Dear Mr. Doak,
This letter is in response to your boundary line adjustment application (L15-0045) and combination,
single-family building permit (D15-0196) for the above referenced parcels dated August 3, 2015. The
subject parcels are located in the Low Density Residential (LDR) zone. As listed in Tukwila Municipal
Code (TMC) 18.10, the minimum lot size in the LDR zone is 6,500 square feet. The boundary line
adjustment, as proposed, will combine two-3,000 square foot Tots to create one-6,000 square foot lot.
This lot does not meet the LDR minimum lot square footage requirement.
Pursuant to TMC 18.70.030, a variance is required before the lot can be developed. At this time, the
Department of Community Development has not received a variance application for the subject lots.
As such, the Department of Community Development cannot accept your boundary line adjustment
application nor the building permit application until a variance is granted for the subject parcels. The
fees for the above referenced applications will be refunded to you. Upon issuance of a variance for the
subject parcels, you may submit an application for a boundary line adjustment and subsequent
development of the property. There is no certainty or assurance that a variance will be granted.
Variances shall meet the criteria as listed in TMC 18.72. A variance application is enclosed.
APPEALS
This decision may be appealed to the Hearing Examiner. If there are no valid appeals filed within the
time limit the decision of the Department will be final.
In order to appeal the decision, a written notice of appeal must be filed with the Department of
Community Development within fourteen days of the issuance of the decision. The requirements for
such appeal are set forth in the Tukwila Municipal Code 18.116.
Appeal materials shall include:
1. The name of the appealing party.
2. The address and phone number of the appealing party; and if the appealing party is a
corporation, association or other group, the address and phone number of a contact person
authorized to receive notices on the appealing party's behalf.
3. A statement identifying the decision being appealed and the alleged errors in that decision. The
Notice of Appeal shall state specific errors of fact or errors in application of the law in the
decision being appealed; the harm suffered or anticipated by the appellant, and the relief
sought. The scope of an appeal shall be limited to matter or issues raised in the Notice of
Appeal.
4. Appeal fee per the current fee schedule, additional hourly charges may apply. In addition all
hearing examiner costs will be passed through to the appellant.
The Hearing Examiner's decision on the appeal is the City's final decision. A party who is not satisfied
with the outcome of the administrative appeal process may file an appeal in King County Superior
Court from the Hearing Examiner's decision pursuant to the procedures and time limitations set forth
in RCW Chapter 36.70C.
