YOUR APPEAL RIGHTS The Decision on this Permit Application is a Type II decision pursuant to Tukwila Municipal Code § 18.104.010. Other land use applications related to this project may still be pending. No administrative appeal of a DNS or an EIS is permitted. One administrative appeal to the Hearing Examiner of the Decision on the Permit itself is permitted. If an MDNS was issued, any person wishing to challenge either the conditions which were imposed by the MDNS decision or the failure of the Department to impose additional conditions in the MDNS must raise such issues as part of the appeal to the Hearing Examiner. A party who is not satisfied with the outcome of the administrative appeal process may file an appeal in King County Superior Court from the Hearing Examiner decision. IV. PROCEDURES AND TIME FOR APPEALING In order to appeal the Community Development Director's decision on the Permit Application, a written notice of appeal must be filed with the Department of Community Development within 14-days of the issuance of this Decision, which is by February 3, 2016. The requirements for such appeals are set forth in Tukwila Municipal Code 18.116. All appeal materials shall be submitted to the Department of Community Development. Appeal materials MUST include: 1. The name of the appealing party. 2. The address and phone number of the appealing party; and if the appealing party is a corporation, association or other group, the address and phone number of a contact person authorized to receive notices on the appealing party's behalf. 3. A statement identifying the decision being appealed and the alleged errors in the decision, including any specific challenge to an MDNS. 4. The Notice of Appeal shall identify (a) the specific errors of fact or errors in application of the law in the decision being appealed; (b) the harm suffered or anticipated by the appellant, and (c) the relief sought. The scope of an appeal shall be limited to matters or issues raised in the Notice of Appeal. 5. Appeal fee per the current fee schedule, additional hourly charges may apply. In addition all hearing examiner costs will be passed through to the appellant. V. APPEAL HEARINGS PROCESS Any administrative appeal regarding the Permit shall be conducted as an open record hearing before the Hearing Examiner based on the testimony and documentary evidence presented at the open record hearing. The Hearing Examiner decision on the appeal is the City's final decision. Any party wishing to challenge the Hearing Examiner decision on this application must file an appeal pursuant to the procedures and time limitations set forth in RCW 36.70C. An appeal challenging a DNS, an MDNS or an EIS may be included in such an appeal. If no appeal of the Hearing Examiner decision is properly filed in Superior Court within such time limit, the Decision on this permit will be final. The project includes: • Replace three (3) existing HEX antennas with three (3) 8ft. low band antennas. • Add two (2) quad port antennas • Add four (4) FRLB, one (1) FRIG, one (1) FXFC, and four (4) diplexers. Existing Development The existing building is Located within a commercial, transit -oriented area. Surrounding Land Uses All surrounding developments are zoned TUC-TOD. The Green River lies to the east of the parcel but is not immediately adjacent to the site. The building nor the existing WCF are not visible from the Green River Trail. Background In 2006, the City adopted a Wireless Facilities Chapter (TMC 18.71) to the Zoning Code. The chapter provides specific location and design requirements for the placement of WCF within the City of Tukwila. Location Selection Tukwila Municipal Code (TMC) provides a hierarchy of appropriate locations within the City. Generally, co -locations and utilizing existing structures are favored over the development of new standalone WCF within the City. This decision does not require the use of any new facilities for placement of the new antennas. The proposal will increase the total number of antennas on the WCF, therefore, the project is not exempt per TMC 18.58.030. The proposed modifications are considered a Type 2 decision as the WCF is non -concealed and building attached within a commercial zone. Design Standards The City provides specific design standards for the placement of WCF within the City of Tukwila. The table below indicates if the applicant's proposal complies with required standards. The proposed project is in keeping with the goals and policies of the Comprehensive Land Use Policy Plan. RECOMMENDATIONS The recommendation to the Director of Community Development is to approve this application for a Type II Wireless Telecommunication Facility permit, as applied for by Lexcom Development Services on behalf of T-Mobile. The scope of work includes replacing three (3) existing HEX antennas with three (3) 8' low band antennas and tow (2) quad port antenna. Add 4 FRLB, 1 FRIG, 1 FXFC and 4 diplexers. The facility is on the rooftop with antenna and radio equipment paint to match the building. ELIGIBLE FACILITY REQUEST This project includes the collocation of new transmission equipment on an existing rooftop facility (antennas and radio units), and the replacement of transmission equipment (antenna model change). As such, it qualifies as an eligible facility request under Section 6409(a) of the Middle Class Tax Relief and Job Creation Act of 2012. Further, none of the scope of work exceeds the standards for a "substantial increase in size." The definition of "substantial increase in size" can be found in the Nationwide Programmatic Agreement for the Collocation of Wireless Antennas (47 C.F.R. Part 1, App. B), and has been adopted by the FCC for use in interpreting Section 6409. The thresholds are the greater of: • Height increases of more than 10% or 20 feet • Horizontal equipment protrusions of 20 feet or the width of the structure These standards are also recognized in state law, in the revision of SEPA to include these sorts of collocations in the list of exemptions. See RCW 43.21C.0384. SEC. 6409. WIRELESS FACILITIES DEPLOYMENT. (a) FACILITY MODIFICATIONS. (1) IN GENERAL. Notwithstanding section 704 of the Telecommunications Act of 1996 (Public Law 104- 104) or any other provision of law, a State or local government may not deny, and shall approve, any eligible facilities request for a modification of an existing wireless tower or base station that does not substantially change the physical dimensions of such tower or base station. (2) ELIGIBLE FACILITIES REQUEST. For purposes of this subsection, the term "eligible facilities request" means any request for modification of an existing wireless tower or base station that involves — (A) Collocation of new transmission equipment; (B) Removal of transmission equipment; or (C) Replacement of transmission equipment. (3) APPLICABILITY OF ENVIRONMENTAL LAWS. Nothing in paragraph (1) shall be construed to relieve the Commission from the requirements of the National Historic Preservation Act or the National Environmental Policy Act of 1969. LEONARD, PE (1925 — 2011) NON -IONIZING ELECTROMAGNETIC ANALYSIS OF THE RADIO FREQUENCY EXPOSURE ENVIRONMENT DUE TO THE MODIFIED T-MOBILE WIRELESS FACILITY S E04001 A "PARK EAST" ROOFTOP SITE 130 ANDOVER PARK E CITY OF TUKWILA KING COUNTY, WASHINGTON DECEMBER 2015 2 INTRODUCTION Hatfield & Dawson Consulting Engineers has been retained to evaluate the radio frequency (RF) exposure environment due to the modified T-Mobile personal wireless facility "PARK EAST", site designator SE04001A, for compliance with current Federal Communications Commission (FCC) guidelines regarding human exposure to RF electromagnetic fields (EMFs). BACKGROUND Information furnished by T-Mobile representatives indicates that the existing T-Mobile wireless facility will be modified by the removal of three (3) existing antennas and the installation of five (5) new antennas on the existing "unistrut" frames atop the project building at 130 Andover Park E, Tukwila, King County, Washington 98188. Construction drawings show all of the T-Mobile antennas mounted and centered approximately 50 feet above grade, and well above the nearest occupied space. Thus all of the T-Mobile antennas will be mounted well away from persons inside the project building, inside adjacent buildings, or standing anywhere at ground level. Building construction materials, which separate persons inside the project building from the T- Mobile antennas, will attenuate the wireless signals and reduce the interior RF exposure conditions. Therefore it is unlikely that anyone other than authorized workers could approach near enough to any of the T-Mobile antennas to cause that person's RF exposure to exceed FCC limits. Access to the project building roof appears to be restricted. It is unlikely that a casual visitor to the roof would dwell long enough in the vicinity of the T-Mobile antennas to cause that person's RF exposure to exceed FCC limits. However there may be certain rooftop locations where a person could stand too close to the active apertures and main beams of the T-Mobile antennas. These areas should be designated as "exclusion zones". Hatfield & Dawson Consulting Engineers 3 The modified wireless facility is expected to be compliant with FCC rules and guidelines regarding public RF exposure provided that direct access to the T-Mobile antennas is positively restricted by clearly demarcated and enforced rooftop exclusion zones. Persons standing on the roof outside of the exclusion zones will not be subjected to excessive RF exposure conditions due to the modified T-Mobile wireless operations. All of the T-Mobile antennas are highly directional in the vertical plane and they project the majority of the transmitted RF energy horizontally away from the project building, and well above all nearby habitable areas. Very little energy is directed downwards towards ground level or the nearest occupancies. Therefore RF exposure conditions within the project building below the roof deck, and on adjacent properties, due to the combined contributions from all of the T-Mobile antennas will be well below the FCC Public Maximum Permissible Exposure (MPE) limit exposure limit, and the limits given in King County code K.C.C. 21A.26.100 "NIER exposure standards." RF EXPOSURE CONDITIONS DUE TO MODIFIED FACILITY Ambient exposure conditions below the roof deck and in nearby areas are expected to be a fraction of the 100% FCC Public MPE limit. To verify that the modified T-Mobile facility will be in compliance with FCC and City rules regarding public exposure to RF fields, I have calculated the maximum power density and exposure condition likely to exist near ground level on the project site and on adjacent properties. The RF exposure analysis is based on information provided by T-Mobile representatives, and known characteristics of typical wireless facilities. The analysis provides a "worst -case" model for calculating maximum "uncontrolled" (i.e., general public) RF power densities and exposure conditions. Personal wireless and microwave facilities are required to comply with the FCC "Rules & Regulations" 47 CFR §1.1310, Radiofrequency radiation exposure limits. The exposure limits shown in the table titled "NIER Exposure Standards (1) (6)" in K.C.C. 21A.26.100 "NIER Hatfield & Dawson Consulting Engineers 4 exposure standards" are generally in agreement with FCC exposure guidelines and limits. In any case, since the FCC exposure limits supersede the limits shown in the aforementioned table, then compliance is determined by comparing RF field predictions with the general population/uncontrolled environment (i.e., "Public") Maximum Permissible Exposure (MPE) limits allowed by the FCC rules and guidelines, as specified in 47 CFR §1.1310. The FCC document Evaluating Compliance with FCC Guidelines for Human Exposure to Radiofrequency Electromagnetic Fields, OET Bulletin 65, August 1997, describes the methods established by the FCC for predicting compliance with the FCC -specified exposure limits. RF power densities and exposure levels are computed in accordance with methods described in OET Bulletin 65. The following formula derived from Equation 9 on page 21 of the bulletin has been used to calculate the power densities at specific locations: S(mW/cm2) = 0.36 x ERP (watts) / (Distance in feet)2 This formula includes the effect of signal reflections. The Effective Radiated Power (ERP) in a particular direction depends on the vertical and horizontal antenna patterns. A composite vertical antenna pattern is used to determine the predicted power density. This composite antenna pattern is a worst -case envelope that encompasses the maximums of the downward lobes of the vertical patterns of the T-Mobile antennas. The RF power density and RF exposure calculations predict that RF exposure conditions inside the project building, and on all adjacent properties, due to the contributions from all of the T- Mobile antennas, will be well below the 100% of the Public exposure limits established by the FCC. The operation of the modified T-Mobile facility will NOT create significant RF exposure conditions in any occupancy, habitable space or publicly accessible area below the roof of the project building. Hatfield & Dawson Consulting Engineers 5 COMPLIANCE WITH FCC AND LOCAL REGULATIONS The modified facility is expected to be compliant with FCC rules regarding public RF exposure provided that direct access to the T-Mobile antennas is positively restricted. The modified T- Mobile facility will not cause any nearby existing wireless facility to exceed NIER exposure standards below the roof of the project building. Therefore the modified T-Mobile wireless operations at the project site will not have a significant environmental impact below the roof as defined by the FCC Public MPE limits. COMPLIANCE WITH FCC REGULATIONS FOR RF EMISSIONS AND RF INTERFERENCE It is expected that the RF interaction between all of the T-Mobile wireless operations will be low enough to preclude the likelihood of localized interference caused by the modified T-Mobile wireless facility to the reception of any other communications signals. All of the T-Mobile antennas will be sufficiently high enough, and far enough removed from all occupancies, that they are unlikely to cause interference with nearby consumer receivers or other consumer electronic devices. Transmission equipment for the modified T-Mobile wireless facility is certified by the FCC under the equipment authorization procedures set forth in the FCC rules and guidelines. This assures that the wireless facility will transmit within the desired base -station frequency bands at authorized power levels. The modified T-Mobile wireless facility will operate in accordance with all FCC rules and guidelines regarding power, signal bandwidth, interference mitigation, and good RF engineering practices. COMPLIANCE WITH LOCAL REGULATIONS Because the modified T-Mobile wireless facility is in compliance with federal rules and guidelines, it is also in compliance with local regulations concerning RF emissions per K.C.C. 21A.26.090 "Interference." Hatfield & Dawson Consulting Engineers 6 The following is the complete text of 47 U.S.C. § 332(c)(7)(8)(iv): "No State or local government or instrumentality thereof may regulate the placement, construction, and modification of personal wireless service facilities on the basis of the environmental effects of radio frequency emissions to the extent that such facilities comply with the Commission's regulations concerning such emissions." CONCLUSIONS BASED ON CALCULATIONS AND REGULATIONS The modified T-Mobile wireless facility "PARK EAST", SE04001A, will be in compliance with current FCC and local rules regarding radio frequency interference and public exposure to radio frequency electromagnetic fields provided that direct access to the antennas on the project site is positively restricted. This conclusion is based on information supplied by T-Mobile wireless representatives, and estimates of future RF exposure conditions due to the modified T-Mobile facility in specific areas with the corresponding safe exposure guidelines set forth in the FCC rules and guidelines, and in King County K.C.C. Chapter 21A.26. The stated conclusions are based on FCC rules and recommendations, and the comparison of predicted RF conditions in specific areas with the corresponding safe exposure limits set forth in the FCC rules. The FCC exposure limits are based on recommendations by federal and private entities with the appropriate expertise in human safety issues. Under the Commission's rules and guidelines, licensees are required to ensure compliance with the limits for maximum permissible exposure (MPE) established by the FCC. These limits have been developed based on guidelines provided by the Institute of Electrical and Electronics Engineers, Inc. (IEEE) and the National Council on Radiation Protection and Measurements (NCRP). Both the NCRP and IEEE guidelines were developed by scientists and engineers with a great deal of experience and knowledge in the area of RF biological effects and related issues.
