BACKGROUND N/A — WSDOT right-of-way Adjacent to the off -ramp from southbound I-405 to Interurban Ave. South/Ft. Dent Way is a three tiered retaining wall structure containing stormwater facilities for the highway. The structure is located within Washington State Department of Transportation (WSDOT) right-of- way. This three tiered retaining wall structure is next to the Green River Trail. This retaining wall structure was constructed at the time (approximately 1993) when the off -ramp was reconstructed by WSDOT and landscaped with six evergreen trees upon completion of the off - ramp reconstruction. Dent Way. A portion of one of the retaining walls was collapsing and there was significant undermining of a USGS gauging station located in the vicinity of the collapsing wall. WSDOT maintenance staff removed all of the vegetation from each of the three tiers and repaired the blocked storm water pipe. It appears that in addition to the six trees that were planted at the time the reconstruction was completed, volunteer evergreen trees had also seeded and become established. As can be seen from the photos below, the trees that were removed were quite large. The site is located in the City's shoreline jurisdiction, therefore the tree regulations that govern are found in TMC 18.44.080. Any clearing of any vegetation in the shoreline requires a Tree Clearing Permit. Based on the tree replacement ratios found in TMC 18.44.180 B.4., a total of 36 trees would need to be planted to replace the trees that were removed. WSDOT has evaluated the site and proposes to plant five Excelsa Cedars trees at the edges to avoid interfering with the flow lines of the storm water system. The dimensions of this tree at maturity will not block roadway signage or grow into the bridge deck in the future. WSDOT will pay into the City's tree replacement fund for the remaining 31 trees. A landscaping plan has been provided as part of the permit application. III. DECISION SEPA Determination: The City's SEPA Responsible Official has previously determined that this application does not require a SEPA threshold determination because it is categorically exempt. Decision on Substantive Permit: The City Planning Supervisor has determined that the application for a Shoreline Tree Removal and Vegetation Clearing Permit does comply with applicable City and state code requirements and has approved that application, subject to any conditions which are set forth in the Decision below: 1. A total of thirty-six (36) replacement trees are required to be planted. Based on the landscaping plan submitted by WSDOT, five trees will be planted on site — the remaining trees will be compensated for by paying into the City's tree replacement fund. 2. Tree planting may be deferred to the fall to ensure plant survivability. YOUR APPEAL RIGHTS The Decision on this Permit Application is a Type 1 decision pursuant to Tukwila Municipal Code § 18.104.010. Other land use applications related to this project may still be pending. No administrative appeal of a DNS or an EIS is permitted. One administrative appeal to the City Hearing Examiner of the Decision on the Permit itself is permitted. If an MDNS was issued, any person wishing to challenge either the conditions which were imposed by the MDNS decision or the failure of the Department to impose additional conditions in the MDNS must raise such issues as part of the appeal to the Hearing Examiner. A party who is not satisfied with the outcome of the Hearing Examiner appeal process may file an appeal in King County Superior Court from the Hearing Examiner's decision: V. PROCEDURES AND TIME FOR APPEALING In order to appeal the Planning Supervisor's decision on the Permit Application, a written notice of appeal must be filed with the Department of Community Development within 14 days of the issuance of this decision, that is by 5:00 p.m., Thursday, July 30, 2015. The requirements for such appeals are set forth in Tukwila Municipal Code Chapter 18.116. All appeal materials shall be submitted to the Department of Community Development. Appeal materials MUST include: 1. The name of the appealing party. 2. The address and phone number of the appealing party; and if the appealing party is a corporation, association or other group, the address and phone number of a contact person authorized to receive notices on the appealing party's behalf. 3. A statement identifying the decision being appealed and the alleged errors in the decision, including any specific challenge to an MDNS. 4. The Notice of Appeal shall identify (a) the specific errors of fact or errors in application of the law in the decision being appealed; (b) the harm suffered or anticipated by the appellant, and (c) the relief sought. The scope of an appeal shall be limited to matters or issues raised in the Notice of Appeal. 5. Appeal fee per the current fee schedule, additional hourly charges may apply. In addition all hearing examiner costs will be passed through to the appellant. VI. APPEAL HEARINGS PROCESS Any administrative appeal regarding the Permit shall be conducted as a closed record hearing before the Hearing Examiner based on the information presented to the Planning Supervisor, who made the original decision. Parties will be allowed to present oral argument based on the information presented to the Planning Supervisor before their decision was issued. The Hearing Examiner's decision on the appeal is the City's final decision. Any party wishing to challenge the Hearing Examiner's decision on this application must file an appeal pursuant to the procedures and time limitations set forth in RCW Chapter 36.70C. If no appeal of the Hearing Examiner's decision is properly filed in Superior Court within such time limit, the Decision on this permit will be final. VII. In an email dated April 22, 2015, Andrew Gross, the Regional Maintenance Environmental Coordinator, provided an estimate for replacement trees at $85.00/tree based on the average cost for an eight -ten foot Western red cedar or Douglas fir. Six trees were removed — based on their size, six replacement trees are required for each removed tree. Five trees (all Excelsa Cedars) will be planted at the site where the trees were removed. This leaves 31 replacement trees that cannot be planted at the site and therefore will be compensated at the agreed rate of $85.00 per tree. This fee goes into the City's tree replacement fund and will be used to plant trees in the shoreline as opportunities arise. In addition to the tree replacement payment, there is a fee of $110.25 for the shoreline tree removal permit (my April 22, 2015 letter to Andrew Gross incorrectly stated the fee is $100.25). The City's permit fees can be found here: http://www.tukwilawa.gov/dcd/LandUsePermitFees.pdf. You may make one payment to the City and the receipt will break out the tree replacement contribution from the permit fee. Sent: Wednesday, May 13, 2015 1:47 PM To: Gross, Andrew Cc: Golden, Micheal; Durst, Gary Subject: I-405 SR 181 Replacement tree locations Andrew, 1 i I met Mike and Gary out on site this morning and we were able to identify 5 acceptable location on the edges of the stormwater BMP where tree plantings are possible. Because we can only plant trees on the edge of the site, and not within the flow lines of the BMP, I have had to select a tree with a narrow form. My goal is to match, as closely as we can, the character of the trees removed: evergreen natives. For these reasons I feel that the Excelsa cedar (Thuja plicata 'Excelsa') would be an appropriate choice; it grows to 35' height at maturity and attains a 10'-15' diameter so it won't block roadway signage or grow into the bridge deck in the future. I've attached a marked up plan sheet showing the approximate locations of the trees. The size and height of the trees at time of installation is listed below: Species Quantity Size Height Excelsa Cedar 5 #5 cont. 2' - 4' The benefit of planting the #5 container is that these trees will adapt and recover from the transplant shock much faster than a larger specimen. This means that the chance of survivability within the first few years will greatly be increased. Please let me know if I can provide any more information. The trees were removed during the process of determining how to repair a storm water drainage issue at this off -ramp. A permit file number of L15-0022 has been assigned to this project. In an email dated April 22, 2015, you provided an estimate for replacement trees at $85.00 based on the average cost for an eight -ten foot Western red cedar or Douglas fir. Six trees were removed — based on their size, six replacement trees are required for each removed tree. You are still exploring whether any trees can be planted at the site — since WSDOT initially provided a landscape plan for this area when construction work was carried out at the off -ramp and planted six trees, I hope that it will be possible to replace some of the removed trees on -site. For any trees that are not planted at the off - ramp, WSDOT will pay into the City's tree replacement fund. In addition to the tree replacement payment, I don't believe we talked about the permit fee - there is a fee of $100.25 for the shoreline tree removal permit. I will attach the application — you only need to fill out the first page, and if there will be trees planted on site, specify the number and location. I have calculated what WSDOT believes it is responsible for mitigation. Please let me know if we are on the same page and we will move forward with a payment. Six planted conifers (within the 8"-20" dbh range) were cut down within the city of Tukwila's shoreline jurisdiction. Additional volunteer big leaf maples were also cut down but were located within the limits of the BMP. However, these trees were not counted in the calculation for the mitigation tree fund as they should have not been allowed to become established within the flow lines of the stormwater BMP. The original planting plan included 4 Douglas firs and 2 western red cedars. Using the city of Tukwila's Shoreline Tree removal requirements, WSDOT is responsible for the cost of 36 trees (6 trees for every cut tree). Based on tree prices provided by landscape and the calculation provided by the city, we would owe $85/tree x 36 = $3,060. The $85/tree is an average cost for a 8'-10' Western red cedar or Douglas -fir at 3 Pacific NW wholesale nurseries (cost were comparable between both species). I will have landscape take a look at the site next week with the maintenance crews to see if there are locations suitable for replanting a few conifers back on site. If so, that number will be reduced from 36 tree cost total provided. Sounds like we can bay by credit card. Is it possible to have a bill sent to the address below? There is a USGS gauging station near there, so WSDOT and King County were notified. To investigate the damage, WSDOT took the trees out. Here is the initial assessment from PW staff: "You may already be aware of this but in my field review this afternoon near the Fort Dent/Interurban intersection I noted a retaining wall collapse and significant undermining of the USGS gauging station on the south edge of the Green River (SW corner of Ft. Dent and IU). If we haven't already alerted the appropriate contacts at DOT, King County Flood District, USACE and/or USGS we probably should do that. It looks like DOT may have a failed drainage system on the SW corner of the intersection and the runoff from the off ramp is running under the jersey barrier and taking a portion of the bridge abutment away as it makes its way down the slope to the river. It doesn't currently look like an imminent failure situation but with a couple more large winter storms without appropriate attention it could turn into a real problem." By the time I was able to get out to look at the site, the trees were already down. Regardless, I don't think we have much control over what WSDOT does in their limited access ROW, unfortunately. I understand that as a result of drainage issues at the 1-405 on/off ramp at Interurban Avenue, a number of trees were removed adjacent to the off ramp. These trees were located in the shoreline jurisdiction of the Green River and as such are regulated under the City's Shoreline Master Program. Under the City's Shoreline Master Program regulations, the removed trees must be replaced - if you are not the right person to talk to about this issue, I would appreciate it if you would put me in touch with the correct person so we can discuss replacement of the removed trees. It appears they took a sledge hammer approach and just took every tree out when they might have been able to save some of them. It appears that a catch basin failed at the end of the ramp allowing storm runoff to flow down the steep slope and damage a USGS gauging station and a WSDOT retaining wall. WSDOT crews responded and later that day they apparently cut down the trees. I am not sure why they did this. I reported this issue to Carol Lumb and Sandra Whiting. I have not heard anything back from WSDOT on this. On a separate note, a large amount of erosion was observed on the east bank of the Green River just below of the SB I- 405 bridge. It appears they have a failing drainage structure on the highway causing water to flow down the steep slope and into the river. This was due to the recently felled trees obscuring visual access. The masonry landscaping blocks appear to be dislocated from the upper wall at the base of the gauge, and the lower wall at the edge of the trail is tilting from the vertical. I would suggest the slope may need to be reconstructed, after the drainage issues are corrected. I assume the tree cutting is somehow related to the noted slope damages? Dent and IU). If we haven't already alerted the appropriate contacts at DOT, King County Flood District, USACE and/or USGS we probably should do that. It looks like DOT may have a failed drainage system on the SW corner of the intersection and the runoff from the off ramp is running under the jersey barrier and taking a portion of the bridge abutment away as it makes its way down the slope to the river. It doesn't currently look like an imminent failure situation but with a couple more large winter storms without appropriate attention it could turn into a real problem.
