II. DECISION
SEPA Determination: The City SEPA Responsible Official has determined that this application does
not require a SEPA threshold determination because it is categorically exempt.
Decision on Substantive Permit: The Community Development Director has determined that the Special
Permission Application does comply with applicable City and state code requirements and has approved the
application with no conditions.

III. YOUR APPEAL RIGHTS
The Decision on this Permit Application is a Type 2 decision pursuant to Tukwila Municipal Code
§ 18.104.010. Other land use applications related to this project may still be pending.
No administrative appeal of a DNS or an EIS is permitted. One administrative appeal to the Hearing
Examiner of the Decision on the Permit itself is permitted.
A party who is not satisfied with the outcome of the administrative appeal process may file an appeal in King
County Superior Court from the Hearing Examiner decision.
IV. PROCEDURES AND TIME FOR APPEALING
In order to appeal the Community Development Director's decision on the Permit Application, a written
notice of appeal must be filed with the Department of Community Development within 14-days of the
issuance of this Decision; that is, by November16, 2014.
The requirements for such appeals are set forth in Tukwila Municipal Code 18.116. All appeal materials
shall be submitted to the Department of Community Development. Appeal materials MUST include:
1. The name of the appealing party.
2. The address and phone number of the appealing party; and if the appealing party is a corporation,
association or other group, the address and phone number of a contact person authorized to receive
notices on the appealing party's behalf.
3. A statement identifying the decision being appealed and the alleged errors in the decision, including
any specific challenge to an MDNS.
4. The Notice of Appeal shall identify (a) the specific errors of fact or errors in application of the law in
the decision being appealed; (b) the harm suffered or anticipated by the appellant, and (c) the relief
sought. The scope of an appeal shall be limited to matters or issues raised in the Notice of Appeal.
5. Appeal fee per the current fee schedule, additional hourly charges may apply.. In addition all hearing
examiner costs will be passed through to the appellant.
V. APPEAL HEARINGS PROCESS
Any administrative appeal regarding the Permit shall be conducted as an open record hearing before the
Hearing Examiner based on the testimony and documentary evidence presented at the open record
hearing. The Hearing Examiner decision on the appeal is the City's final decision.
Any party wishing to challenge the Hearing Examiner decision on this application must file an appeal
pursuant to the procedures and time limitations set forth in RCW 36.70C. An appeal challenging a DNS,
an MDNS or an EIS may be included in such an appeal. If no appeal of the Hearing Examiner decision is
properly filed in Superior Court within such time limit, the Decision on this permit will be final.

The City's decision to issue a DNS, an MDNS or an EIS is final for this permit and any other pending
permit applications for the development of the subject property.
VI. INSPECTION OF INFORMATION ON THE APPLICATION

FINDINGS
Project Description
This project is a request to allow the extension of a telephone and fiber optic line to using a directional bore within the
gravel shoulder on the northerly pavement edge of S. 134th P1. and across the street to connect with the existing customer
2" conduit in the access driveway for 4501 S. 134th Pl. The bore will align with horizontal limits of the asphalt access road
through the buffer and run over the culvert conveying Southgate Creek under the access road off of S. 134th Pl.
Decision Criteria
TMC 18.45.070 B. 5. states that essential utilities may be permitted in sensitive areas, subject to approval by the Director
of the Department. The criteria are identified in italics followed by the staff response.

its buffer;

Response: The directional bore is proposed within the buffer and above the culvert conveying Southgate Creek.
There will be no intrusion into the free flowing portion of the stream and the project will be above the water table.
The bore pits will be restored to their original condition.
b. Essential utilities must be designed to protect the sensitive area and its buffer against erosion, uncontrolled storm
water, restriction of groundwater movement, slides, pollution, habitat disturbance, any loss of flood carrying
capacity and storage capacity, and excavation or fill detrimental to the environment;
Response: As noted above, there will be minimal disturbance to the buffer area and the bore pits, which are
across the street from the creek and will be restored to their original condition.
c. Upon completion of installation of essential utilities, sensitive areas and their buffers must restored to pre -project
configuration, replanted as required and provided with maintenance care until newly planted vegetation is
established. In addition, mitigation to offset impacts to sensitive areas and mitigation ratios of this chapter.
Response: Typically, as a condition of approval for work in a sensitive area buffer, mitigation such as tree
planting would be required. In this case, a recent building permit (D13-219) for the new commercial building at
4501 S 1.34' Pl. required several site improvements and buffer mitigation along the southerly margin of the Right
of Way. Mitigation work has been conducted and shall not be disturbed as part of this work.
d. All crossings must be designed for shared facilities in order to minimize adverse impacts and reduce the number
of crossings.
Response: Not applicable.
CONCLUSIONS
1. The project has demonstrated that it complies with requirements to minimize or avoid disturbance to the sensitive
area and its buffer, protect the sensitive area from erosion and other disturbances during construction, and restore
the area to pre -project configuration upon completion.
RECOMMENDATION
Approve the extension of telephone and fiber optic lines using a directional bore on the NW side of S 134th Pl. and across
the street, over the culvert that runs under the access driveway for 4501 S. 134`h Pl, to connect with existing conduit.

We are asking for Administrative Review and Approval under 18.45.070, B., 5. Essential Utilities as
allowed in the Tukwila Municipal Code.
Approval is necessary to extend telephone and fiber optic to 4501 S134th Place, a commercial building
nearing completion on the site.
The permit for this building is D13-219. Part of the requirements under this permit were to widen the
existing access road and install curb and sidewalk on the westerly side of the access road, and to
provide buffer mitigation for the unnamed stream which is within the southerly margin of the ROW for
S. 134th Place. Prior to installing the side walk the developer provided conduit for gas, telephone and
cable TV under the sidewalk and across the drive way . Gas was recently extended to the building under
separate ROW permit.
Approval under 18.45.070, B., 5 is necessary because the buffer of the unnamed stream extends across
the paved section and gravel shoulder of S. 134th Place and also across the 30 foot wide paved driveway
that accesses the building at 4501 S. 134th Place. The stream crosses the driveway in a concrete incased
culvert.
The construction will take place mostly outside the northerly pavement edge of S 134th Place in the
gravel shoulder. It will consist of two bore pits, one 140 feet west of the centerline of the driveway of
4501 and one directly across from the center of the driveway, from this location we will bore under S
134th Place and above the culvert and intercept and existing conduit that extends to the building at
4501. Each bore pit will be 5' x 5'. The curb and sidewalk will buffer our construction from the buffer
mitigation area. The bore pits will be restored to their original condition.
There will be no intrusion into the free flowing portion of the stream, and based on the recent gas
installation bore pit at 4.5 feet deep we will be above the water table.
This single bore crossing will also enable us to serve the five other businesses in the buildings adjacent
4501 without the need for a separate ROW permit.
We ask for a waiver from a sensitive areas study as none of our proposed construction will be out of
improved areas.
Attached are the mitigation plan for the 4501 Building showing the site layout and adjacent buildings
and photos show our proposed bore bits and connection point to the existing conduit.
