I. PROJECT INFORMATION Project File Number: L15-0047 Applicant: Gregg Berwin for Westfield/Southcenter Mall Type of Permit Applied for: Landscape Modification Permit Project Description: Landscape improvements related to tenant improvements. Modification of existing perimeter landscaping along Tukwila Parkway, existing interior parking lot planter island, and adding landscaping to screen a blank wall and bowling pin structure. Location: 2531 Southcenter Mall, Tukwila, WA 98188 Tax Parcel # 9202470010 Associated Files: NA Comprehensive Plan Designation/Zoning District: II. BACKGROUND Tukwila Urban Center/ Tukwila Urban Center —Regional Center (TUC -RC) Round 1 is a tenant in the Southcenter Mall, located at 2531 Southcenter Mall. As part of Round 1's tenant improvements, a bowling pin sculpture will be placed on the southwest corner of the site (see Attachment C: Site Map). To ensure that the sculpture is not discernible from the right-of-way, specifically from Tukwila Parkway to the north side of the site, the applicant has proposed landscape modifications to provide enhanced screening. As shown in Attachment B: Aerial Showing Potential Sight Line to Bowling Pin, there are existing trees planted along Tukwila Parkway which provide some screening. There is also an interior parking island planter which provides some screening. The applicant has proposed to plant additional trees and shrubs in three locations — along Tukwila Parkway and a parking lot drive aisle, in an existing parking lot planter island, and a newly landscaped area on the north side of the building — within the sight line to provide additional screening. Staff Discussion The subject site is located in the Tukwila Urban Center— Regional Center (TUC -RC) zone. In June 2014 the City of Tukwila adopted a subarea plan for the urban center, which includes this site. Under the new regulations the TUC Zone is broken down into smaller subzones with different uses and standards. The structures, including landscaping on the subject site were built in accordance with Zoning Code, prior to adoption of the Tukwila Urban Center Subarea Plan. Pursuant to TMC 18.70.090(A), the proposed landscape modifications do not need to be brought into compliance with the new TUC code (TMC 18.28) as the there is no change of use or alteration of the structure requiring design review as part of this proposal. However additional landscaping improvements are required to adequately screen the bowling pin so that it is not discernible from the streetscape. Additionally the landscaping that is in place was installed to meet the requirements of as listed in TMC 18.52 — Landscape, Recreation, Recycling/Solid Waste Space Requirements. General Landscape and Screening Requirements The proposed landscape modifications meet the general landscape and screening requirements as listed in TMC 18.52.04. As shown in Attachment A: Landscaping Plans, the applicant plans to plant a combination of evergreen and deciduous trees and shrubs that are well adapted to the conditions of the Puget Sound Region. The site will be prepared with fertilizers and other soils amendments, and will be maintained to remove dead plants and weeds, ensure plants are in healthy condition, and inspect the irrigation system during the drier months of May through September to ensure the landscaping is receiving adequate water. The proposed landscape modifications will provide additional screening of the parking lot and bowling pin sculpture. The landscaping will not obstruct view from or into driveways, sidewalks, or streets, and allows for surveillance from streets and buildings. Perimeter Landscaping Requirements The proposed landscape modifications along Tukwila Parkway and a parking lot drive aisle, approximately 820 lineal feet, meet the perimeter landscaping requirements as listed in TMC 18.52.030(A) (see Attachment A, Sheet 1 of 3). Pursuant to 18.52.020, perimeter landscaping in the TUC zone shall meet the requirements of Type 1 landscaping, which includes one tree for each 30 lineal feet and one shrub for each 7 lineal feet of required perimeter excluding curb cuts, and living groundcover to cover 90% of the Iandlscape areas within three years. The applicant proposes to remove three trees with an 8"-12" caliper and plant 10 Autumn Purple Ash trees. Autumn Purple Ash irees are deciduous, fast growing trees with a heavy canopy which will provide additional screening from ihe sight line from Tukwila Parkway to the sculpture. The applicant proposes to plant ten additional shrubs — four 'Morning Light' Miscanthus, deciduous, fast growing shrubs, and six 'Otto Luyken' Laurel, fast growing evergreen shrubs commonly used for landscape screening. There are no changes proposed to the size of the planting strip along Tukwila Parkway. The proposed additional trees and shrubs meet the requirements based on number of plants per lineal feet. The existing perimeter landscaping meets the living groundcover requirement. Interior Parking Lot Landscaping Requirements The proposed landscape modifications to the interior parking lot island planter and along the north side of the building meet the requirements as listed in TMC 18.52.035.3 and 18.52.035.4 (see Attachment A, Sheet 2/3 of 3). The existing parking island planter is approximately 2,850 square feet. The applicant proposes no changes to the size of the planter. The applicant proposes to plant an additional 356 shrubs, including deciduous and evergreen varieties commonly used for screening. The applicant has also proposed planting 'Wickwar Flame' Heather groundcover. A new landscaped area with new irrigation will be installed on the north side of the building (Attachment A, Sheet 3 of 3). This area was required to be landscaped as part of design review approval for SeaFood City, but the landscaping did not thrive and there is currently no landscaping in this area. This will include three trees — Hicks Yew, evergreen trees commonly used to create hedges, and fourteen Sweetbox evergreen shrubs. The new landscaping will provide additional screening of a blank building wall. III. DECISION SEPA Determination: The City's SEPA Responsible Official has previously determined that this application does not require a SEPA threshold determination because it is categorically exempt. Decision on Substantive Permit: The Community Development Director has determined that the application for a Landscape Modification Permit does comply with applicable City and state code requirements and has approved that application, subject to any conditions which are set forth in the Decision below: 1. Make the following changes to the Landscape Plans: a. Remove the addition of gypsum as an amendment from the details (Landscape Specifications #12 on Sheet 2 of 3). Gypsum is an unnecessary addition to the planting soil under these conditions and with the proposed plant species unless a previous soil test indicated a very low pH on the site. b. Planting pit should be 3-times the root ball width. (Attachment A, Sheet 3 of 3, Details #2) c. Remove burlap from top 2/3 of rootball. Do not peel back. (Attachment A, Sheet 3 of 3, Details #4) 2. Tree planting may be deferred to the fall to ensure plant survivability. IV. YOUR APPEAL RIGHTS The Decision on this Permit Application is a Type 1 decision pursuant to Tukwila Municipal Code §18.104.010. Other land use applications related to this project may still be pending. No administrative appeal of a DNS or an EIS is permitted. One administrative appeal to the City Hearing Examiner of the Decision on the Permit itself is permitted. A party who is not satisfied with the outcome of the administrative appeal process may file an appeal in King County Superior Court from the Board of Architectural Review decision. V. PROCEDURES AND TIME FOR APPEALING In order to appeal the Planning Supervisor's decision on the Permit Application, a written notice of appeal must be filed with the Department of Community Development within 14 days of the issuance of this Decision. The requirements for such appeals are set forth in Tukwila Municipal Code 18.116. All appeal materials shall be submitted to the Department of Community Development. The name of the appealing party. 2. The address and phone number of the appealing party; and if the appealing party is a corporation, association or other group, the address and phone number of a contact person authorized to receive notices on the appealing party's behalf. 3. A statement identifying the decision being appealed and the alleged errors in the decision, including any specific challenge to an MDNS. 4. The Notice of Appeal shall identify (a) the specific errors of fact or errors in application of the law in the decision being appealed; (b) the harm suffered or anticipated by the appellant, and (c) the relief sought. The scope of an appeal shall be limited to matters or issues raised in the Notice of Appeal. 5. Appeal fee per the current fee schedule, additional hourly charges may apply. In addition all hearing examiner costs will be passed through to the appellant. VI. APPEAL HEARINGS PROCESS Any administrative appeal regarding the Permit shall be conducted as an open record hearing before the Hearing Examiner based on information presented to the Planning Supervisor, who made the original decision. No new evidence or testimony will be permitted during the appeal hearing. Parties will be allowed to present oral argument based on the information presented to the Planning Supervisor before their decision was issued. The Hearing Examiner's decision on the appeal is the City's final decision. Any party wishing to challenge the Hearing Examiner's decision on this application must file an appeal pursuant to the procedures and time limitations set forth in RCW 36.70C. If no appeal of the Hearing Examiner's decision is properly filed in Superior Court within such time limit, the Decision on this permit will be final. VII. INSPECTION OF INFORMATION ON THE APPLICATION Project materials including the application, any staff reports, and other studies related to the permits are available for inspection at the Tukwila Department of Community Development, 6300 Southcenter Blvd., Suite 100, Tukwila, Washington 98188 from Monday through Friday between 8:30 a.m. and 5:00 p.m. The project planner is Laura Benjamin, who may be contacted at 206-433-7166 for further information. The plan currently shows mostly deciduous trees.. They will provide little in the way of screening for six months of the year. Autumn ash tend to drop leaves early. An evergreen (broad leaf or conifer) should be considered. Additionally, understory evergreen shrubs along Tukwila Parkway should be incorporated into the plans to further .erix of the thirteen trees proposed are upright/columnar varieties. Again, this will provide only minimal screening as compared to other tree choices. If this columnar choice was dictated by the narrowness of the existing island strip to minimize traffic damage to the branches, then more density of trees would /provide better screening. Backfill soil should not be amended separately (Landscape Spec #11) but should be of the existing amended soil. Soil consistency should be uniform to a depth of 12inches throughout the island planting bed. (This is too much fertilizer. Excessive high nitrogen fertilizer will result in insect problems (particularly on Fraxinus and maple) heavy above ground growth and weak root systems. Do not use fish fertilizer AND incorporated commercial fertilizer AND osmocote AND tablets. Plants will not be able to take all of this p while available and it will runoff into parking lots/storm drains. Please amend details. Use medium bark chip or wood chips rather than fine bark. Fine chips reduces air in the soil, breakdowns down quickly and can form an impermeable crust to water infiltration. ,Pre -emergent herbicide applied in December will not be effective and runoff. 9ndscape Spec #19 — If landscape is installed in the fall (as is proposed) then minimal maintenance will e required during the 60 day period. Please detail proposed maintenance after this 60 day period. 18" spacing for Calluna groundcover is wide. I talked with Westfield's Development Director, Gregg Berwin, about your concerns last week and he informed me that he spoke with Nora about this issue. Gregg gave me a really good recommendation. He recommended that I have someone walk along the Right of Way / street sidewalk and take periodic photographs looking toward our entrance and send them to your office. So we did that today and the resulting images are included in a PDF. As you'll see, at a couple locations the bowling pin sculpture is visible. The entry doors and pin are not hardly visible from the majority of the viewpoints. I doubt the pin will be very discernible at these few spots because of: a) distance from the ROW to the entrance, b) the amount of landscaping and parked cars throughout the site, and c) views from moving vehicles. Compared to the 1-2 still images, when someone is driving by in a moving vehicle the bowling pin will be somewhat visible but not discernible. It's extremely unfortunate that we are having these discussions 10 days before we plan to open. Our plans (which included the 17' tall pin sculpture) were submitted at the beginning of June 2014. We never received one comment from the city or Westfiled, our landlord, that the pin was going to be an issue. So to hear that the City is considering not allowing the pin at all has floored us and our owners are in disbelief. I'll be flying into Seattle tomorrow. I spoke with Minnie and I'm scheduled to meet with her and hopefully you at the city at 3:OOp PST. I don't know if you understand this but Westfield is shocked because they are very excited about Round 1 as a new tenant and are eager about the architectural improvements we've made to the building. The bowling pin element is a requirement of Round 1's lease and has been approved by Westfield from the beginning. I wanted to follow up the call with the attached which is a sight line study from Tukwila Parkway to the proposed Round 1 Bowling Pin. What we are proposing is that the bowling pin be moved to the right side of Round 1's front door (it had been on the left side) so it's further away from the public right -a -way and that Westfield infill the bare areas along Tukwila Parkway with landscaping to further block any sight lines to the bowling pin from the public right -a -way. I think the key here is that the bowling pin would now be even further from the public right -a -way and landscaping will be added to those areas along Tukwila Parkway where the landscaping is bare so the bowling pin is not clearly discernable from any portion of Tukwila Parkway and therefore not subject to the sign code. I'm hoping that you look at the bowling pin in the same respect as the Round 1 signs that got approved by the City recently, in that the Round 1 sign on the western portion of the building above their entryway is not clearly discernable from the public right -a -way because of angle and distance and because it is not facing the street, so the City is allowing a smaller Round 1 sign to be placed on the north facade which is definitely discernable from the public right -a -way. I think the proposed bowling pin on the west side of the building can follow this same logic even more so given it is on the ground which makes it even less discernable from the public right -a -way than the Round 1 sign near the top of the west side of the building. I would completely understand the City not approving a bowling pin along the north side of the building because it is clearly discernable from the public right -a -way. Please reach out to me to discuss this matter further after your review. I'm hoping Round 1 can obtain approval of the bowling pin in this new location with a condition that Westfield infill the bare areas with landscaping so the bowling pin is not clearly discernable from the public right -a -way and therefore is not subject to the sign code.
