Revise Note on Site Plan Sheet A3.0 to state that it is a requirement for antennas and ancillary equipment to be painted to match the existing structure. 2. A business license is required as listed in TMC 18.58.070(2). Corresponding building permit shall not be issued until business license is issued. INFORMATIONAL ITEMS 1. The applicant is required to install emergency shut -down switch for Fire Department use. This can be a condition of approval of the corresponding building permit, D15-0308. YOUR APPEAL RIGHTS The Decision on this Permit Application is a Type 2 decision pursuant to Tukwila Municipal Code §18.104.010. Other land use applications related to this project may still be pending. No administrative appeal of a DNS or an EIS is permitted. One administrative appeal to the City Hearing Examiner of the Decision on the Permit itself is permitted. If an MDNS was issued, any person wishing to challenge either the conditions which were imposed by the MDNS decision or the failure of the Department to impose additional conditions in the MDNS must raise such issues as part of the appeal to the Hearing Examiner. A party who is not satisfied with the outcome of the Hearing Examiner appeal process may file an appeal in King County Superior Court from the Hearing Examiner's decision. IV. PROCEDURES AND TIME FOR APPEALING In order to appeal the Community Development Director decision on the Permit Application, a written notice of appeal must be filed with the Department of Community Development within 14 days of the issuance of this decision. The requirements for such appeals are set forth in Tukwila Municipal Code ch. 18.116. All appeal materials shall be submitted to the Department of Community Development. Appeal materials MUST include: 1. The name of the appealing party. 2. The address and phone number of the appealing party` and if the appealing party is a corporation, association or other group, the address and phone number of a contact person authorized to receive notices on the appealing party's behalf. The scope of an appeal shall be limited to matters or issues raised in the Notice of Appeal. 5. Appeal fee of $602 plus retainer. V. APPEAL HEARINGS PROCESS Any administrative appeal regarding the Permit shall be conducted as a closed record hearing before the Hearing Examiner based on the information presented to the Community Development Director, who made the original decision. No new evidence or testimony will be permitted during the appeal hearing. Parties will be allowed to present oral argument based on the information presented to the Community Development Director before their decision was issued. The Hearing Examiner's decision on the appeal is the City's final decision. Any party wishing to challenge the Hearing Examiner's decision on this application must file an appeal pursuant to the procedures and time limitations set forth in RCW ch. 36.70C. An appeal challenging a DNS, an MDNS or an EIS may be included in such an appeal. If no appeal of the Hearing Examiner's decision is properly filed in Superior Court within such time limit, the Decision on this permit will be final. The City's decision to issue a DNS, an MDNS or an EIS is final for this permit and any other pending permit applications for the development of the subject property. VI. The project includes: • Removal of 2 existing panel antennas and addition of three new panel antennas. • Addition of 1 FRIG RRU radio. • Addition of 1 FXFC RRU radio. • Addition of cabinet equipment including 6 diplexers, 2 FSMF, 2 FBBC, and 1 ESMB. The existing non -concealed building mounted cellular facility extends beyond the roofline. The proposed modifications do not alter the existing height and is below the 85 foot maximum height without incentives in the TUC -RC. Existing Development This non -concealed building mounted wireless facility is located on the Legacy Southcenter Place, an office building located in the Southcenter (Tukwila Urban Center) area. Surrounding Land Uses The subject property is zoned TUC -RC. The surrounding parcels to the south and east are zoned Tukwila Urban Center — Pond (TUC-P). The property fronts Southcenter Parkway. To the west of Southcenter Parkway, the parcels are zoned Tukwila Urban Center — Commercial Corridor (TUC -CC). To the north, across Strander Boulevard, the properties are also zoned TUC -RC. BACKGROUND In 2006, the City adopted a Wireless Facilities Chapter (TMC 18.71) to the Zoning Code. The chapter provides specific location and design requirements for the placement of WCF within the City of Tukwila. The WCF being modified was originally approved by the City in 1998 (L98-0016) through a conditional use permit. In 1998 the WCF was approved for modifications (L98-0023) through a conditional use permit. In 2008 the WCF was approved for modifications (L08-047) through a Type 2 Wireless Facilities permit. Location Selection Tukwila Municipal Code (TMC) provides a hierarchy of appropriate locations within the City. Generally, co - locations and utilizing existing structures are favored over the development of new standalone WCF within the City. The table below indicates if the applicant's proposal complies with required standards. The proposed facility must meet the height requirements of the applicable zoning category. If the building where the facility is located is at or above the maximum height requirements, the antennas are permitted to extend a maximum of 3 feet above the existing roof line. The proposed modifications to the existing WCF will not significantly alter the conditions that currently exist and will not be materially detrimental to the public welfare or injurious to property or improvements in the vicinity. 2. As demonstrated in Tables 1 and 2, the project meets all applicable development standards for a Type 2 WCF. 3. The proposed modifications will not alter the surrounding land uses in terms of traffic and pedestrian circulation, building or site design. 4. The proposed project is in keeping with the goals and policies of the Comprehensive Land Use Policy Plan. RECOMMENDATIONS The recommendation to the Director of Community Development is to approve this application for a Type I Wireless Telecommunication Facility permit as applied for by Centerline Solutions for T-MOBILE with the following conditions: 1. This modification is exempt from SEPA per WAC 197-11-800 (25) (a)(i). The site does not include any sensitive areas per NWMaps.net and all equipment is on the roof. No generator is located at the site and none is proposed. The site is unscreened so a screening board is not applicable. The site is on a rooftop so a landscaping plan is not applicable. The following shall apply to all wireless communication facilities regardless of the type of facility: 1. Noise — Any facility that requires a generator or other device which will create noise must demonstrate compliance with TMC Chapter 8.22, "Noise". A noise report, prepared by an acoustical engineer, shall be submitted with any application to construct and operate a wireless communication facility that will have a generator or similar device. The City may require that the report be reviewed by a third party expert at the expense of the applicant. Applicant Response: This site does not include a generator and none is proposed. 2. Business license requirement — Any person, corporation or entity that operates a wireless communication facility within the City shall have a valid business license issued annually by the City. Any person, corporation or other business entity which owns a tower also is required to obtain a business license on an annual basis. Applicant Response: A business license application is pending. 3. Signage — Only safety signs or those mandated by other government entities may be located on wireless communication facilities. Advertising — No advertising is permitted at wireless communication facility sites or on any ancillary structure or facilities equipment compound. Applicant Response: There is no existing or proposed advertising. 10. Equipment Enclosure — Each applicant shall be limited to an equipment enclosure of 360 square feet at each site. However, this restriction shall not apply to enclosures located within an existing commercial, industrial, residential or institutional building. Applicant Response: The equipment is on the roof of a building, there is no Equipment Enclosure. 18.58.110 Non -concealed Building Mounted Development Requirements. The following requirements shall apply: 1. Height — The proposed facility must meet the height requirements of the applicable zoning category. If the building where the facility is located is at or above the maximum height requiirements, the antennas are permitted to extend a maximum of 3 feet above the existing roof line. Non -concealed building mounted facilities shall not qualify as "Rooftop Appurtenances" under TMC 18.50.080. Antenna aesthetics — The first preference for any proposed facility is to utilize flush -mounted antennas. AGL • Equipment Location- Adjacent to the antennas. • Other Antennas- There are 8 Verizon antennas and a microwave dish. Also, there are several satellite dishes. • Access- The only access to the site is through the locked door leading to the rooftop. • Study Reference Location- This study examines the power density environment at ground, rooftop, and penthouse levels from ALL sources of RF radiation, except for those antennas specifically excluded as described in the Introduction section. • Existing Signage- There are blue RF signs and a yellow RF guideline sign placed at the interior side of the door that leads to the rooftop of the building. Also, there are barriers with blue Notice signs around Verizon's antennas. Centerline Solutions, Inc. However, the areas on the rooftop and penthouse levels are considered to be controlled/occupational environments. Analysis: The analysis of the RF power density at this site indicates that emissions on the ground will not exceed the FCC's MPE limit for General Public environments. T-Mobile's contribution to the rooftop level exposures is calculated to be less than 28.2% of the FCC MPE limit for Occupational/Controlled environments. The rooftop level exposures near Verizon's Beta sector antennas are calculated to be less than 122.9% of the FCC MPE limit for Occupational/Controlled environments. However, Verizon has mitigated the risk of accidental exposure by placing barriers and RF signs. Conclusion and Recommendations: • The results of the analysis indicate that the power density levels at the ground will not exceed the FCC MPE General Population limit with the proposed antenna plan. • The results of the analysis indicate that the power density levels on the main building rooftop contributed by T-Mobile will not exceed the FCC MPE Occupational limit with the proposed antenna plan. • The results of the analysis indicate that the power density levels on the north penthouse (Penthouse 2) may exceed the FCC MPE Occupational limit with the proposed antenna plan. However, Penthouse 2 is not generally accessible. • Centerline Solutions recommends placing blue RF signs on the wall of the south penthouse (Penthouse 1), adjacent to the antennas of the Gamma sector. In addition, Centerline Solutions recommends placing yellow RF signs near the top of the roof and on each side of the north penthouse (Penthouse 2). See Exhibits 5 and 6 for recommended signage locations. • By taking the above mentioned recommended actions, this site will operate in general compliance with the FCC's OET Bulletin 65. This report also assesses the rooftop's compliance with FCC OET Bulletin 65; "Guidelines for Human Exposure to Radio -frequency Electromagnetic Fields". As part of this analysis, the site was visited on 11/17/2015 to perform a complete field survey. The purpose of the survey was to verify antennas located on the building rooftop and identify co -located wireless facilities. The power density simulation performed for this site utilized RoofView® analysis software. All antennas were assigned an operating frequency and transmit power and were deemed to be operating at 100% of their rated output power. The microwave dish antenna located on Verizon's Alpha sector and other satellite dishes were not included in the analysis, as their beamwidth is very narrow, and very little of their radiated energy is propagated to the rooftop level below the antenna. Page 13 of 18 Prepared for: T-Mobile, Site: SE04000B Appendix A: FCC Compliance and RF Safety Policies In August of 1997, the FCC published OET Bulletin 65 Edition 97-01 to regulate methods for evaluating compliance with FCC guidelines for human exposure to radiofrequency (RF) electromagnetic fields. The FCC guidelines for human exposure to RF electromagnetic fields incorporate two categories of limits; namely "Controlled" (a.k.a. Occupational) and "Uncontrolled" (a.k.a. General Public). The guidelines offer suggested methods for evaluating fixed RF transmitters to insure that the controlled and uncontrolled limits deemed safe by the FC for human exposure are not exceeded. OET Bulletin 65 recommended guidelines are intended to allow an applicant to "make a reasonably quick determination as to whether a proposed facility is in compliance with the limits." In addition, the guidelines offer alternate supplementary considerations and procedures such as field measurements and more detailed analysis that should be used for multiple emitter situations. These guidelines define RF as emissions in the frequency range of 300 kHz to 100 GHz. The FCC define Maximum Permissible Exposure (MPE) limits within this frequency range based on limits recommended by the National Council on Radiation Protection and Measurement, the Institute of Electrical and Electronics Engineers (IEEE), and by the American National Standards Institute (ANSI). Page 15 of 18 Prepared for: T-Mobile, Site: SE04000B Appendix B: Overview of RoofView® Functions and Assumptions RoofView® is a tool developed and supported by Richard Tell Associates, Inc. to be used for analysis of RF field levels at telecommunications sites produced by antennas of the type commonly used in cellular, paging, SMR, PCS and two-way radio communications services. Although its name suggests that the tool is only for use in evaluating emissions for roof top applications, it can also be used to evaluate ground level effects of tower facilities. RoofView® allows the user to apply near field, far field, or a combination of near and far field computational methods as desired by the user. For this analysis, near field computations are used for areas within the near field, and far field computations are used beyond the near field. Specific break points are dynamic based on the aperture of the antenna being analyzed. The near field methodology is based on a cylindrical model that assumes the power into an antenna is distributed as a cylinder around the aperture of the antenna. Research by Richard Tell Associates, Inc. found that using such a model, along with corrections for height and antenna pattern, is very accurate, if not slightly conservative in estimating RF exposure. FCC Bulletin 65 recognizes the use of the cylindrical model for near field calculations. The following picture and corresponding equation summarizes the computations used by RoofView® on a bin -by -bin basis when the near field method is used: S= 360P 0 BW 2nRh 3 dB Beam (degrees) - eBW Each bin's results are then also adjusted by spatially averaging the portion of a 6 foot tall human that intercepts the aperture over 6 feet. Once bins being analyzed fall outside of the near field (as determined by a method and variable that is user -selectable; see below for method and variable used in this analysis), a far -field spatial average is calculated. Spatially averaged power density in the far -field is calculated by reducing the spatially averaged power density inversely, by the square of the distance from the antenna(s). There are several input variables to RoofView® that can impact the results produced when evaluating specific cell sites.
