SPECIAL ISSUES
a. An update onthe Financia|Suetminabi|dy Plan &Ut|dy Rate Study: Finanoim/Suetainabi|ity
Committee Process.
Vicky Cadsen, Finance Director, and Brian Murphy, Principal with BERKConsuNnQ. provided an
overview of the proposed Financial Sustainability Plan and Utility Rate Study. The overview included the
process to date with BERK for the development of the plan and next steps that include forming a
committee 0nadvise nnthe development ofthe plan.
The Councilmembers asked clarifying questions and offered feedback regarding the proposed plan
including the importance of bringing an equity -lenses, inclusivity, representation from varied community
groups, and improving the recruitment process to remove barriers.

b. Ordinances updating 2024 Fire and Parks Impact Fee Schedules.
VickyCodnen. Finance Director, and David Rosen, Parks and Recreation Analyst, explained the Fire and
Parks Impact Fee Schedules are updated annually per Tukwila Municipal Code Sections 16.26.080 and
16.28.080. Fire and Parks Impact Fees are one-time charges assessed against new development
projects to address increased demand for services created by development projects.
Based onaquestion from Counci|memberHougordy regarding Puget Sound Fire' Ms. Carlsen clarified
Fire Impact Fees remain the City's responsibility and are currently dedicated to repaying debt h)the
Public Safety Plan.

c. An ordinance adopting amendments to Tukwila Municipal Code Chapter 8.07 regarding drug
possession. (Reference: Blake Decision).

Eric Dnaver, Police Chief, indicated the draft ordinance adopts provisions of Second Engrossed Second
Substitute Senate Bill 5536 ("2E2SSB"), which established a permanent "Blake fix." The draft ordinance
adopts byreference new state statues inalignment with 2E2SSB prohibits the possession ofcontrolled,
counterfeit, and legend drugs without a prescription, and enables City prosecution of those violations in
the Tukwila Municipal Court. Due to the expiration of drug possession statutes on July 1, 2023 through
ESB 5476, this draft ordinance declares an emergency to take effect immediately upon passage.

d. An update on Allentown roadside barriers and consensus on next steps.
Hari Ponnekand, Public Works Director, and Cyndy KniQhton, Senior Program Manager, provided an
overview of the history and funding status of guardrail and/or barriers on 42nd Avenue South along the
Uuwamiah River in Allentown. HistohoaUy, the roadside barriers in Allentown have been part ofthe
broader "Small Roadway and Safety Improvements" CIP (Capital Improvement Program) Project that is
now "Traffic Calming/Residential Safety Improvements" in the current G'yearC|P.

The Councilmembers offered comments and spoke in support for the Allentown roadside barriers to have
its own C|Pproject poge.

Mayor Ekberg was not inattendance.
b. City Council
Councilmember Kruller attended the dedication event of Habitat for Humanity's La Fortuna development,
a potluck event with several State and local elected officials in attendance, and was invited to speak at
the Rotary Club of SeaTac-Tukwila. She reported the Salvation Army held a Back -to -School shopping
event atOld Navy. She relayed feedback from residents in Allentown regarding the raised sidewalks in
Allentown and shared Church by the Side of the Road is continuing conversations with the City for
emergency housing tobeinstalled ontheir property.
c. Staff

MISCELLANEOUS
Councilmember Kruller referenced Ms. Symonds' public comment regarding public safety and requested
additional patrolling along 42nd Avenue South by the Duwamish River. She applauded the Tukwila Police
Department for their response to a recent incident at Westfield Southcenter Mall.
