The below listed conditions, jobsite rules, and customer call back standards are applicable to all CONTRACTORS, their agents and employees. CONDITIONS The CONTRACTOR warrants that he shall provide and/or agree to the following: 1. Everyone shall maintain a safe jobsite in compliance with applicable codes and ordinances. 2. Each contractor shall file a copy of an injury report with the superintendent within 24 hours of any injury. A written plan to minimize or eliminate the cause of the injury shall be included with the report. 3. Comply with the Affirmative Action Program. 4. Comply with the Immigration and Control Act or 1986. 5. Trained supervision shall be provided for each tradesman performing work. 6. All inspections and subsequent compliance shall be provided by the CONTRACTOR in a timely fashion. 7. All work performed by the CONTRACTOR shall be in full compliance with applicable codes and ordinances 8. The CONTRACTOR shall maintain mandated timely performance of all contractual relations. 9. All of the CONTRACTOR'S work shall be done with full crews. Appropriate to the needs of the application. 10. The CONTRACTOR shall perform field measurements, verify dimensions on drawings, become and remain informed of all applicable building codes, and obtain the appropriate inspections and certifications. Any variation from the plans and specifications to maintain compliance with code shall require the CONTRACTOR to inform the OWNER, in writing, prior to doing so. 1 l . All plans, blueprints and construction related documents are confidential and the property of the OWNER, and shall not be reproduced, divulged or otherwise imparted to a third party or organization without the written consent of the OWNER. 12. The Subcontract Agreement shall not be sublet to any other person or organization without the written consent of the OWNER. 13. All work shall be done in a professional mariner with the highest degree of quality. 14. If applicable codes or building department approved plans are more restrictive than the OWNER Standards, the more restrictive shall govern. Any variation from the plans and specifications to maintain compliance with code shall require the CONTRACTOR to inform the OWNER, in writing, prior to doing so. 15. Color Sheet Verification for all finish trades: Prior to starting any painting, hard surface material installation, or carpet work, the CONTRACTOR will verify all color and material selections to be installed with the unit color sheet. 16. When work requires correction, OWNER shall notify the CONTRACTOR of the need for correcting the work, and shall provide the CONTRACTOR a reasonable period of time within which to correct the problem. If the CONTRACTOR fails to correct the work to the satisfaction of OWNER, then OWNER will withhold payment from the CONTRACTOR until the CONTRACTOR does complete the work to the satisfaction of OWNER or else OWNER shall itself correct the work and appropriately backcharge the CONTRACTOR. Any backcharge by OWNER to any CONTRACTOR shall include the administrative costs incurred by OWNER in addition to the actual labor and materials. JOB SITE RULES 1. The OWNER Standards shall be adhered to at all times. 2. No personal trash shall be left anywhere on the job site. All hazardous wastes shall be property stored and removed from the site upon completion of the contract. 3. Every CONTRACTOR is responsible for putting his own scrap material in the approved location on a daily basis. Each home, unit or space must be left clean daily and for the next CONTRACTOR. 4. Recyclable, such as wood and cardboard, shall be kept separate from refuse and in an approved location for convenient pick-up. Each CONTRACTOR is to break down their cardboard and deposit in the approved location on site. 5. Materials supplied by OWNER shall be stacked neatly and/or stored properly. 6. Foul language is prohibited on site, CONTRACTOR shall remove from the project any and all employees, who are considered unsatisfactory by OWNER. CONTRACTOR shall indemnify and hold OWNER harmless against any claims, actions, or demands against any damages, liabilities, or expenses arising out of any such removal. Where a controversy arises concerning union labor jurisdiction covering any portion of the CONTRACTOR'S work, at OWNER 'S option, such work may be awarded to others and not performed by CONTRACTOR. 7. Smoking is prohibited in homes, units and common areas after drywall installation. Smoking in the concrete parking garage is permitted. 8. Consumption or possession of alcoholic beverages, drugs or other controlled, or illegal substances are not allowed. Evidence of intoxication of the same is prohibited on the job site and will be cause for immediate removal of offending individual(s) from the job site by the OWNER. 9. All materials and equipment shall be installed per the manufacturer's instructions except where agreed upon by a separate written document approved by the Construction Manager. 10. Portable toilets shall by used; not the house bathrooms 11. All vehicles shall be parked as directed. 12. Radios shall be played at a low volume. If normal conversation is not possible, it is too loud. OWNER reserves the right to ban radio usage from any job site that has a continued problem. 13. The CONTRACTOR shall inspect all previously performed work which his work may cover, and report any noticeable blemishes, flaws and/or discrepancies in the material or workmanship to OWNER prior to performing his work. Any such surface not so reported by the IT) c) m —1 rrt CONTRACTOR shall be reworked by the CONTRACTOR at the CONTRACTOR'S sole expense, after repair or replacement of the unacceptable surface. 14. Protect surrounding finished surfaces so as not to damage them when installing your own work. 15. Nothing shall be left on a finished surface which has the potential to damage it. 16. Anyone needing to move any appliance on the finish floor (hardwood, granite, marble, vinyl) must use adequate floor protection. Acceptable protection: laminate strips, Teflon/nylon strips, appliance air -sled. Do not use Cardboard or vinyl to move appliances. 17. Carpeting shall be protected from all tools, material, debris, dirt, sawdust, etc. and CONTRACTOR is required to clean up after job is completed. 18. Anyone working in a unit after insulation has been installed shall be responsible for heat and/or lock -up. Heat shall be set no higher than 75 degrees during the day and 55 degrees during the night. Door window and access panels shall be kept closed to conserve energy. 19. Extras and changed orders must detail resources used and be negotiated and signed by the supervisor in advance or commencing the extra work, or charges will be disallowed. All time tickets, material delivery tickets, change orders, and work orders shall be turned in to the site supervisor mail slot daily. 20. All CONTRACTORS digging or excavating to a depth of 12" or more are required to call for Utility locates no less than 48 house prior to work commencing. CUSTOMER SERVICE CALL BACK STANDARDS 1. Spread visqueen or drop cloths in the area in which you will be working. 2. Remove your shoes, put shoe protectors on, spread visqueen or drop cloths over the traffic areas. 3. If Tenant is there during repair, do not leave without informing tenant of the status of the job. If you are not finished advise them what need to be done, approximately when it will be done and who will contact them to reschedule. If the tenant is not there, leave a business card or note with the same information. Then follow up with Brad Decker at the OWNER'S office. 4, If you are running late, or unable to make your appointment, advise the tenant so they do not wait around all day. If you are unable to contact the tenant, contact Brad so he can contact the tenant for you. 5. Return all call-back slips to our office, signed by the tenant or you with the completion date, within the designated time at the bottom of the form. If you can not finish the job within this amount of time, call to let us know when it will be dona, otherwise you check will be held. 6. Support other trades. Criticizing others work is unprofessional and shows lack of good judgment and integrity. If you think someone has done a substandard job, notify our office rather than adding to the purchasers or tenant's anxiety. 7. Please leave the job clean after every service call.
