DECISION SEPA Determination: The City SEPA Responsible Official has previously determined that this application does not require a SEPA threshold determination because it is categorically exempt. Decision on Substantive Permit: The Community Development Department has determined that the application for a Type 2 Wireless Communications Facility does comply with applicable City and state code requirements and has approved that application. YOUR APPEAL RIGHTS The Decision on this Permit Application is a Type 2 decision pursuant to Tukwila Municipal Code §18.104.010. Other land use applications related to this project may still be pending. No administrative appeal of a DNS or an EIS is permitted. One administrative appeal to the City Hearing Examiner of the Decision on the Permit itself is permitted. If an MDNS was issued, any person wishing to challenge either the conditions which were imposed by the MDNS decision or the failure of the Department to impose additional conditions in the MDNS must raise such issues as part of the appeal to the Hearing Examiner. A party who is not satisfied with the outcome of the Hearing Examiner appeal process may file an appeal in King County Superior Court from the Hearing Examiner's decision. IV. PROCEDURES AND TIME FOR APPEALING In order to appeal the Community Development Director decision on the Permit Application, a written notice of appeal must be filed with the Department of Community Development within 14 days of the issuance of this decision. The requirements for such appeals are set forth in Tukwila Municipal Code ch. 18.116. All appeal materials shall be submitted to the Department of Community Development. Appeal materials MUST include: 1. The name of the appealing party. 2. The address and phone number of the appealing party; and if the appealing party is a corporation, association or other group, the address and phone number of a contact person authorized to receive notices on the appealing party's behalf. 3. A statement identifying the decision being appealed and the alleged errors in the decision, including any specific challenge to an MDNS. 4. The Notice of Appeal shall identify (a) the specific errors of fact or errors in application of the law in the decision being appealed; (b) the harm suffered or anticipated by the appellant, and (c) the relief sought. The scope of an appeal shall be limited to matters or issues raised in the Notice of Appeal. 5. Appeal fee of $591 plus retainer. V. APPEAL HEARINGS PROCESS Page 2 of 3 09/10/2015 Any administrative appeal regarding the Permit shall be conducted as a closed record hearing before the Hearing Examiner based on the information presented to the Community Development Director, who made the original decision. No new evidence or testimony will be permitted during the appeal hearing. Parties will be allowed to present oral argument based on the information presented to the Community Development Director before their decision was issued. The Hearing Examiner's decision on the appeal is the City's final decision. Any party wishing to challenge the Hearing Examiner's decision on this application must file an appeal pursuant to the procedures and time limitations set forth in RCW ch. 36.70C. An appeal challenging a DNS, an MDNS or an EIS may be included in such an appeal. If no appeal of the Hearing Examiner's decision is properly filed in Superior Court within such time limit, the Decision on this permit will be final. The City's decision to issue a DNS, an MDNS or an EIS is final for this permit and any other pending permit applications for the development of the subject property. VI. INSPECTION OF INFORMATION ON THE APPLICATION Project materials including the application, any staff reports, and other studies related to the permits are available for inspection at the Tukwila Department of Community Development, 6300 Southcenter Blvd., Suite 100, Tukwila, Washington 98188 from Monday through Friday between 8:30 a.m. and 5:00 p.m. The project planner is Laura Benjamin, who may be contacted at 206-433-7166 or via email at laura.benjamin@tukwilawa.gov for further information. Electrical permits issued through the City of Tukwila will be required for service alteration for any other electrical service work that is anticipated but not noted on the plans, per article 85.12 (B), Washington electrical code. Public Works permit is required for the antenna replacement work. Building permit is not required for scope of work stated on the submitted plans. Exempt High Density Residential (HDR) High Density Residential (HDR) Laura Benjamin, Assistant Planner Project Plans for Permit L15-0050 FINDINGS Vicinity/Site Information Project Description The applicant is requesting to replace three (3) existing antennas with three (3) new panel antennas and their ancillary equipment on a utility pole co -located wireless facility. The new antennas will not exceed the height of the existing pole and the project is categorically exempt from SEPA [RCW 43.21C.0384(1)(a)]. No ground disturbance or expansion of the existing compound is proposed. Existing Development This facility is preexisting. Surrounding Land Uses The property is zoned HDR. Surrounding properties are zoned Medium Density Residential (MDR) to the south, and Low Density Residential (LDR) to the north, east, and west. Background In 2006, the City adopted a Wireless Facilities Chapter (TMC 18.71) to the Zoning Code. The chapter provides specific location and design requirements for the placement of WCF within the City of Tukwila. The WCF being modified is preexisting. The facility was originally approved through a Conditional Use Permit (L03-002) in 2003. Location Selection Tukwila Municipal Code (TMC) provides a hierarchy of appropriate locations within the City. Generally, co - locations and utilizing existing structures are favored over the development of new standalone WCF within the City. Design Standards The City provides specific design standards for the placement of WCF within the City of Tukwila. The table below indicates if the applicant's proposal complies with required standards. As demonstrated in Tables 1 and 2, the project meets all applicable development standards for a Type 2 WCF. 3. The proposed modifications will not alter the surrounding land uses in terms of traffic and pedestrian circulation, building or site design. 4. The proposed project is in keeping with the goals and policies of the Comprehensive Land Use Policy Plan. RECOMMENDATIONS The recommendation to the Director of Community Development is to approve this application for a Type 2 Wireless Telecommunications Facility permit as applied for by Ryka Consulting on behalf of T-Mobile with no conditions. INFORMATIONAL ITEMS 1. A City of Tukwila electrical permit is required for service alteration. 2. A City of Tukwila Public Works permit is required for the antenna replacement work. 3. It is also an authorization for city staff to enter the property. If there is particular language on the form that needs to be amended we can have the city attorney review it. Materials board for screening is referring to samples of the material used for equipment enclosure screening. If your proposal does not include any alteration of the ground mounted equipment enclosure then this does not apply. Type 2 application does not require items listed under Type 2 review. I should be able to provide the materials that you have referenced here. Both of my projects in the City of Tukwila should meet the requirements set by 6409, as they both only involve the swapping of antennas of similar size. I do have a question about three of the items required: The affidavit of ownership will be difficult to get and it is a little unusual for this to be a requirement for a project like this, as there is typically lease language that gives the carrier's associates the right to enter the property. Would a copy of the lease suffice? Does the "materials board for the screening" refer to just a piece of poster board or something like that? If you could clarify what this is, that would be very helpful. Do minor modifications such as these require all of the public notice materials? It's not under the Type 2 review, but has its own section on the application, so I thought that I should clarify this also. 1 Thanks for all of your help!! Also, if you think that the proposal qualifies for review under Section 6409 of the Spectrum Act please provide information sufficient to determine whether the proposed change constitutes a substantial change or not. If it is not a substantial change then it could be processed expeditiously as required by the Spectrum Act. A substantial change as established by FCC rules is: Substantial Change. A proposed facilities modification will substantially change the physical dimensions of an eligible support structure if it meets any of the following criteria: a. For towers other than towers in the public rights -of -way, it increases the height of the tower by more than 10% or by the height of one additional antenna array with separation from the nearest existing antenna not to exceed 20 feet, whichever is greater; for other eligible support structures, it increases the height of the structure by more than 10% or more than 10 feet, whichever is greater. Changes in height should be measured from the original support structure in cases where deployments are or will be separated horizontally, such as on buildings' rooftops; in other circumstances, changes in height should be measured from the dimensions of the tower or base station, inclusive of originally approved appurtenances and any modifications that were approved prior to the passage of the Spectrum Act. b. For towers other than towers in the public rights -of -way, it involves adding an appurtenance to the body of the tower that would protrude from the edge of the tower more than 20 feet, or more than the width of the tower structure at the level of the appurtenance, whichever is greater; for other eligible support structures, it involves adding an appurtenance to the body of the structure that would protrude from the edge of the structure by more than 6 feet. 2 c. For any eligible support structure, it involves installation of more than the standard number of new equipment cabinets for the technology involved, but not to exceed 4 cabinets; or, for towers in the public rights -of -way and base stations, it involves installation of any new equipment cabinets on the ground if there are no pre-existing ground cabinets associated with the structure, or else involves installation of ground cabinets that are more than 10% larger in height or overall volume than any other ground cabinets associated with the structure. d. I have attached a draft copy of the plans which includes the address and parcel on the first page, with elevation drawings on the fifth page. As you can see, the antenna count will remain the same but the new antennas will extend above the tip of the pole itself, though the pole itself will not be altered. My colleague tells me that such an increase in overall height might trigger some extra permitting requirements. Could you please confirm if this is indeed the case, in this instance? And if so, what are the extra requirements (perhaps a CUP amendment or something like that)? Thanks for your help. Let me know if you have any questions. There will be no increase in tower height or any ground disturbance. Review Process The property is zoned HDR. Per conversations with Planning Department this project is to go through a WCF Permit Process (Type 1). The original T-Mobile facility was first approved under permit number L03-040 in 2003. The proposed modifications will be in conformance with the previous Conditional Use Permit. Additionally, this project will not result in a significant change in visual impact and will not increase the overall height of the facility. Design and Development Standards T-Mobile's proposal is in compliance with all applicable design and development standards. According to WCF Section 18.58 as follows: The following are general requirements for all Wireless Communication Facilities: 1. Noise — Any facility that requires a generator or other device which will create noise must demonstrate compliance with TMC Chapter 8.22, "Noise". A noise report, prepared by an acoustical engineer, shall be submitted with any application to construct and operate a wireless communication facility that will have a generator or similar device. The City may require that the report be reviewed by a third party expert at the expense of the applicant. T-MOBILE is not proposing a generator. 2. Business license requirement — Any person, corporation or entity that operates a wireless communication facility within the City shall have a valid business license issued annually by the City. Any person, corporation or other business entity which owns a tower also is required to obtain a business license on an annual basis. T-Mobile has a City Business License. SUS — 0000 l tp3C1 3. Signage — Only safety signs or those mandated by other government entities may be located on wireless communication facilities. No other types of signs are permitted on wireless communication facilities. T-Mobile is not proposing any new signage. 4. Parking — Any application must demonstrate that there is sufficient space for temporary parking for regular maintenance of the proposed facility. Parking is not affected by T-MOBILE's proposed modification. 5. Finish — A tower shall either maintain a galvanized steel finish or, subject to any applicable standards of the FAA or FCC, be painted a neutral color so as to reduce its visual obtrusiveness. No change to the existing tower color is proposed. 6. Design — The design of all buildings and ancillary structures shall use materials, colors, textures, screening and landscaping that will blend the tower facilities with the natural setting and built environment. T-MOBILE is not proposing a new building or structure. 7. Color — All antennas and ancillary facilities located on buildings or structures other than towers shall be of a neutral color that is identical to or closely compatible with the color of the supporting structure so as to make the antenna and ancillary facilities as visually unobtrusive as possible. This is an existing wireless facility. No change to the existing tower color is being proposed. 8. Lighting — Towers shall not be artificially lighted unless required by the FAA, FCC or other applicable authority. If lighting is required, the reviewing authority shall review the lighting alternatives and approve the design that would cause the least disturbance to the surrounding areas. No strobe lighting of any type is permitted on any tower. T-MOBILE is not proposing any new lighting. 9. Advertising — No advertising is permitted at wireless communication facility sites or on any ancillary structure or facilities equipment compound. T-MOBILE is not proposing any advertising at this existing wireless facility. 11. Equipment Enclosure — Each applicant shall be limited to an equipment enclosure of 360 square feet at each site. However, this restriction shall not apply to enclosures located within an existing commercial, industrial, residential or institutional building. T-MOBILE is not proposing to exceed more than 360 square feet at this existing wireless facility location. 18.58.130 Tower -Specific Development Standards: 1. Height — Any proposed tower with antennas shall meet the height standards of the zoning district where the tower will be located. This is an existing wireless facility. No increase to existing tower height is proposed. 2. Antenna and tower aesthetics — The applicant shall utilize a wireless communication concealed facility. The choice of concealing the wireless communication facility must be consistent with the overall use of the site. For example, having a tower appear like a flagpole would not be consistent if there are no buildings on the site. If a flag or other wind device is attached to the pole, it must be appropriate in scale to the size and diameter of the tower. This is an existing wireless facility. This project will not result in a significant change in visual impact and will not increase the overall height of the facility. 3. Setbacks — The proposed wireless communication facilities must meet the setbacks of the underlying -zoning district. If an exception is granted under TMC Section 18.58.180 with regards to height, the setback of the proposed wireless communication facilities will increase 2 feet for every foot in excess of the maximum permitted height in the zoning district. This is an existing wireless facility. This project will not result in a significant change in visual impact and will not increase the overall height of the facility. 4. Color — The color of the tower shall be based on the surrounding land uses. This is an existing wireless facility. No change to the existing tower color is being proposed. 5. Feed lines and coaxial cables — All feed lines and cables must be located within the tower. Feed lines and cables connecting the tower to the equipment enclosure, which are not located within the wireless communication facility equipment compound, must be located underground. The City prefers the use of concealed building mounted facilities in lieu of non -concealed facilities. However, in some cases using a non -concealed facility may allow a wireless facility to blend with the environment. An applicant may request to use a non -concealed facility and will be evaluated under the following criteria: The coaxial cables are routed within the existing steel pole. No change to existing. 1. An applicant for a wireless communication facility can demonstrate that placing the facility on certain portions of a property will provide better screening and aesthetic considerations than provided under the existing setback requirements; or 2. The modification will aid in retaining open space and trees on the site; or 3. The proposed location allows for the wireless communication facility to be located a greater distance from residentially -zoned (LDR, MDR, and HDR) properties. This is an existing wireless facility. This project will not result in a significant change in visual impact and will not increase the overall height of the facility. 18.58.150: Landscaping/Screening. A. The visual impacts of wireless communication facilities may be mitigated and softened through landscaping or other screening materials at the base of the tower, facility equipment compound, equipment enclosures and ancillary structures, with the exception of wireless communication facilities located on transmission towers, or if the antenna is mounted flush on an existing building, or camouflaged as part of the building and other equipment is housed inside an existing structure. The DCD Director, Director of Public Works or Planning Commission, as appropriate, may reduce or waive the standards for those sides of the wireless communication facility that are not in public view, when a combination of existing vegetation, topography, walls, decorative fences or other features achieve the same degree of screening as the required landscaping; in locations where the visual impact of the tower would be minimal; and in those locations where large wooded lots and natural growth around the property perimeter may be sufficient buffer. B. Landscaping shall be installed on the outside of fences. Existing vegetation shall be preserved to the maximum extent practicable and may be used as a substitute for or as a supplement to landscaping or screening requirements. The following requirements apply: 1. Screening landscaping shall be placed around the perimeter of the equipment cabinet enclosure, except that a maximum 10-foot portion of the fence may remain without landscaping in order to provide access to the enclosure. 2. The landscaping area shall be a minimum of 5 feet in width around the perimeter of the enclosure. 3. The applicant shall utilize evergreens that shall be a minimum of 6 feet tall at the time of planting. 4. Applicant shall utilize irrigation or an approved maintenance schedule that will insure that the plantings are established after two years from the date of planting. C. The applicant shall replace any unhealthy or dead plant materials in conformance with the approved landscaping development proposal, and shall maintain all landscape materials for the life of the facility. In the event that landscaping is not maintained at the required level, the Director, after giving 30 days advance written notice, may maintain or establish the landscaping at the expense of the owner or operator and bill the owner or operator for such costs until such costs are paid in full. This is an existing wireless facility and no change in the existing landscaping is being proposed. T-MOBILE's project will not include the removal ofany existing vegetation. 18.58.160 Zoning Setback Exceptions: A. Generally, wireless communication facilities placed on private property must meet setbacks of the underlying zoning. However, in some circumstances, allowing modifications to setbacks may better achieve the goal of this Chapter of concealing such facilities from view. B. The Director or Hearing Examiner, depending on the type of application, may permit modifications to be made to setbacks when: 1. An applicant for a wireless communication facility can demonstrate that placing the facility on certain portions of a property will provide better screening and aesthetic considerations than provided under the existing setback requirements; or 2. The modification will aid in retaining open space and trees on the site; or 3. The proposed location allows for the wireless communication facility to be located a greater distance from residentially -zoned (LDR, MDR, and HDR) properties. C. This zoning setback modification cannot be used to waive/modify any required setback required under the State Building Code or Fire Code. This is an existing wireless facility and T-MOBILE will continue to meet the setbacks of the underlying zoning. 18.58.170 Height Waivers: Where the Hearing Examiner finds that extraordinary hardships, practical difficulties, or unnecessary and unreasonable expense would result from strict compliance with the height limitations of the Zoning Code, or the purpose of these regulations may be served to a greater extent by an alternative proposal, it may approve a height waiver to these regulations; provided that the applicant demonstrates that the waiver(s) will substantially secure the values, objectives, standards, and requirements of this Chapter, TMC Title 18, and the Comprehensive Land Use Plan, and demonstrate the following: 1. The granting of the height waiver will not be detrimental to the public safety, health or welfare, or injurious to other property, and will promote the public interest; and 2. A particular and identifiable hardship exists or a specific circumstance warrants the granting of a waiver. Factors to be considered in determining the existence of a hardship shall include, but not be limited to: a. Topography and other site features; b. Availability of alternative site locations; c. Geographic location of property; and d. Size/magnitude of project being evaluated and availability of co -location. B. In approving the waiver request, the Hearing Examiner may impose such conditions as it deems appropriate to substantially secure the objectives of the values, objectives, standards and requirements of this Chapter, TMC Title 18, and the Comprehensive Land Use Plan. C. A petition for any such waiver shall be submitted, in writing, by the applicant with the application for Hearing Examiner review. The petition shall state fully the grounds for the waiver and all of the facts relied upon by the applicant. This is an existing wireless facility.
