Decision on Substantive Permit: The City Community Development Director has determined that the application
for a Shoreline Substantial Development Permit does comply with applicable City and state code requirements
and has approved the application based on the findings and conclusions contained in the staff report.
The Decision on this Permit Application is a Type 2 decision pursuant to Tukwila Municipal Code
§18.104.010. Other land use applications related to this project may still be pending.
III. YOUR APPEAL RIGHTS
One administrative appeal to the Shorelines Hearings Board of the Decision is permitted. Any person
appealing to the Shorelines Hearings Board may raise certain SEPA issues as part of the appeal to the
Shorelines Hearings Board. Appellants should consult the rules and procedures of the Shorelines Hearings
Board for details.
IV. PROCEDURES AND TIME FOR APPEALING
The requirements and procedures for appeals to the Shorelines Hearings Board are set forth in RCW 90.58
and WAC 461.08.
V. INSPECTION OF INFORMATION ON THE APPLICATION
Project materials including the application, any staff reports, and other studies related to the Shoreline
Substantial Development Permit are available for inspection at the Tukwila Department of Community
Development, 6300 Southcenter Blvd., Suite 100, Tukwila, Washington 98188 from Monday through Friday

Property owners affected by this decision may request a change in valuation for their property tax purposes.

I. SUMMARY OF PROPOSED ACTION
Request for a shoreline substantial development permit to pave 4,811 sq. ft. of an existing gravel access

III. PROJECT DESCRIPTION
The proposed project intends to pave 4,811 sq. ft. of an existing gravel access road that extends from
the existing parking lot. This access road was first built by the Army Corps of Engineers for levee
maintenance and repairs, but has been informally used as a parking lot circulation roadway for church
members. The maintenance road was not built to accommodate high volumes of traffic and regular
use. As a result of the traffic, the road has needed maintenance work to maintain a drivable condition.

The pavement is necessary to strengthen the road to accommodate the current levels of vehicle traffic
using the parking lot.
The other aspect of this project is a pedestrian ramp that connects the Green River Trail to the
northwest corner of the parking lot. The ramp is 7' wide and would be built on the landward side of the
levee and extend beyond the toe of the levee sloping down to the parking lot. The ramp ends in the
parking lot by abutting a Flood Protection Levee Easement (see attachment A for descriptions and a
map of existing easements). The ramp will create access to the trail where none exists currently.
Figure 1 shows the subject parcel, highlighted in yellow; Figure 2 shows the project sites.

IV. TUKWILA SHORELINE MASTER PROGRAM - BACKGROUND
The City of Tukwila adopted a Shoreline Master Program (SMP) on August 15, 2011 which was
approved by the Washington State (Department of Ecology on October 14, 2011 and became effective
October 28, 2011. This project is subject to the Shoreline Master Program.
A. Shoreline Environment Designation
The shoreline environment designation for the site is Urban Conservancy; the purpose of the Urban
Conservancy Environment is to protect ecological functions where they exist in urban and
developed settings, and restore ecological functions where they have been previously degraded,
while allowing a variety of compatible uses.
The shoreline buffer in the Urban Conservancy environment is 125 feet when the river bank is
fortified with a levee (Figure 3). However, the Urban Conservancy buffer on this parcel is not a
consistent 125' all along the river. Because the levee has been rebuilt, the buffer has been reduced,
in places, to the landward toe of the levee per TMC 18.44.050 (D.2) (see attachment B for the
existing location of the buffer and attachment A for the easement agreements). This buffer width is
consistent with that established by the City's Sensitive Areas Ordinance for Type 2 streams that
support salmonid use, which is based on Best Available Science.

The final buffer widths adopted by the City and approved by Ecology for each shoreline
environment attempted to balance shoreline ecological function needs, human life and property
protection needs (including future levee repair/reconstruction), existing land use patterns, and
state and federal agency policies.

The following section discusses the Shoreline Master Program goals and policies as they relate to
this project, excerpted from Chapter 6 of the City's SMP.
Goal 5.3 Land Development and Economic Vitality:
Goal: Development along the shoreline that fosters the economic vitality of Tukwila while preserving
the long-term benefits of the river.
• Policy 5.3.7: Tukwila Urban Center Development Policy: Design and locate shoreline
development in the Tukwila Urban Center to encourage water enjoyment uses that:
• Support public access to and along the shoreline;
• Provide water -enjoyment uses as transitions between the river and non -water dependent
uses;
• Etc.
Response: The proposed ramp would provide another access point to the Green River Trail where none
currently exists. The Green River Trail provides a water -enjoyment use that serves as a transition to
adjacent non -water dependent uses. This policy is designed to support and increase public access to
the shoreline. The policy supports the notion that access points to the shoreline, like the non -
motorized ramp, should be encouraged and available to the public.
Goal 5.6 Access and Recreational Use
Goal: Increase the amount and diversity of opportunities for public recreation and access to and along
the river, including visual and cultural access, access to the water's edge, opportunities for small boat
navigation and access, and connections to other neighborhoods, consistent with the shoreline
character.
• Policy 5.6.4: Design, locate and manage public access for diverse types and variable levels of
intensity in order to minimize impacts on vulnerable features of the natural environment and to
minimize conflicts with private property uses.
• Policy 5.6.5: Where shoreline development provides public access areas, reserve such areas for
use by the public through the means most appropriate for the type, scale and impacts of the
development, such as dedication, donation or sale of an easement or right-of-way to the City.
• Policy 5.6.11: Improve pedestrian connections between the river, Green River Trail and the
Urban Center's commercial, office and residential uses.
Response: This shoreline development builds a ramp to the Green River Trail that will be used by the
Church membership. The ramp will increase the number of connections from the Green River Trail to
the Tukwila Urban Center north of the ramp. The ramp will require a separate building permit and shall
meet ADA requirements.
Goal 5.9 Natural Environment and Habitat Use
Goal: Restored, enhanced and protected natural environment resources along the river, including
trees, wildlife habitat and features with value for long-term public, scientific and educational uses.

Response: This goal supports the notion that development in Shoreline Environments should strive to
enhance the natural environment along the river and consider the wide range of uses and value within
the Shoreline jurisdiction. This goal is consistent with mitigation and landscaping requirements set
forth in TMC 18.44 Shoreline Overlay.
V. SHORELINE REGULATIONS
TMC 18.44.130 (B.3) Administration states that a substantial development permit shall be granted only
when the development proposed is consistent with the Shoreline Master Program (SMP). The relevant
SMP goals and policies were discussed above. This site is located in an area that is both inside and
outside of the Urban Conservancy Environment Buffer. Because of the reconstruction of the levee, the
buffer has been reduced, in places, to the landward toe of the levee per TMC 18.44.050 (D.2) (see
attachment B for existing location of the buffer and attachment A for the easement agreements). The
ramp phase of this project is located inside the buffer and the access road is located outside of the
buffer. The ramp and the paving will be reviewed according to the underlying Shoreline Environment
designation for each project site.
TMC 18.44.050 Permitted Uses
The proposed ramp is considered a "public and/or private promenade, footpath or trail" and is
permitted per TMC 18.44.050 (B.1) for development within the Urban Conservancy Environment
Buffer. Because the access road is used for vehicular circulation within a parking lot, the paving of the
road is considered an expansion of a parking lot and subject to the Development Standards per TMC
18.44.070.
TMC 18.44.070 Off Street Parking and Loading Requirements
In addition to the parking requirements in TMC 18.56, the following requirements apply to all
development in the shoreline jurisdiction.
1. Any parking, loading, or storage facilities located between the river and any building must
incorporate additional landscaping in accordance with the Vegetation Protection and Landscaping
Section, or berming or other site planning or design techniques to reduce visual and/or environmental
impacts from the parking areas. utilizing the following screening techniques:
a. A solid evergreen screen of trees and shrubs a minimum of six feet high; or
b. Decorative fence a maximum of six feet high with landscaping. Chain Zink fence, where
allowed, shall be vinyl coated and landscaped with native trailing vine or an approved non-native vine
other than ivy, except where a security or safety hazard may exist; or
c. Earth berms at a minimum of four feet high, planted with native plants in accordance with
the Vegetation Protection and Landscaping Section.
Response: The paving of the access road is considered an expansion of the parking lot because of its
function as vehicular circulation within the lot. Additionally, this paving occurs between the Green

River Trail and the existing building. Because the Trail is elevated by the levee slightly above the church
property, landscaping is the most appropriate means of reducing visual and environmental impacts
from parking areas. This requirement establishes the need for a landscaping plan that will be subject to
the landscaping requirements of this particular Shoreline Environment for screening parking areas.
2. Where a parking area is located in the shoreline jurisdiction and adjacent to a public access
feature, the parking area shall be screened by a vegetative screen or a built structure that runs the entire
length of the parking area adjacent to the amenity. The landscape screening shall comply with the
Vegetation Protection and Landscaping Section.
Response: The proposed paved access road will be screened by additional native landscaping as shown
in Attachment B: Landscaping Plan.
3. Where public access to or along the shoreline exists or is proposed, parking areas shall provide
pedestrian access from the parking area to the shoreline.
Response: No public access is proposed.
4. Parking facilities, loading areas and paved areas shall incorporate low impact development
techniques wherever feasible, adequate storm water retention areas, oil/water separators and
biofiltration swales, or other treatment techniques and shall comply with the standards and practices
formally adopted by the City of Tukwila Public Works Department.
Response: The paved access road complies with Public Works standards and practices. Public Works
had no comments regarding low -impact development nor stormwater management at the time of
review.
TMC 18.44.080 C.3. Landscaping Requirements for the Urban Conservancy Environment — Outside of
the River Buffer
Landscaping requirements for projects that pave parking areas in this shoreline jurisdiction is
addressed in TMC 18.44.080 (C.3.b) Interior Parking Lot Landscaping: Every 300 square feet of paved
surface requires 10 square feet of interior landscaping within landscape islands separated by no more
than 150 feet between islands.
Response: This requirement applies to the square footage of the added pavement and provides the
minimum requirement for the amount of landscaping needed. A landscaping plan has been drafted for
this project and complies with the landscaping requirements set by TMC 18.44.080 (C.3.b). The new
landscaping does not interfere with access to the levee or public access to the shoreline and is not
located within any easements. The size of the planting required is relative to the size of the proposed
paving and mitigates the impact of the additional paving by screening the parking lot from the Green
River Trail and increasing the amount of vegetation in the shoreline.

TMC 18.44.100 Public Access
A. Applicability.
1. Public access shall be provided on all property that abuts the Green/Duwamish River
shoreline in accordance with this section as further discussed below where any of the following
conditions are present:
a. Where a development or use will create increased demand for public access to the
shoreline, the development or use shall provide public access to mitigate this impact. For the purposes
of this section, an "increase in demand for public access" is determined by evaluating whether the
development reflects an increase in the land use intensity (for example converting a warehouse to office
or retail use), or a significant increase in the square footage of an existing building. A significant increase
is defined as an increase of 3,000 square feet.
Response: The proposed paved access drive and pedestrian ramp do not constitute an increase in
demand for public access as there are no changes or expansions proposed for the existing building, nor
is there a change of use.
b. Where a development or use will interfere with an existing public access way, the
development or use shall provide public access to mitigate this impact. Impacts to public access may
include blocking access or discouraging use of existing on -site or nearby accesses.
Response: There is an existing public trail on the subject property. The applicant's proposal will not limit
nor interfere with the trail or existing public access from adjacent properties.
c. Where a use or development will interfere with a public use of lands or waters subject to
the public trust doctrine, the development shall provide public access to mitigate this impact.
Response: The proposal will not interfere with public use of land or waters as the proposed development
will take place on private property outside of the existing easements. As stated above, the proposal does
not limit access to the existing public trail.
d. Where the development is proposed by a public entity or on public lands.
Response: Not applicable as the applicant is a private entity and the land is privately owned.
e. Where identified on the Shoreline Public Access Map.
Response: Not applicable. The subject site is not identified on the Shoreline Public Access Map.
f. Where a land division of five or greater lots, or a residential project of five or greater
residential units, is proposed.
Response: Not applicable. Land division nor residential development is not proposed.

2. For the purposes of this section, an "increase in demand for public access" is determined by
evaluating whether the development reflects an increase in the land use intensity, for example
converting a warehouse to office or retail use, or a significant increase in the square footage of an
existing building. A significant increase is defined as an increase of 3,000 square feet. The extent of
public access required will be proportional to the amount of increase in the demand for public access.
For smaller projects, the Director will review the intent of this section and the scope of the project to
determine a reasonable amount of public access to be carried out. Depending on the amount of
increase, the project may utilize the alternative provisions for meeting public access in TMC Section
18.44.100(F). The terms and conditions of TMC Sections 18.44.100(A) and (B) shall be deemed satisfied
if the applicant and the City agree upon a master trail plan providing for public paths and trails within a
parcel or group of parcels.
Response: The proposed paved access drive and pedestrian ramp to do constitute an increase in
demand for public access as there are no changes or expansions proposed for the existing building, nor
is there a change of use. The ramp will meet ADA requirements (Attachment C). Additional work on the
site and/or site expansions will likely trigger public access requirements.
3. The provisions of this section do not apply to the following:
a. Short plats of four or fewer lots;
Response: Not applicable. The proposal does not include a short plat.
b. Where providing such access would cause unavoidable health or safety hazards;
Response: No unavoidable health or safety hazards have been identified.
c. Where providing such access would create inherent and unavoidable security problems;
or
Response: No inherent and unavoidable security problems have been identified.
d. Where providing such access would cause significant ecological impacts that cannot be
mitigated. An applicant claiming an exemption under items 3(b) - (d) above must comply with the
procedures in TMC Section 18.44.100(F).
Response: No ecological impacts that cannot be mitigated have been identified.
TMC 18.44.110 Shoreline Design Guidelines
Per TMC 18.44.110 the project is subject to the Shoreline Design Guidelines. Design guidelines include:

1. (A.1) Relationship of Structure to Site: The proposed ramp is located in the northwest corner of
the parking lot and displaces three parking spaces. According to the conditional use permit staff
report, the church has approximately 241 parking spaces on site and 733 fixed seats. Based on
the number of fixed seats, the church is required to provide 183 parking stalls. The Toss of the
parking spaces due to the ramp is minimal and the available parking is still well above the
required minimum. The ramp connects the Green River Trail to an existing maintenance levee
which connects to Sperry Dr. Giving the public access to the ramp is a very small impact on the
property because the ramp is located far from the building and isolated in the northwest corner
of the parking lot.
2. (A.2) Building Design: There are no buildings associated with this proposal.
3. (A.3) Design of Public Access: The proposed ramp will create a new connection to the Green
River Trail. The existing nearby public connections are located approximately 570 feet to the
northwest where the sidewalk from 180th St extends to the Trail and to the northeast
approximately 1/3 of a mile along the river and connects to a public parking lot. Requiring
public furniture and additional landscaping for the ramp is not applicable due to the type,
location, and size of development.
VI. COMMENTS
A Notice of Application was distributed to nearby residents, property owners, and applicable agencies
on July 6th, 2015. The Notice of Application was also posted on the project site.
The King County Flood Control Zone District (KCFCD) commented during the public comment period.
Their comment expressed concern that this project would be considered a modification to an existing
federal levee and a written determination from the Army Corp of Engineers would be needed to
ensure that these modifications would not adversely affect the functions of the levee.
Response: The City of Tukwila has reached out to the Army Corp of Engineers for a written
determination on the proposal. However, there has been no letter received as of May 2016. The
applicant is responsible for obtaining any state or federal permits required for the construction of the
ramp.
They also stated a preference for the pedestrian ramp to be accessible for levee maintenance
equipment. The comment requested that no plantings or excavation occur within the levee easement
areas.
Response: The proposed ramp is 7' wide and does not serve the needs of equipment access. However,
there is an existing vehicle access ramp on an adjacent property to the northeast. This ramp to the
north is gravel and accessible through a vacant property by a levee access easement. No excavation or
plantings in the easements are part of this proposal, as shown in the Landscaping Plan (Attachment B).

They also stipulated that this work should not include any excavation along the 'landward toe of the
existing levee, or encroachment into the existing levee slope itself. I assume your ensured this
stipulation.
Response: The proposed ramp and paving would only add fill to the landward side of the levee and
easement areas.
The Muckleshoot Indian Tribe also commented on the proposal. They inquired about the proposed
mitigation for locating the project in the shoreline jurisdiction and permanently precluding any
opportunity to plant native trees in the paved area. They pointed to the adopted Shoreline Master
Program that notes the need for restoration in the lower Green River to improve riparian functions and
support salmon habitat. They also stated that tall trees are needed to provide shade to the river based
on the river's aspect in this location and provided shade maps from the King County Food District's
System Wide Improvement Framework (SWIF).
Response: The applicant will add landscaping outside the existing easements to help screen the new
paved access road, see Attachment B. The levee profile and easements limit area for planting. The
landscaping, as proposed, meets TMC 18.44.08(C)(3) requirements.
They also expressed concern over the possibility of restricting access to the shoreline and impacts to
the Tribal members' fishing access. "The Muckleshoot Tribal fishing access is protected under federal
treaties with the United States government. Tribal members cannot be restricted from accessing their
fishing sites under these treaties. As part of this protection, the applicant should be noticed that tribal
members will likely be using the ramp, Green River trail, and other adjacent areas to access their
fishing site as needed without restrictions."
Response: There is an existing public trail along the property and the proposed project does not restrict
access to the shoreline and does not impact Tribal members' fishing access. The criteria for an
exemption from providing public access are met under TMC 18.44.100 (A), as the proposed ramp and
paving project do not trigger the thresholds for providing public access. The ramp will meet ADA
requirements (Attachment C). Additional work on the site and/or site expansions will likely trigger
public access requirements in the future. The Muckleshoot Tribe's comments regarding fishing access
have been shared with the applicant, as have the other comments outlined in this report.
VII. SEPA
SEPA was not triggered as part of this proposed development.
VIII. CONCLUSIONS
1. The proposal does not interfere with access to the shoreline and only increases the number of ways
the public can access the shoreline.
2. The proposal does not interfere with the ability to maintain and repair the existing levee.

3. The 4,811 sq. ft of paving is considered an expansion of the existing parking lot and is therefore
subject to landscaping requirements set forth in TMC 18.44.080 (C.3.b).
4. The proposed ramp meets ADA requirements and requires a separate building permit.
S. The applicant shall obtain any necessary state or federal permits that pertain to this project.
6. The project is consistent with the economic development, shoreline design quality, access and
recreational use, historical resource use and archaeological protection, and natural environment
and habitat use goals and policies of the Shoreline Master Program.

Dear Mr. Phan:
On June 1, 2016, we received notice that the City of Tukwila approved your application for an
SDP. Your permit is to pave 4,811 square feet of an existing gravel access road and add
additional landscaping to screen the road, as well as to construct a new non -motorized, ADA-
compliant ramp that connects the Green River Trail to the existing church parking lot. This work
will occur within the Urban Conservancy environment designation of Green River.
By law, local governments must review all SDPs for compliance with:
• The Shoreline Management Act (Chapter 90.58 RCW).
• Ecology's SDP approval criteria (Chapter 173-27-150 WAC).
• The City of Tukwila Local Shoreline Master Program.
Local governments, after reviewing SDPs for compliance, are required to submit them to
Ecology. We have received your approved SDP.
What Happens Next?
Before you begin activities authorized by this permit, the law requires you wait at least 21 days
from June 1, 2016, the "date of filing." This waiting period allows anyone (including you) who
disagrees with any aspect of this permit to appeal the decision to the state Shorelines Hearings
Board (SHB). You must wait for the conclusion of an appeal before you can begin the activities
authorized by this permit.
The SHB will notify you by letter if they receive an appeal. We recommend you contact the SHB
before you begin permit activities to ensure no appeal has been received. You may reach them at
(360) 664-9160 or http://www.eluho.wa.gov/Board/SHB.

The project proposes to construct a pedestrian ramp on fill, and to pave portions of a landward levee inspection access
area within a Flood Protection Levee Easement (#20101004002883) area jointly reserved to Tukwila and the King County
Flood Control Zone District (KCFCD). Portions of the work are also proposed within King County's earlier River Protection
Easement (#5769890). King County, through the KCFCD, provides maintenance for the levee here, under the terms of an
Inter -local Agreement with Tukwila.

These site improvements will constitute modifications to an existing federal levee, for which Tukwila serves as the local
sponsor. As such, it is incumbent on Tukwila to obtain a written determination from the Seattle District Engineer, United
States Army Corp of Engineers, that these modifications will not adversely affect the flood protection function of the
levee.
Please provide us with a copy of that determination once it has been issued, so that we can keep our records up to date.
While we have previously reserved an maintenance access corridor and easement to the levee adjoining the area
currently shown for ramp construction, the current pedestrian ramp will be limited to a 9 foot width and an alignment
that would not serve our equipment access needs. While we would certainly prefer that a constructed ramp here
provide improved levee maintenance access as well, we have no direct objection to the pedestrian ramp as proposed at
this time.
Similarly, we have no direct objection to paving a portion of the landward levee toe inspection access area as
proposed. However we would stipulate that this work should not include any excavation along the landward toe of the
existing levee, or encroachment into the existing levee slope itself.
In addition, we are requesting that you insure that no plantings of shrubs, bushes, or trees be allowed within the levee
easement areas under this application as well, consistent with the terms of the easement(s).

We are reviewing the City's proposal to pave part of an existing gravel driveway and construct a pedestrian ramp at
6801 S 180th Street in Tukwila along the Tukwila 205 levee area. From the materials we received with the Notice of
Application, we have a question about access to this new driveway and pedestrian path. Does the City or the King
County Flood Control District intend to place lock bollards or any other built facility to restrict access at this location?
We need this information to determine if there are any potential impacts to Muckleshoot Tribal members' fishing
access.
What is the City's proposed mitigation for locating these facilities within the regulated shoreline and permanently
precluding any opportunity to plant native trees in these locations? As noted in the City's Shoreline Master Programs,
the lower Green River is in need of restoration along many areas to restore riparian functions and support salmon
habitat.
We appreciate the opportunity to review this proposal and look forward to the City's responses. We may have
comments subsequently.

Project Description and Analysis
The project is proposing an access driveway along the toe of the levee and a ramp connecting from the
parking lot to the existing pedestrian path along the river. The project is located at 6801 S. 180th Street,
approximately 250 feet south of the intersection of S. 180th Street and Sperry Drive South. Access is
from via Sperry Drive South.
PERMITTED USES
Shoreline Residential Environment: Proposed driveway and ramp construction are within the 200 feet
from OHWM. It's approximately 84 feet and 50 feet away from OHWM. At 84 feet and 50 feet from
OHWM, construction for driveway and ramp will not impact any river bank or water.
Urban Conservancy Environment: Proposed driveway and ramp construction are 84 feet and 50 feet away
from OHWM and less than 125 feet from urban conservancy environment buffer. But it's along the toe of
the levee trail which will not impact any environmental concerns.
High Intensity Environment: Proposed driveway and ramp construction are 84 feet and 50 feet from
OHWM and less than 100 feet from high intensity environment buffer. But it's along the toe of the levee
trail which will not impact any environmental concerns.
Aquatic Environment: The project is proposing to use sheet flowing for surface water onto grass.
Shoreline Residential Environment Development Standards: The proposed project meets shoreline
